70B03C23R00000046 ‐ Southern Border Food Services – 4 Regional IDIQ Contracts

AMENDMENT SEVEN – Questions and Answers Document

1. QUESTION: Please provide clarity on the use and volume of this IDIQ. Per Amend 2, Question 8 the IDIQ is not Mandatory for use by the Government. However, per Amend 3, Question 24 states that the sector stations as indicated in the solicitation shall be required. Are the Station Locations “Required” to utilize this IDIQ for Food Services?

RESPONSE: Amendment Three Question 24 was in response to a question of whether the IDIQ contracts pertain to US Border Patrol Sectors or also include Office of Field Operations Ports of Entry. The response indicated that at this time only the US Border Patrol Sector requirements are to be covered by the anticipated IDIQ contracts.

However, these IDIQ contracts will not be required to be utilized by the relevant Regions/Sectors, and other mechanisms may be used to acquire food services or meals, such as the existing SWB Multi‐Award Blanket Purchase Agreement for Detainee Meals.

2. QUESTION: How long would a detainee be present at the Station Locations before being moved to the Processing Facilities?

RESPONSE: Detainee time on station varies from location to location. Actual requirements for food services under the IDIQ contract(s) will be outlined within each individual Task Order awarded.

3. QUESTION: Under what type of Contract or payment vehicle (credit card or local purchase) are the detainees currently being provided Food Services?

RESPONSE: Meal requirements are being met by various contractual and non‐contractual (purchase card) avenues currently, such as the SWB Detainee Meals Multi‐Award BPA.

4. QUESTION: Asking for volume in a different way. What’s the bedspace capacity at each Station Location? Amendment 4, Questions 4 response states that Estimated requirements for each location are contained in the solicitation documentation. Can you please elaborate as I’ve been unable to locate the Sector or Location expected volumes? (except for the minimum value of $10,001 and Maximum Value up to $45,000,000 which doesn’t help to resolve the question).

RESPONSE: The volume of detainees held at each location is a dynamic and constantly changing number, and specific requirements will be determined by individual Task Orders awarded. Over the last two years, the average meals requirements per location have been as follows:

1. El Paso Sector: 1500 meals daily

2. Miami Sector: 50‐100 meals daily

3. Rio Grande Valley Sector: 2900 meals daily

4. San Diego Sector: 500 meals daily

5. QUESTION: I do not see it stated anywhere but to confirm, is this a LPTA?

RESPONSE: The evaluation criteria for award is contained in the Solicitation Clauses and Provisions document, including the FAR provision 52.212‐2. Please ensure the solicitation documents are read in their entirety. Award is not based on Lowest Priced Technically Acceptable (LPTA) criteria.

6. QUESTION: Can you please clarify the term “reasonable” regarding pricing? Does it protect CBP from unreasonably low bids on this contract?

RESPONSE: The Government will determine price reasonableness based on competition and comparison with Independent Government Cost Estimates in accordance with the evaluation criteria set forth in the solicitation. Price realism analysis will not be conducted.

7. QUESTION: On the current contract for the Southern Border Food Services, what is the price of each of the meals (breakfast, lunch and dinner) in each age group.

RESPONSE: There is no current contract for these services.

8. QUESTION: In the last year, how many meals have been served?

RESPONSE: See response to Question #4 above.

9. QUESTION: What company has the current contract?

RESPONSE: There is no current contract for these services.
