1.) Reference: Section 2.0 - The work to be performed under this contract will be funded and executed via individual Task Orders as outlined in Paragraph 7.1 of this SOW.

Question: Is it the intent of the government to award individual task orders per research participant project? Or will single task orders cover multiple data collection events?

FAA Response: Individual Task Orders will be used per research participant project.

2.) Reference: Section 2.0 - All travel must be approved by the COR before travel arrangements are made.

Question: Is it possible that sweeping approval for each effort can be submitted at the beginning of a TO/project rather than a one-by-one basis?

Preparing/submitting and then waiting for COR approval can significantly impact travel arrangements for participants - especially when they are backfilling a cancel or are a last-minute fill.

FAA Response: Yes, travel can be preapproved for a project without the need to do individual travel requests.

3.) Reference: Section B - Excel worksheet

Question: The section B document specifies an estimated number of hours per participation, per participant category. Participants should be paid for travel time if the data collection requires travelling participants. Is this the understanding of the government as well? The estimated number of hours will be considerably greater than what is noted if participants are traveling. We typically see 4 hours per travel day allowed.

FAA Response: Participants will be compensated for travel as necessary, and this will be further defined in each individual task order based on the need of the individual research project. For the purpose of hourly estimates, travel is incorporated in the estimated hours as listed in

Section B.

4.) Reference: Section 6.4 C: The Contractor must invoice separately with and provide an attached list of subjects and hours related to each study monthly.

Question: Is the expectation that each task order will be invoiced separately and further broken down to provide detail of each ongoing data

collection project on the task order?

FAA Response: Yes

5.) Reference: Section 6.5 - The Contractor may invoice to the COR/Delphi Invoicing at the conclusion of each session. All test participants will be evaluated for acceptance with individual project requirements.

Question: The contractor must submit names 5 days in advance of travel but how far in advance will participants need to be submitted for evaluation and acceptance? This requirement may create trouble for recruiting in a fast-paced recruitment/scheduling environment. Can we anticipate a quick review/acceptance on the government side?

FAA Response: This will be defined in the individual task orders based on the project need.

The government will ensure that participants are approved according to the task order and project timeline.

6.) Reference: Section 7.1.3 - During the

Phase-Out period, personnel of the incoming workforce may observe operations and performance methods of the Contractor.

Question: Will this opportunity be available to the awardee of the future participant contract award?

FAA Response: There is not an incumbent contractor, therefore this will not be available.

7.) Reference: Section 3.1.G - The contractor must obtain workers’ compensation insurance for each participant and the contractor must be solely responsible for reporting each participant’s income to the Internal Revenue

Service and fully complying with all relevant state and federal tax laws. In the event that a participant is injured while performing as a research subject, the contractor must be responsible for the cost of required medical care, and any other associated costs such as lost income during convalescence.

Question: In order for a company to provide workers' compensation insurance, they must hire them as an employee. This would mean that each participant would have to be fully onboarded for a day of work and terminated at the end of participation. This type of work would normally fall under a 1099 (or other employment agreement) as opposed to a W2. Is the government amenable to the participant signing a liability waiver as opposed to being covered under the contractors workers compensation policy?

FAA Response: Clauses 3.4.1-10, 3.4.1.12 and

AC3211 Can be found in the posted SIR documents on Pages 29 and 60. The government cannot deviate from these clauses as written.

8.) Reference: Section 3.1.G - The contractor must obtain workers’ compensation insurance for each participant and the contractor must be solely responsible for reporting each participant’s income to the Internal Revenue

Service and fully complying with all relevant state and federal tax laws. In the event that a participant is injured while performing as a research subject, the contractor must be responsible for the cost of required medical care, and any other associated costs such as lost income during convalescence.

Question: Can participants who will not travel or be on center at the FAA be excluded from the insurance requirement?

FAA Response: Per clauses 3.4.1-10 and 3.4.1.12, participants are not exempt based on research location.

9.) Reference: Section SOL-M.1 - Basis for

Contract Award. This acquisition will utilize

Lowest Priced Technically Acceptable (LPTA) procedures to make an integrated assessment for an award decision. No tradeoffs will be made.

Question: Will the government consider best value, or incorporate tradeoffs, as the basis for award? Due to the nature of the work, it would appear mission success and assurances of successful survey completion would outweigh or be equal in consideration to price.

FAA Response: Due to the strength of the market, tradeoffs are not necessary.

10.) Reference: Section B - Section B - All FY

Tabs - ITEM # 00001 - Contractor Support Services

Question: Can the government provide historical workload data on for the Contractor Support

Services CLIN? E.g., historical quantity of hours for this CLIN. This would better inform industry in pricing to an LPTA basis for award.

FAA Response: The number of estimated hours is in the Schedule B document based on historical data and requirements for future participant research efforts.

11.) Question: Is there an incumbent contractor?

If so, can the government provide the contract number?

FAA Response: There is not an incumbent contractor.

12.) Question: Are there any other projects or types of participants anticipated? For example, paid online survey participants, etc.?

FAA Response: The types of participants will be the same as those listed in the SOW, but the method for participant involvement may include paid online survey participants, and this will be detailed in the additional task orders.

13.) Question: What is the actual anticipated date of award for this contract?

FAA Response: Estimated 60-90 days from 25 March

2024 when the SIR closes.

Second: All other Terms and conditions Remain unchanged, Proposals must be received by the FAA

Contracting Officer, Kimberly.sites@faa.gov, no later than 3:00P.M.
