Government Reponses to Offeror Questions

1.

Solicitation Section/Subsection Number: L.6.c Page Count

Question: In RFP Section L.c.6, the Government provides page limitations for Section I Technical and Section II Past Performance. It is noted that the page limitations exclude “executive summaries, table of contents, FCC certificates and subcontract agreements/letters of commitment (if any).”

Will the Government permit Offerors to include a Requirements Traceability Matrix that is also outside of page count?

ICE Response: See updated Section L.6.c.

Solicitation Section/Subsection Number: L.6.a Format

Question: In Section L.6.a, the Government indicates “Font within charts or tables may be smaller than 12-point but no smaller than 10-point.”

Will the Government permit Offerors to use the Arial font family for Charts, tables, and graphics?

ICE Response: As stated in Section L.6.a, “Times New Roman” font is required.

Solicitation Section/Subsection Number: L.6.b File Packaging

Question: In Section L.6.b, the Government indicates “Proposals shall be submitted in five (5) sections.”

We assume the Government intends for each “section” to be submitted as a separate file. Is that correct?

ICE Response: Correct, the responses shall be separated into five separate files.

However, multiple sections may be submitted via a single e-mail.

Solicitation Section/Subsection Number:

L.6.c Page Count L.Section II Past Performance

Question: In Section L.6.c, the Government indicates past performance references are “NTE 2 pages per reference”. In L.Section II Past Performance, the Government indicates Offerors are to include “Contract Descriptions, Performance, New Corporate Entities, and Past Performance Questionnaires” in this section.

Will the Government confirm the 2-page limit applies to Section 2 (Performance) for each reference and that Section 1 (Contract Descriptions) and Section 2 (New Corporate Entities) are excluded from page count?

ICE Response: The two (2) page limit is inclusive of all subsections of Section-II Past Performance with the exception of subsection (4) Past Performance Questionnaire.

Solicitation Section/Subsection Number: L.6 Content Requirements

Question: Section L.6 Content Requirements states, “Offerors who propose to use subcontractors shall provide the same information as is required for the prime offeror in accordance with FAR 52.215-1. Subcontractor information submitted in response to FAR 52.215-1 shall not count against the page limit (See Page Count paragraph.

Section L.6.c.).”

It is unclear how this FAR clause applies; will the Government clarify what information is required for subcontractors?

ICE Response: See updated Section L, this statement has been removed.

Solicitation Section/Subsection Number: Attachment 2 Paragraph 2 ECMS

Question: Attachment 2 Paragraph 2 states, “Staffing ratios of ECMS participants to Case Specialists are at a rate of no more than 40 participants to one Case Specialist.

All C-sites shall have at least one Case Specialist trained in providing enhanced services and capability to track referrals for stabilization service.”

We assume that by “participants”, the Government is referring to “adults 18 years of age or older” rather than all members of the family unit. Is that correct?

ICE Response: Correct, “participants” refers to “adults 18 years of age or older,” not all members of the family unit.

Question: Attachment 2 Paragraph 2 states, “Staffing ratios of ECMS participants to Case Specialists are at a rate of no more than 40 participants to one Case Specialist.

All C-sites shall have at least one Case Specialist trained in providing enhanced services and capability to track referrals for stabilization service.”

We assume ECMS Participants are only to be assigned to C and/or G sites. Is that correct?

ICE Response: ECMS Participants are only assigned to C-sites.

Question: Attachment 2 Paragraph 2 states, “Staffing ratios of ECMS participants to Case Specialists are at a rate of no more than 40 participants to one Case Specialist.

All C-sites shall have at least one Case Specialist trained in providing enhanced services and capability to track referrals for stabilization service.”

Will the Government provide ECMS Participant forecasts for each C and G site?

ICE Response: ECMS is a relatively new component of the ISAP program and therefore the Government is unable to provide accurate forecasts by site.

Solicitation Section/Subsection Number: Attachment 2 Paragraph 3 ECMS

Question: Attachment 2 Paragraph 3 states, “All adult individuals and their non- United States citizen dependents (defined as riders) are eligible.” SOW Section C.1 Paragraph 3 states, “ATD/ISAP also offers services for foreign-born minor children (defined as riders) of enrolled participants under the Extended Case Management Services Program (see Attachment 2-Extended Case Management Services Program).”

Will the Government specify whether all Participants with “Riders” are to be enrolled in ECMS?

ICE Response: Enrollment into ECMS is determined by ERO on a case by case basis. Therefore, the Government cannot specify whether all participants with “Riders” are to be enrolled in ECMS.

10.

Solicitation Section/Subsection Number: L.6 Transition Plan

Question: Section L6 sub-factor 2 Operations Plans includes instructions for a Transition Plan, which covers the “’ramp up during the six (6) month transition-in period.” It does not mention a Transition-Out Plan.

When does the Government intent to provide the incumbent’s “Ramp Down” plan?

ICE Response: The Government will not provide the incumbent’s “Ramp Down” plan.

11.

L.3 Clauses Incorporated by Reference; M.2 Source Selection Process

Question: Section L.3 includes a reference to HSAR 3052.219-71, DHS Mentor Protégé Program (Jun 2006). Section M.2 indicates “subcontracting plan will be reviewed and accepted or not accepted by the Government however, it is not a weighted evaluation factor.”

Does the Government intend to afford evaluation credit to those contractors with qualified DHS Mentor Protégé Agreements?

ICE Response: The Government does not intend to afford evaluation credit to contractors with qualified DHS Mentor Protégé Agreements.

12.

CLIN STRUCTURE – CLIN X004

Case Management

Question: Our understanding is that all individuals in the ISAP program have a case file and will be required for case management. However, the total number of participant days on CLIN X004 for each year is LESS than the number of participant days for Technology (CLIN X006) and Alert Management (CLIN X008). Please clarify the figures for Case Management.

ICE Response: The total participant days for technology days is more than the total participant days for case management. Not all participants are assigned case management (ex. T-site participants).

13.

CLIN STRUCTURE – CLIN X005

Enrollment/Orientations

Question: Please confirm that CLIN X005 is not to be a consolidation line including CLIN X005A and CLIN X005B and that all three of these CLINs are to be priced for each year.

ICE Response: Correct, offerors shall price CLINs X005, X005A and X005B for each year.

14.

CLIN STRUCTURE – CLIN X005A

and CLIN X005B S-Site Enrollments

Question: As the unit of issue is listed as EACH for a single enrollment, please clarify the description of S-SITE ENROLLMENTS / 7 DAYS (CLIN X005A) and S-SITE ENROLLMENTS / 5 DAYS (X005B) since there is no reference to 7 days or 5 days in the SOW.

ICE Response: As noted in the CLIN descriptions, X0005 is addressed in Section C, Paragraph 6.1.f.1, and X005 A and X005B can be mapped to Section C, Paragraph 6.1.f.2. “Partial Enrollments/Orientations.”

15.

CLIN STRUCTURE – CLIN X009

Court Tracking

Question: The draft solicitation listed the unit EACH referring to participant day. The final solicitation listed the unit EACH referring to call. Please define how this is to be measured and tracked as to what constitutes a call for billing purposes.

ICE Response: Court Tracking shall be billed per call to the Executive Office of Immigration Review court line as outlined in Section C, Paragraph 6.1.a. “Court Tracking.”

16.

SECTION 6.0, Paragraph e Staging Site (S-Site)

Question: Sub-paragraph iii states the staging site may be staffed by at least one contractor. Please define the actual manning requirements for staging sites. How does this relate to the CLIN structure and 7 day or 5 day periods.

ICE Response: ERO may determine that a contractor is needed at an S-site to perform partial enrollment duties. If an enrollment is done within 5-days [Monday to Friday] then the 5-day CLIN is used. If an enrollment is done on a Saturday or Sunday, then the 7-day CLIN is used.

17.

Attachment 12 Table for End of FY18 Active Participants by Technology

Question: The table for End of FY18 Active Participants by Technology indicates 39,005 GPS and 49,838 Biometric. The CLIN structure for Technology (CLIN X006) does not support this based on the participant days allocated to Biometric Reporting (CLIN X006C). Please confirm that the table in Attachment 12 is not correct and instead of Biometric, should refer to telephonic which would be more reflective of allocation in CLIN X006.

ICE Response: At the end of FY18, there were 45,699 active participants on Voice Recognition and 4,139 active participants on biometric reporting via a smartphone mobile application.

18.

Solicitation Section/Subsection Number: L.6.a Format

Question: Section L.6.a indicates Offerors are to submit a signed and dated cover letter with their proposal.

Is the cover letter to be submitted as a separate file or behind the title page for each Section?

ICE Response: Offerors shall provide a single cover page for the entire proposal. It shall be the first page of the proposal with no regard to a specific section.

Solicitation Section/Subsection Number: Section C Statement of Work

Question: In respect of the Technology Only sites, will the Department confirm the percentage split between Telephony Reporting, Mobile Biometrics and GPS bracelets?”

ICE Response: See updated Attachment 7 – Location Overview (Tab 2).

20.

Attachment 1 Monitoring System Integration

Question: The paragraph “Interfaces with other government systems”, that was in the Draft RFP, has been removed. The interface to EOIR /Pacer Court system will significantly improve the efficiency of the system and reduce the number of human errors due to manual data entry and reduce the cost. Is it possible to put this interface back in scope?

ICE Response: The Government will not require an EOIR/Pacer Court system interface for this procurement.

Question: Will the EARM interface be available at the inception of the contract?

ICE Response: The EARM interface requirement was removed in the final RFP. See updated Attachment 1 - Detailed GPS Ankle Bracelets and Tracking/ Monitoring System, Telephonic Reporting System, Biometric Reporting System.

Question: Will the EARM interface be the only means of enrolling new participants in the Contractor Case Management system?

Question: The QASP in Attachment 9 includes: “Develop and Implement Mobile Application – Case Management / Monitor System AQL of 99.999%”

Will the Government permit scheduled maintenance windows at Government approved times to allow for system patches and upgrades? If yes, will these Government-approved maintenance windows be excluded from counting against the AQL requirements outlined in the table of attachment 9, Section 6.0 Methods of Surveillance?

ICE Response: Yes, scheduled maintenance windows will be permitted.

Question: The QASP in Attachment 9 includes: “Maintain Optimal GPS Performance AQL of 99.999%”

Will the Government permit scheduled maintenance windows at Government approved times to allow for system patches and upgrades? If yes, will these Government-approved maintenance windows be excluded from counting against the AQL requirements outlined in the table of attachment 9, Section 6.0 Methods of Surveillance?

ICE Response: Yes. See ICE Response to Question #24.

Question: How long does the government expect it will take to grant approvals of the agreed upon web service connections between the Offeror’s solution and government systems?

Question: With a July 1, 2019 due date for proposals, and the Government’s fiscal year (and current contract expiration) ending September 30th, will the Government please provide an estimate of when an award announcement would be made resulting from this procurement process?

ICE Response: The Government intends to make an award announcement prior to September 30th.

M.2.1 Section I: Factor 1 – Technical

Question: Given the scale and nature of this important program for DHS/ICE, will the Government please consider adding a system testing (equipment and software) step as part of the evaluation process within this procurement?

ICE Response: The Government will not conduct system testing as part of the evaluation process.

Attachment 1 B.9 Monitoring Equipment/GPS

Question: Will the Government please disclose how many signal range extenders (also known as ‘beacons’) are in use daily with the current GPS devices? A rough percentage would suffice as this impacts the pricing/cost assumptions.

ICE Response: The Government cannot provide this information.

Attachment 1 b. iv Monitoring System Architecture

Question: Will the Government please disclose how many times (average) per month the current contractor is contacting the clients due to strap tamper alarms? (iv. The Contractor shall telephonically contact the Participant immediately upon system notification of a band or device tamper alert). These requirements have pricing/cost impacts, and therefore the details are necessary for the Government to receive the most advantageous pricing from the vendor community.

Monitoring System Architecture

Question: Will the Government please disclose how many times (average) per month the current contractor is contacting the clients due to low battery alarms? “The Contractor shall telephonically contact the Participant immediately upon system notification of a low battery alert (25 % battery life remaining)”. These requirements have pricing/cost impacts, and therefore the details are necessary for the Government to receive the most advantageous pricing from the vendor community.

Question: The volume of Voice ID clients on the program has reduced over the course of the current contract, while the volume of clients being supervised with a smartphone monitoring application has risen. Does the Government expect this trend to continue?

ICE Response: The Government cannot accurately predict a trend as multiple factors determine the services to which participants are subscribed. Please use the estimates provided in Section B for billing purposes.

33.

Attachment 1 Multi-Lingual Telephonic Voice Recognition/ Verification Reporting System “g”

Question: Attachment 1 states: “g. The Contractor shall allow land line, voice over IP (internet protocol) or cellular as requested by ERO.”

It is our understanding; cellular carriers are no longer offering the ability to use network triangulation.

Does the government have a special waiver from the cellular carriers for this application?

ICE Response: The Government does not have a special waiver from the cellular carriers for this application. The Government does not utilize network triangulation.

Question: Of the 50,352 C-Site and 2,824 G-Site active participants as indicated in attachment 7, please provide the number of participants requiring 1-week, 2-week, 4-week, 8-week, and 12-week office visits respectively.

After notification of award, when can the awarded vendor expect to receive incumbent personnel information to implement hiring and staffing transition in accordance with this clause?

ICE Response: See paragraph (d) of FAR 52.222-17 for more information on personnel lists.

Solicitation Section/Subsection Number: Section I.2 Clause 52.222-41

Question: Clause 52.222-41, Service Contract Labor Standards is invoked, and occupation code 27101 is indicated for the Case Specialists. This occupation is

GUARD I.

According to the Department of Labor SCA Directory of Occupations, Fifth Edition, the GUARD (Occupational Base) description, “This guard protects property from theft or damage, or persons from hazards or interference. Duties involve serving at a fixed post, making rounds on foot or by motor vehicle, or escorting persons or property.

This worker may be deputized to make arrests and may help visitors and customers by answering questions and giving directions. This person may be required to demonstrate proficiency in the use of firearms and other special weapons and continuing physical fitness.” The GUARD I description, “This guard carries out detailed instructions and procedures primarily oriented to insure that emergencies and security violations are readily discovered and reported to appropriate authority. The primary duty is to observe and report security and emergency situations. This guard intervenes directly only in situations which require minimal action to safeguard property or persons. Duties require minimal training and physical fitness standards.”

The qualifications for Case Specialist in paragraph 4 to include bachelor’s degree and state licensure, would indicate a higher level of position. The low wage rates for the Guard I category compared to the qualifications will lead to high turnover and degradation of services on the program.

Will the Government map the Case Specialist position to 27102 GUARD II to allow for better recruitment and retention of people meeting the degree and licensure requirements outlined in the solicitation?

ICE Response: The requirement remains unchanged.

42.

Question: Given the significant scaling of participant volumes within the program since the 2014 procurement, and presumably a variance in today’s volumes vs. the previously published end of 2018 volumes, will the Government please provide the current participant volumes for all three technologies (GPS, Voice Verification, and Biometric Reporting System)? In addition, will the Government please provide the current daily figures broken out by Full Service vs. Technology Only.

Question: Will the Government provide the current call volumes for the Voice Verification system to include how many calls per participant per month are utilized?

ICE Response: Each participant subscribed to Telephonic Reporting gets one call per month. As of June 6, 2019, there are 43,188 participants on Telephonic Reporting.

44.

Question: It appears the Biometric Reporting System used today (BI SmartLink) was added to the contract/program after the most recent procurement (2014). Given this, will the Government please provide the current per diem price for the Biometric System for both Full Service and Technology Only participants?

ICE Response: The information requested is information that is considered confidential or privileged and cannot be provided.

Solicitation Section/Subsection Number: Attachment 1 General

Question: Will Government please confirm that the incumbent vendor’s case management system & monitoring platform utilize API’s that support automated, electronic migration of Participant case records?

ICE Response: The Government does not track this information and therefore cannot confirm.

Solicitation Section/Subsection Number: L.6.c Page Count and Attachment 1

Question: In Section L.6.c of the Draft RFP, Offerors were instructed to provide a spec-by-spec response to Attachment 1 - Detailed GPS Ankle Bracelets and Tracking/Monitoring System, Telephonic Reporting System, Biometric Reporting System that was not be included in the page count for Section 1 – Technical.

Will the Government please confirm Offerors are still permitted to do this?

ICE Response: See ICE Response to Question #1.

47.

Solicitation Section/Subsection Number: Attachment 1 General

Question: What percentage of ATD Participant Enrollment Forms (Attachment 5’s) will be submitted electronically from EARM to the contractor’s Case Management system and what percentage will be sent via paper?

ICE Response: The Government anticipates that 100% of ATD Participant Enrollment Forms will be submitted electronically.

Solicitation Section/Subsection Number: H.2.2. Preliminary Determination

Question: In Section H.2.2. page 99 it states "ICE may, as it deems appropriate, authorize and make a favorable expedited pre-employment determination based on preliminary security checks." What is expected from the contractor in order to gain approval for expedited pre-employment screenings?

ICE Response: Please see updated Section H.2. language. Contract employees are nominated via the Contracting Officer’s Representative (COR) to begin vetting in support of the contract. Contractor employees nominated by the COR will need to submit the documentation listed in Section H.2.3. Background Investigations. ICE will then make a preliminary Fitness decision and allow a contractor employee to begin supporting the contract while a full field investigation is being conducted.

Question: Since the number of participants receiving Extended Case Management Services (ECMS) affects the staffing ratios, please provide the anticipated number of participants that will receive (ECMS) per location.

Visits

Question: Can ICE provide an estimate of the number of hours per year associated with home visits?

ICE Response: An average home visit takes approximately ten (10) minutes to complete.

Question: Section 6.0 2. d. states "The Government may request that the contractor provide alert management and court tracking services remotely." How many participants are currently being provided with remote alert management and court tracking?

Question: 'Know your Rights" Can this be a video presentation or hand out provided by an attorney?

ICE Response: The “Know Your Rights” presentation shall be conducted in person with handouts.

ICE Response: The Government does not track this information.

Question: Can the Government provide an estimate of the number of hours per year associated with Residency checks?

ICE Response: The Government cannot provide an estimated number of hours per year associated with Residency Verifications. The current contract does not include a Residency Verification CLIN.

ICE Response: Participants are continuously enrolled and terminated throughout the year. Not all participants subscribed to a certain service will remain subscribed to that service for an entire year. Please use the CLIN estimates provided in Section B.

Question: Subparagraph (b) requires notice to the Contracting Officer before removing or replacing Key Personnel. Notice prior to removal is not always practical or possible. The RFP otherwise requires the Contractor to report terminations/resignations (see section H.2.6 Required Reports) within 5 days of occurrence. Further, the contract otherwise requires written approval of the Contracting Officer before an employee is assigned to a Key Personnel role (Section 4.0 a.ii., page 49). Will the government agree to delete subparagraph (b) of this clause or revise it so that notice prior to removal of Key Personnel is not required?

Is the latest data on Form 336 valid?

If not, can the Government please explain why the number is higher?
