About this file
This is a Business Confidentiality Claim Form issued by the Utah State Archives Office of the Government Records Ombudsman for use in conjunction with the Salt Lake City School District's Invitation for Bid (IFB) for the Emerson Elementary Storm Water Retention Basin project. The IFB solicits qualified vendors to provide all labor, materials, equipment, and services necessary to construct a storm water retention basin in the northwest parking lot area of Emerson Elementary School, located at 1017 East Harrison Avenue, Salt Lake City, Utah. A mandatory pre-bid site visit is scheduled for Friday, May 15, 2026, at 9:00 A.M. in the northwest parking lot, with attendance required for bid eligibility. All questions must be submitted in writing through the Bonfire/U3P system or posed at the pre-bid meeting, with official answers provided exclusively through Bonfire/U3P or authorized addenda. Bids must be submitted electronically through Bonfire/U3P and must include all required documentation, bid bonds, licensing information, and any additional supporting materials as specified in the bid documents.
The confidentiality form allows bidders to protect trade secrets and commercial financial information from public disclosure under Utah Code 63G-2-305 by submitting a concise statement of reasons supporting the claim. Claimants must submit both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to redact proposals on behalf of bidders who fail to provide a redacted copy. The form requires detailed claimant information including company name, address, representative contact details, and specification of which pages and paragraphs of submitted documents require confidential treatment. Submission of a confidentiality claim does not guarantee protected classification if the governmental entity receives a public records request under Utah's Government Records Access and Management Act (GRAMA).

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
