About this file
This document includes a screening information request and related federal contract opportunity notice for a design-build project. The Federal Aviation Administration Northwest Mountain Region is seeking responses for a two-phase evaluation process to select up to three contractors to design and construct an approximately 11,000 square foot administrative support building adjacent to the Airport Traffic Control Tower at Portland International Airport in Portland, Oregon. The estimated value of the project is between $10-15 million. Responses are due by June 18, 2019 and site visits must be completed by June 5, 2019. The project involves building construction, interior design, furniture procurement, and other requirements. The selected contractors will advance to the second phase of the competition for award of the design-build contract.

1. The SIR requests that all parties on the Design-Build Team, including General Contractor, Architect of Record, and Structural Engineer of Record possess professional liability insurance with a limit of at least $1 million per occurrence and $5 million aggregate.
a. If the Design-Build Contractor prime holds such policy, is it necessary to have the subconsultants also hold this coverage?
A. The Architect and Engineers of Record will be required to carry Professional Liability insurance. Also, the A/E is required to carry Errors and Omissions insurance per the following AMS clause:
3.4.1-13 Errors and Omissions (July 1996)
(a) The contractor warrants that it is insured for $200,000 (unless another amount is set forth in the "Schedule") for errors and omissions per claim in an amount in excess of the minimum set forth in the "Schedule" in the performance of this contract.
(b) Unless the contractor's policy is prepaid, noncancelable, and issued for a period at least equal to the term of this contract on an occurrence basis, the contractor must have the policy amended to include substantially the following provision:
"It is a condition of this policy that the company furnish written notice to the U.S. Federal Aviation Administration 30 days in advance of the effective date of any reduction in or cancellation of this policy."
(c) The contractor must furnish a certificate of insurance or, if required by the Contracting Officer, true copies of liability policies and manually countersigned endorsements of any changes, including the FAA's contract number to ensure proper filing of documents.. Insurance must be effective, and evidence of acceptable insurance furnished, before beginning performance under this contract. Evidence of renewal must be furnished not later than five days before a policy expires
(End of clause)
b. Will the FAA allow letters from each entity’s insurance broker stating that the respective insured is capable of obtaining these limits of coverage? For these limits to be possessed at the time of the Phase 1 SIR response will require a significant outlay of premium costs on the part of each team member, with no assurances that the team will advance to Phase 2.
A. Yes, a letter will suffice.
2. On page 15, the SIR says “a complete set of financial statements” is required for Factor 2.
However, Attachment A mentions the financial statements in Section II Pass/Fail and then has a placeholder for them in Section VII. Where does the government want the financial statements?
A. Place them in Section VII
3. Page 22 of 54 asks if the general contractor and/or architect of record is covered by professional liability insurance. For design-build projects, the architect of record typically carries this insurance, not the general contractor. With the use of the word “and” in the first part of the question, is the general contractor also required to carry professional liability insurance for this project, or is the architect of record the only one required to carry the professional liability insurance?
A. Architect and Structural Engineer of Record
1. Part I.B. what is the % Interest in Offeror meant to address? Is this requesting a list of Owners of the Company?
A. Just looking for % interest/ownership (if any) the particular individual has in the company.
2. Part I.B “For Each Offeror Team Member listed above that is not a sole proprietorship….” Is this a request for Operating Agreements or similar for the offerors that are not Corporations?
A. Yes.
3. Part II. The Introduction paragraph reads that if “no” is entered for question 8 “…the Offeror may not be considered…”, and Part V.3. reads “(Licensed professionals must have a current license to practice in the State of Oregon.)”, is it necessary that every engineer and/or architect of record be registered in Oregon since this is a Federal Project, or is there a specific discipline(s) that is of paramount concern?
a. If it is, is the intent to give preference to local firms for this project?
A. No
b. If local firms are not being given preference, our engineers are able to obtain Oregon licenses through reciprocity/NCEES, but may not have received by June 18…is a pending registration acceptable?
4. Part V.3. Can the same individual fill the multiple roles for this contract?
A. Yes
5. Part V.3.j. and V.3.k requests the names of subcontractor project managers…we would compete the project based on #1 qualifications/past performance and #2 budgetary pricing after moving through this initial selection process utilizing the methods described in Part VI of the SIR response. In other words, we are not planning to “sole source” to a particular subcontractor(s) at this point, unless that is the FAA’s desire? Please clarify the expectation for Subcontractor information requested throughout the document.
A. Provide subcontractor information if known at the time of submission.
6. A furniture firm/consultant is mentioned in several locations. Please confirm this is a requirement.
A. It is assumed the DNE will have an Interior Designer on the team.
7. Pages 12, 15 and 54 request an audited financial statement, page 12 seems to indicate that reviewed financials are acceptable with the following statement: “…(or reviewed by an independent party CPA)…”. Are reviewed financials acceptable?
8. Related to RFI #6, if the Offeror provides an internal financial (Balance Sheet and Income
Statement) for the June 18, 2019 submittal, will the FAA still consider the proposal or will they be disqualified immediately? Our CPA has not completed the review and isn’t confident that it will be complete by June 18th, but has committed to completing by mid-July.
A. You may provide the most current year that is available.
1. Do we need to submit a past performance questionnaire for each of the projects required on
Attachment A pages 27-37?
A. Yes
2. Also, since some contracting officers won’t complete PPQs if a CPAR exists. Can we submit CPARS in lieu of the PPQ?
Clarification on FAA Requirements. Certain aspects of FAA Electrical Design requirements will be incorporated into this project. Complete details wil be made available to the three selected DBEs.
4.
1. Please confirm that the relocation of all existing site utilities will not be the responsibility of this design build contract?
A. The Port of Portland is relocating the Chiller water lines and fire water lines under the site. They are being abandoned in place.
2. With regards to the office furniture, is there a dollar value allowance that we should include in our proposal?
A. Furniture is a deliverable. Budget $300K
3. Are we to include all concrete and soil testing in this proposal?
A. YES
4. Under this contract, will the design build firm be responsible for paying for all temporary utilities and consumable fees during construction, i.e ... electric and water?
A. YES
5. Under this contract will the design build firm be responsible for the payment and performance bonds?
A. CONTRACTING OFFICER DETERMINATION
6. Will there be a schematic design phase on the project? Or will FAA provide a floor plan(s)? So that we start the project at the design development stage?
A. PROGRAMING INFORMATION WILL BE PROVIDED
7. Will there be progress review meetings? If so at what point? 25%? 50%? 90%?
A. YES PPD, 45%,70%, 100%
8. Since the site is currently a parking lot (impervious) will there not be any requirement for detention? Will down spouts be hard piped to the subsurface drainage system or will they discharge at grade?
A. DESIGN BUILDER - TBD
9. Are there any special requirements for the exterior skin of the new building? i.e ... blast proof or bullet proof provisions?
A. TBD
10. Are there any Green requirements or standards that will need to be met?
A. HIGH PERFORMANCE SUSTAINABLE BUILDING REQUIREMENTS
11. Are there any minimum building insulation standards above what the IECC requires?
A. TBD – AT NEXT PHASE
12. Are there any site-specific architectural covenants or requirements that need to be complied with? Is there a review process for approval of the exterior finishes & building appearance? If so, what is that process and how long does the process take from submission to approval?
A. TBD – AT NEXT PHASE
13. Will FAA provide soil information? i.e ... borings? Nuclear density?
A. DESIGN BUILDER RESPONSIBLE FOR GEOTECHNICAL DESIGN, SOME GEOTECH
REPORTS WILL BE AVAILABLE AT NEXT PHASE
