About this file

This is an amendment to a request for proposal for permanent housing construction repair services in Saipan. The amendment removes one property from the base scope of work and replaces it with a property from the option, reducing that quantity to four homes. It also updates pricing, specifications, and responses to questions. Services required include general construction, demolition, design, permitting, and repair of 17 homes damaged by Typhoon Yutu to a safe and functional condition. The contractor must use local materials and labor to the greatest extent possible. The period of performance is 195 calendar days with a maximum of 120 days to complete repairs after notice to proceed. Pricing is firm fixed price by line item. The federal agency is FEMA Region 9 and work will take place in Saipan and Tinian.

RFP: 70FBR921R00000003 AMENDMENT 1

SECTION C – DESCRIPTION / SPECIFICATIONS

PERMANENT HOUSING CONSTRUCTION (PHC) REPAIR

STATEMENT OF WORK (SOW)

1. Background

On October 24, 2018, Category 5 Typhoon Yutu, the strongest typhoon to impact the Commonwealth of Northern Marianas Islands (CNMI) on record caused catastrophic damage to the islands of Saipan and Tinian. Typhoon Yutu caused one death, downed power poles and damaged vehicles, schools, hotels, businesses, airports, and hundreds of homes on both islands.

The U.S. President signed a Disaster Declaration on October 27, 2018 making funds available to the Federal Emergency Management Agency (FEMA), to provide disaster assistance to Saipan and Tinian.

The Office of Response and Recovery (ORR), Recovery Directorate is seeking to repair and/or replace eligible applicant’s housing affected by the disaster. The services required are in support of the Individual Assistance (IA) Program DR-4404-MP.

2. General Scope of Work

The purpose of this procurement is to acquire construction services to repair eligible applicants’ dwellings impacted in Saipan to a habitable; safe, sanitary, and functional condition per the applicable Federal, State and Local codes. FEMA defines “habitable” as safe, sanitary, and functional. “Safe” refers to being secure from disaster-caused hazards or threats to occupants; “sanitary” refers to being free of disaster-caused health hazards; and “functional” refers to an item or home capable of being used for its intended purpose.

The Contractor shall ensure compliance with 2018 International Building Code (IBC) for high wind and flooding hazards, to include seismic zone 4 code, permitting, licensing, Federal floodplain management standards and environmental/historical preservation requirements. Please see exceptions to the applicable code requirements, listed below. Utilizing the individual scopes of work that the U.S.

Government (USG) will provide, all repair work must be performed by licensed building Contractors, authorized to work in the CNMI, using materials of average quality for the lowest price (“builder grade”), IBC minimum code compliant materials and employing at a minimum 30% local labor (IAW FAR 52.226- 5), to the greatest extent possible.

The Program activities require the services of professional construction technicians, engineers, and other related technical specialists with knowledge, experience, and expertise in the professional field of construction services, project management; supply chain/logistics, workforce mobilization & sustainment.

The only items authorized for repair are shown below and the Contractor shall not deviate from this approved list, unless authorized by the Contracting Officer (CO).

2a. Exceptions

It is not the Program's intention to bring every aspect of an existing structural, electrical, plumbing and/or other building systems up to current code requirements except, where expressly required by the referenced codes or when making authorized repairs to disaster caused damages, or to ensure safe conditions. Eligible items that are storm damaged shall be repaired as per code requirements, except in cases where FEMA and CNMI have determined otherwise:

See attached five (5) waiver letters.

1. Waiver of Sprinkler Installation for Residential Structures

2. BECQ Property Clearance Permit and Individual Wastewater disposal system – Legal

Ownership Waiver

3. Zoning – legal Ownership Waiver

4. Letter for DPW Waiver

a) The Contractor shall repair one bathroom per property to meet FEMA requirements, whether an interior or a non-traditional bathroom. Ceramic tile shall be installed on shower enclosure walls to within a height of 72 inches to 74 inches from the floor, and on shower enclosure floor and bathroom floor for one bathroom to ensure the area is sanitary and safe, as necessary. Isolation valves shall be furnished and installed where necessary to prevent active leaks when water is turned on to plumbing equipment required to make the home safe, sanitary, and functional.

b) The contractor shall provide termite remediation for all properties prior to the beginning of construction.

c) If a home did not have windows prior to Super Typhoon Yutu (in the CNMI, not all homes have traditional windows, and may just have screens or portals that are boarded up in times of inclement weather) the Contractor shall only install shutters as required by the approval memo for mitigation as it relates to 2018 IBC Code. In summary, no upgrades to the pre-disaster condition of the home are to be provided; only the items listed in the above section(s) of this SOW, if they pre-existed, and had been damaged by the disaster, will be repaired.

d) If structural elements of the pre-disaster primary residence, (e.g. foundation, frame), or other components of the home requiring architectural or engineering services require repair, the home is not eligible for PHC-Repair, except that repairing or replacing roof framing is eligible so long as the structure can support a 2018 IBC compliant roof.

3. Tasks

a) The Contractor shall obtain all required permits and comply with all applicable U.S. & CNMI Environment and Historical Preservation (EHP) laws, regulations, executive orders, and building codes, as applicable. The Contractor shall perform repairs on all assigned residential homes of multiple construction types existing in the CNMI (e.g., wood frame, concrete, brick, etc.). The types of homes may consist of a mix between 1- and 6-bedroom homes. The USG requires the Contractor to submit 100% drawings within the first 60 days from the issuance of the first Notice-to-Proceed (NTP) and to complete each repair work order within 120 calendar days [maximum] from the Second NTP, and operate toward completion with a sense of urgency;

always leaning forward in its planning, operations and reporting in order to complete the repairs as quickly as is possible.

b) Each of the homes will have an associated work order defining the scope of repairs. 6c. Archeologically Sensitive Zones (ASZ)

The Contractor shall comply with all applicable Environment and Historic Preservation requirements mandated by Federal laws, regulations, executive orders, CNMI officials, and the Contracting Officer.

This may include, but is not limited to, a requirement allowing a USG Archeologist or USG contracted Archeologist to be present on-site during any ground disturbing activities, such as, foundation or utility installation work, installation of septic systems, installation of ADA ramps, or any activity entailing excavating, digging, trenching, or post-installation for work in designated Archeologically sensitive areas.

The Contractor must take appropriate action based on the Contracting Officer’s direction based on specific guidance provided by the Archeologist to protect/preserve Archaeological resources, as necessary. Since a USG/Contracted Archeologist’s presence is required during all ground disturbing events, each house project in an Archaeological sensitive area may be started independently from other Archaeological house projects awarded on the contract. Therefore, the Notice-to-Proceed (NTP) for each house project and schedule may be independent of the other Archaeological house projects NTP(s) and completion dates. Each Civil Design plan will require a FEMA EHP review prior to any debris removal, demolition, and any ground disturbing activities. Prior to any ground disturbing activities, at least a 48-hour notification is required. This advance notice can be added to the Deliverable 7 requirement with the Daily and 48-hour look ahead schedule if it clearly identifies all ground disturbing activities.

7. Period of Performance

The overall contract period of performance (POP) is 195 calendar days from the date of award. This timeframe includes a maximum of 10 calendar days for the Contractor to furnish the performance and payment bonds, a maximum of 180 calendar days for the two combined Notice-to-Proceeds (NTPs) timeframe (first NTP is for a maximum of 60 calendar days and second NTP is for a maximum of 120 calendar days), and five (5) calendar days between Phase I and II, i.e., between first NTP and issuance of second and final NTP. The five (5) days allows the Government time to examine and approve all submittals required in Phase I (First 60-day NTP) before the second and final NTP is issued for 120 calendar days. The first NTP will be issued for pre-construction work which consists of obtaining permits, ordering materials, demolition, any required designs. Note: Some construction work requires obtaining permits prior to work. The period of performance for the first NTP is no more than 60 calendar days. The second NTP will be issued to repair the house and cleanup activities and will be for no more than 120 calendar days. The first NTP will be issued after receipt of acceptable performance and payment bonds, which is due to the Contracting Officer not later than 10 days of receipt of the contract. The Contractor shall participate in the contract kick-off meeting at the USG discretion after contract award, on the date/time specified by the Contracting Officer or his/her designee.

8. Area of Operation

The Contractor shall be tasked with performing this activity as directed by FEMA; nominally in or around multiple areas in Saipan to be determined per FEMA’s need. The Contractor shall provide a schedule to FEMA in writing where it is planning to perform construction services at least 48 hours prior to commencement of the work.

9. Experience / Skills

The Contractor shall provide personnel with expertise and certification in construction services. The Contractor shall identify shortfalls in skilled labor and provide immediate strategies for addressing shortfalls in its proposal. Where discrepancies, deficiencies or weaknesses are identified by either FEMA or Contractor, the Contractor shall be responsible to make correction(s) immediately, such that these short-falls as identified will not cause a delay in the completion of a home repair due to these short-falls.

The Contractor shall conduct preliminary background checks on all staff assigned to the contract and receive favorable results. This process will increase the likelihood of personnel submitted for FEMA’s background investigation receiving approval.

10. Project Execution

The Contractor shall execute the permanent housing repair mission per the purpose and scope above and the contract terms and conditions, to include contract clauses, per USG work orders issued for repair, and per the Contractor’s accepted Project Management Plan and proposal.
