Questions and Answers June 20, 2018
Question 47: Does the SEDB status for one of the partners of a JV transfer to the JV?
Answer 47: No, as previously stated in the answers to Question 16 and 23, the JV must be certified as a SDB by the Small Business Administration (SBA) for participation in the SBA’s 8(a) program.
Question 48: Do we need to be a federal contractor (I guess there is a special classification)?
Answer 48: There are several requirements listed in the SIR that you will have to follow to do business with the federal government (i.e. you will need to be registered in the System for Award Management (https://www.sam.gov). There are many issues like this that are addressed in the SIR so each potential offeror will need to read the entire SIR to make sure that any proposal submitted is responsive to ALL of the requirements of the SIR. Failure to comply with all terms and conditions set forth and contained in this SIR may result in the offeror’s proposal being determined to be non-responsive and ineligible for contract award.
Question 49: Can you clarify the standard size classification of $7.5 million because our company does not have a past performance reference at $7.5M.
Answer 49: The NAICS code size standard of $7.5M and the past performance requirement of a minimum of one (1) contract valued at a minimum of $7.5M are two separate issues. Please be advised that just because a particular offeror might meet the NAICS code size standard doesn’t necessarily mean that the offeror will meet the past performance requirement included in the SIR.
Question 50: The response to question #42 indicates that offerors can only submit contracts on which they have performed for one (1) year in order to meet the Subfactor 1-1: Contractor Experience. This is very different from the requirement in Factor 4, which allows offerors to submit contracts on which they have performed during the past five (5) years. While we realize the Factor 1 and Factor 4 requirements are not completely identical, the basic compliance criteria have remained consistent (i.e., contract value, number of personnel, etc.). This inconsistency drastically limits what offers can provide for experience. Will the government please consider amending the timeline requirements associated with experience and past performance contracts so that it is consistent between the factors and follow the performance within the past (5) years’ timeframe?
Answer 50: Question 42 addressed the minimum period in which the offeror must have "performed" on the one (1) past performance contract and the corresponding answer was that the offeror must have “performed” for a minimum of one (1) year. For example, if a potential offeror was awarded a contract on June 1, 2018, then they have not performed that particular contract for a minimum of one (1) year. The response to this question does not change that past performance references need to have been performed within the past five (5) years.

Question 51: Please confirm whether there are 149 people (based on CLIN 003 LABOR) or 125 people (based on Longevity Information document provided)? Do we assume the 24 personnel missing from the longevity information are for new employees/requirements and they are therefore all under 1 year of service for SCA?
Answer 51: Correct, the Accounting Clerk II positions are a new requirement for this acquisition.
Question 52: Given the significant change in type of procurement set-aside, clarified one week after the initial solicitation release, that impacted many offerors’ eligibility to bid on this procurement, as well as other significant solicitation changes, we recommend the government provide a minimum of a one-week extension to the submission due date.
Answer 52: Please understand that the Government is on a very tight timeline to make a contract award in order to maintain continuity of services. While we do realize that the set-aside did change, potential offerors were made aware of this change on June 8, 2018 and the proposal due date is twenty-five (25) days after the change in set-aside requirements.
Question 52: Please confirm what offerors should submit in response to “detailed pricing information to support all subcontractor costs”? Does this mean that the offeror’s subcontractors are also required to provide separate cost/price details (Direct Labor, Fringe, OH, etc;) and narratives or is the customer looking for additional pricing details from the prime offeror? If subcontractors’ cost data and narrative is required to be submitted, and it is proprietary, can subcontractors meet the hard copy and CD deliverable requirement by submitting a sealed envelope with the prime offeror’s proposal and then submit via email separately from the prime’s email submission?
Answer 52: Yes, the FAA is requesting subcontractor’s detailed pricing information in order to support all subcontractor costs. It is acceptable for subcontractors to submit a CD in a sealed envelope with the prime contractor’s proposal along with an email separate from the prime’s email submission as long at this email clearly identifies the prime contractor to associate with the information.
