Question # 1 - Please clarify whether this requirement may be satisfied by a qualified proposed small-business manufacturer/subcontractor facility located within the required 35-mile radius, with (contractors name) remaining the prime contractor and fully responsible for performance, or whether the prime offeror itself must own, lease, or otherwise directly operate the qualifying facility.

Answer #1 - Yes. The 35-mile facility requirement may be satisfied through a qualified proposed small-business manufacturer/subcontractor facility located within the required radius, provided that [Contractor Name] remains the prime contractor and retains full responsibility for all contract performance requirements, including timely delivery. The prime contractor is responsible for ensuring that all signs comply with the contract specifications and pass Government inspection and acceptance. The Government will not be liable for any costs, charges, rework, replacement, transportation, or other expenses resulting from signs that fail inspection or are not accepted. Any costs associated with correcting deficiencies or otherwise achieving inspection and Government acceptance shall be the sole responsibility of the prime contractor.

The prime contractor is further advised that the required delivery date remains unchanged.

All required signs must be delivered, inspected, and accepted by the Government no later than September 30, 2026. Any use of a subcontractor or third-party facility must not delay performance or affect the Government’s required delivery schedule. The risk of any production, quality-control, transportation, rework, or acceptance delays remains solely with the prime contractor.
