About this file

This is a Performance Bond document issued by the City of St. George, Utah for the 250 West Reconstruction project (Blackridge Drive to Tech Ridge Parkway), Inquiry No. 26-284. The performance bond serves as a guarantee that the selected contractor will faithfully perform all duties, undertakings, covenants, terms, conditions, and agreements specified in the construction contract during the original contract term and any City-granted extensions, as well as throughout a one-year guaranty period following project completion. The bond obligates the contractor and surety to satisfy all claims and demands incurred under the contract and to fully indemnify and save harmless the City from costs and damages resulting from failure to perform, as well as to reimburse the City for any outlays and expenses incurred in addressing contractor defaults. The surety waives notice of any changes, extensions of time, alterations, or additions to contract terms, work scope, or specifications, and acknowledges that no final settlement between the City and contractor shall abridge the rights of any beneficiary with an unsatisfied claim.

The performance bond amount is to be completed at execution and must be dated on or after the contract date. The surety company executing the bond must be licensed to transact business in the State of Utah and appear on the United States Department of the Treasury's most current list (Circular 570 as amended). Per the related Invitation for Bid, 100% payment and performance bonds are required on this project, with the performance bond amount to match the full contract value. A bid bond equal to 5% of the bid amount, issued by a Utah-licensed surety company on a City-acceptable form, must accompany all bid submissions.
