About this file
This document is a Federal Funding Supplement for the South Florida Regional Transportation Authority (SFRTA), detailing federal regulatory requirements and provisions for contracts funded by the Federal Transit Administration (FTA). The comprehensive 43-page document provides mandatory terms and conditions for contractors participating in federally-assisted procurements, covering a wide range of contractual obligations across various types of transportation-related projects and services. The supplement applies to contracts involving public transportation operations, rolling stock procurement, construction, facility improvements, and other transit-related activities.
The document outlines extensive compliance requirements including provisions for civil rights, disadvantaged business enterprise (DBE) participation, labor standards, energy conservation, drug and alcohol testing, telecommunications equipment restrictions, and safe operation of motor vehicles. Contractors must adhere to specific federal regulations such as Buy America requirements, Davis-Bacon Act wage standards, seismic safety standards, and prohibitions on certain telecommunications equipment. The supplement also mandates detailed reporting, certification, and audit processes, with potential consequences for non-compliance ranging from contract termination to debarment from future federal transit assistance. Funding sources are primarily federal, specifically from the FTA, and contractors must demonstrate ongoing compliance with changing federal guidelines and regulatory frameworks.

CONTRACT SUBJECT TO FEDERAL FINANCIAL ASSISTANCE/APPLICATION OF
PROVISIONS AND CLAUSES
This Contract/Project is funded in whole or in part by grants from the Federal Transit Administration (FTA) of the United States Department of Transportation. The award of any contract is subject to the requirements of financial assistance contracts between the South Florida Regional Transportation Authority (hereinafter referred to as “SFRTA”) and the U.S. Department of Transportation requiring compliance with purchasing procedures and standards as set forth in various federal statutes and regulations including 49 CFR Part 18, and the FTA Circular 4220.1G. The Contractor/Proposer/Bidder (may also be referred to herein as only “Contractor” unless expressly indicated otherwise) is required to comply with all terms and conditions prescribed for third-party contracts by FTA. The Contractor is responsible for ensuring its compliance with all applicable FTA requirements. Additionally, the Contractor is responsible for ensuring that subcontractors, at as many tiers of the Project as required, perform in accordance with the terms, conditions and specifications of the Contract, including all applicable FTA requirements. Upon request of SFRTA or FTA, the Contractor shall provide evidence of the steps it has taken to ensure its compliance with the FTA requirements, as well as evidence of the steps it has taken to ensure subcontractor performance, and/or submit evidence of each subcontractor’s compliance at all tiers. The following provisions and required Contract provisions shall be incorporated by reference in the Contract. These provisions are in addition to other General Terms and Conditions, Special Terms and Conditions, Solicitation Documents and Bid or Proposal Forms which may also be incorporated by reference in any resulting Contract. Some provisions require the Proposer, Bidder or Contractor to execute and submit certain required certifications with the Proposal, Bid or Agreement, which are attached to this Federal Funding Supplement. Failure to execute and submit required certifications with the Proposal, Bid or Contract Documents may render a Proposal or Bid non-responsive or an Agreement null and void. SFRTA has provided guidance to the Contractor by indicating applicable provisions and certifications in this Federal Funding Supplement. However, SFRTA shall not be liable to the Contractor whatsoever for any mistakes or errors in determining the application of the provisions or certifications to the Agreement.

hearing, or action, including an investigation conducted by the employer, or is consistent with the Contractor's legal duty to furnish information.
e) The Contractor will send to each labor union or representative of workers with which it has a collective bargaining agreement or other contract or understanding, a notice to be provided advising the said labor union or workers' representatives of the Contractor's commitments under this section, and shall post copies of the notice in conspicuous places available to employees and applicants for employment.
f) The Contractor will comply with all provisions of Executive Order 11246 of September 24, 1965, and of the rules, regulations, and relevant orders of the Secretary of Labor.

2. Prohibit the:
a) Exclusion from participation in employment or a business opportunity for reasons identified in 49 U.S.C. § 5332;
b) Denial of program benefits in employment or a business opportunity identified in 49 U.S.C.
§ 5332; or
c) Discrimination identified in 49 U.S.C. § 5332, including discrimination in employment or a business opportunity identified in 49 U.S.C. § 5332.
d) Follow the most recent edition of FTA Circular 4702.1, “Title VI Requirements and Guidelines for Federal Transit Administration Recipients,” to the extent consistent with applicable federal laws, regulations, requirements, and guidance; but FTA does not require an Indian Tribe to comply with FTA program- specific guidelines for Title VI when administering its Underlying Agreement supported with federal assistance under the Tribal Transit Program.
E. Contractor agrees to include these requirements in each subcontract financed in whole or in part with Federal assistance provided by FTA, modified only if necessary to identify the affected parties.
6. DISADVANTAGED BUSINESS ENTERPRISES (DBEs) [Note: Exhibits 2, 3 and 5 and their associated requirements only apply if there is a specific DBE goal associated with a project.]
A. This Contract is subject to the requirements of Title 49, Code of Federal Regulations, Part 26, Participation by Disadvantaged Business Enterprises (DBEs) in Department of Transportation Financial Assistance Programs. The objectives of 49 C.F.R. Part 26 are:
• To ensure nondiscrimination in the award and administration of U.S. DOT-assisted contracts;
• To create a level playing field on which DBEs can compete fairly for U.S. DOT-assisted contracts;
• To ensure that the DBE program is narrowly tailored in accordance with applicable law;
• To ensure that only firms that fully meet 49 C.F.R Part 26’s eligibility standards are permitted to participate as DBEs;
• To help remove barriers to the participation of DBEs in U.S. DOT-assisted contracts;
• To promote the use of DBEs in all types of federally-assisted contracts and procurement activities;
• To assist the development of firms that can compete successfully in the marketplace outside the DBE program; and
• To provide appropriate flexibility to recipients of Federal financial assistance in establishing and providing opportunities for DBEs.
B. This Contract is subject to the requirements of Title 49, Code of Federal Regulations, Part 26, Participation by Disadvantaged Business Enterprises in Department of Transportation Financial Assistance Programs. Therefore, the Contractor must satisfy the requirements for DBE participation as set forth herein. These requirements are in addition to all other equal opportunity employment requirements of this Contract. SFRTA shall make all determinations with regard to whether or not a Contractor/Proposer/Bidder/Offeror is in compliance with the requirements stated herein. In assessing compliance, SFRTA may consider during its review of the Proposer’s/ Bidder’s/Offeror’s submission package, the Proposer’s/Bidder’s/Offeror’s documented history of non-compliance with DBE requirements on previous contracts with SFRTA.
Each Proposer/Bidder/Offeror shall submit the following with its proposal/bid/offer:
• The Proposer/Bidder/Offeror shall submit separate Schedule of Subcontractor
Participation forms showing DBE and non-DBE subcontractors that they intend to use during the Project (see Exhibit 1). No work to be performed by a DBE shall be included on Exhibit 1 that the Proposer/Bidder/Offeror has reason to believe the listed DBE will subcontract, at any tier, to other than another DBE.
• The Proposer/Bidder/Offeror shall submit the Intent To Perform as a Subcontractor and Proposer/Bidder/Offeror Declaration form for each proposed DBE Subcontractor (see Exhibit 2) which shall constitute a representation by the Proposer/Bidder/Offeror to SFRTA that it believes such firm is ready, willing, and able to perform the work indicated.
This form must be filled out by all DBE subcontracting firms proposed to work on the Project. Each participating DBE firm must have a current valid DBE certification which shall also be attached to this form or provide justification as to how the DBE certification will be obtained prior to award of the Contract. It shall be at SFRTA’s sole discretion to determine if the provided information supports the DBE’s assertion that the DBE certification will be obtained prior to award. In the same form (Exhibit 2), the Proposer/Bidder/Offeror also commits that if it is awarded the Contract, it will enter into a subcontract with such DBE for the work described at the approximate price set forth in the same form (Exhibit 2). If a Proposer/Bidder/Offeror is a DBE and lists itself on the same form (Exhibit 2), it is required to perform the work indicated with its own work force.
If the Proposer/Proposer/Bidder/Offeror is not itself a DBE, nor has plans to utilize an authorized DBE, the Proposer/Proposer/Bidder/Offeror shall write "NO DBEs" on Exhibit 2 and submit the form with its proposal/bid/offer.
• If SFRTA establishes a specific DBE goal for a project (“Contract DBE Goal”), the
Proposer/Bidder/Offeror shall submit the DBE Commitment Letter (Exhibit 3) that certifies compliance with either the Contract DBE Goal for the Project set by SFRTA in the solicitation documents or the Goal of Record which is defined as a DBE participation percentage higher than the Contract DBE Goal than the Contract DBE Goal which the Proposer/Bidder/Offeror certifies it shall satisfy for the Project, as substantiated by the other required exhibits submitted with the proposal/bid/offer.
• The Proposer/Bidder/Offeror shall submit the Proposer’s/Bidder’s/Offeror’s List of Subcontractors/Subconsultants/Suppliers (see Exhibit 4).
• If a Proposer/Bidder/Offeror does not meet SFRTA’s Contract DBE Goal, the Request for DBE Good Faith Efforts Determination (Exhibit 5) should also be submitted when the proposal/bid/offer is due. The submission of this information is considered an issue of responsibility, and SFRTA may not award a Contract to any Proposer/Bidder/Offeror who has not supplied this documentation.
Following submittal of the proposal/bid/offer:
• If the DBE Subcontractor participation changes prior to award of the Contract, the Proposer/Bidder/Offeror will be required to immediately notify SFRTA of the changed amount and the reason(s) for the change.
• If awarded the Contract, the successful Proposer/Bidder/Offeror may not deviate from the DBE Schedule of Subcontractor Participation submitted with the proposal/bid/offer. Any subsequent changes and/or substitutions of DBE firms will require review and written, prior approval by
SFRTA.
