About this file

This document provides an amendment and clarification to a draft solicitation for drug testing services from the Department of Transportation. The solicitation seeks proposals from prime contractors for urine, oral fluid, and alcohol testing services. While the solicitation is directed only at prime contractors, it does not prohibit subcontracting arrangements where a firm provides rapid test kits to a prime awardee. However, kit firms cannot propose directly to the DOT as prime or subcontractors, but must market themselves to prime offerors to be included in those proposals. The DOT will not reimburse any costs incurred by kit firms for marketing or proposal preparation. Competition among prime offerors will be the primary factor in selection, though the DOT may engage in pre-award negotiations with proposals in the competitive range. Questions on the draft solicitation were due by February 19, 2023.

Amendment No. 1

To

Solicitation No. 693JK423R500002

This Amendment No. 1 provides an answer to a question posed by an interested firm.

QUESTION 1: May an entity which is not necessarily interested in being a prime-offeror or in being a prime-contractor, serve, nevertheless, as a subcontractor, for the purpose of providing, to this

Solicitation’s resulting prime-contract-awardee-company, Rapid Test Kits for use by that resulting prime contractor in performing this Solicitation’s resulting contract?

ANSWER 1: Subject to the following caveats, this Solicitation does not prohibit such a subcontracting arrangement. CAVEAT A: DOT does not plan to enter directly into any contract with any firm that provides only Rapid Test Kits, and DOT accordingly will not consider proposals submitted by such Kit-firms directly to DOT in their own names as prime offerors, or submitted directly to DOT as proposed subcontractors. Instead, each interested Kit-firm would have to perform its own marketing-efforts, and solely at its own expense, in an attempt to find one or more drug-testing prime-offerors who would be willing to include the interested Kit-firm as a proposed subcontractor in the prime-offeror’s proposal submitted to DOT in response to this Solicitation. CAVEAT B: DOT cannot and will not reimburse any such interested Kit-firm for any of its marketing-effort-costs or subcontractor-proposal-preparation-costs incurred in any such attempt to attach itself, as a proposed subcontractor, to any prime offeror’s proposal. CAVEAT C: Given DOT’s expectation that this Solicitation will result in strong de facto competition among prime-offerors, DOT is planning to allow such a competitive process to function by itself, and without any direct-intervention by DOT in any prime-offeror’s proposed arrangement for providing Test-kits—except, perhaps, by DOT’s potentially entering into a pre-award negotiation-process or discussion-process with prime-offeror-firms whose proposals DOT has determined are within this procurement’s Competitive Range.

This Amendment No. 1 answers no other questions and provides no further clarifications regarding the subject Solicitation.

James H. Mowery III Contracting Officer, DOT June 21, 2023
