About this file
This document is an amendment to a draft solicitation for drug testing services issued by the Department of Transportation. The amendment provides clarifications to questions posed by prospective offerors, including revising pricing tables to separate travel time and extended site time into separate contract line items. The services required include urine, oral fluid, and breath alcohol testing to be conducted at government and contractor sites across the United States and its territories. Offerors must submit pricing for a base year and four option years. Key personnel requirements and evaluation criteria are also outlined, with an emphasis on program management experience, quality assurance, and the ability to provide qualified scheduling and collection staff.

Amendment No. 3 to
Solicitation No. 693JK423R500002
This Amendment No. 3 answers the following additional questions posed by prospective offerors, and provides the following clarifications regarding the subject Solicitation.
3. QUESTION: Re: Section B.2.2-B.2.6 – Pricing tables; Please confirm that the CLIN for
“Collectors/Breath Alcohol Technicians – Time/Travel time is correctly displayed as a “Lot”? These two measures, time and travel time, can vary widely based on a large amount of unknown factors not limited to the actual number of collection events per quarter as well as the randomness of the locations being selected. Would recommend using an hourly unit of measure as well as separating Time and Travel Time into separate CLINs so that the hourly rate could properly reflect the nature of each type.
3. ANSWER: PART A: The CLIN for "Collectors/Breath Alcohol Technicians - Time/Travel time" has been divided into two separate CLINs. The first CLIN, titled "Collectors/Breath Alcohol Technicians -
Travel," will continue to be displayed as a Lot. The second CLIN, called "Collectors/Breath Alcohol
Technicians – Extended Site Time," will be displayed on an hourly basis. PART B: This Amendment No.
3 SUBSTITUTES the revised Pricing-Tables set forth between horizontal lines near the bottom of this
Amendment No. 3, for the Pricing-Tables that were given in Section B of the FORMAL Solicitation that was originally published in SAM.gov on June 15th, 2023.
4. QUESTION: Re: C.3 – Task 1 – Drug Collection and Transportation Requirements; Will the oral fluid and/or hair testing products be provided by the governments contracted laboratory, i.e. Abbott?
4. ANSWER: DOT anticipates that the oral fluid/hair testing products will be provided by the government contracted laboratory and will be ordered through them along with other items such as forms and kits.
5. QUESTION: Re: C.6 – Task 4 – Scheduling, Site Scheduling, Paragraph 10; The last sentence references a “…2-hour site cancellation charge…” however a Site CLIN does not currently exist. How does the government propose that this requirement is met?
5. ANSWER: This charge would be billed to the CLIN entitled Testing/Collection Site Cancellation which is located under Miscellaneous on the Independent Government Cost Estimate.
6. QUESTION: C.11 – Travel of Collector/BAT Personnel; This section twice mentions separating Travel
Time and Site Time and again I will note that the current Pricing Tables do not have CLIN for either, only a “Lot”. Please advise how the government would like these rates addressed?
6. ANSWER: The CLIN for "Collectors/Breath Alcohol Technicians - Time/Travel time" has been divided into two separate CLINs. The first CLIN, titled "Collectors/Breath Alcohol Technicians - Travel," will continue to be displayed as a Lot. The second CLIN, called "Collectors/Breath Alcohol Technicians -
Extended Site Time," will be displayed on an hourly basis.
7. QUESTION: Re: H.9 – Qualifications of Key Personnel, Program Manager; What does the government consider to be “…the equivalent of a bachelor’s degree…”?
7. ANSWER: While a bachelor's degree is preferred, an equivalent level of expertise can be attained with significant work experience (minimum of 5 years) coupled with relevant professional experience, certifications, specialized training programs, and a demonstrated proficiency in administering drug and alcohol testing services.
8. QUESTION: . Section M, p. 210, #4 states that “Each offeror’s proposal shall include Past Performance
References for all companies and Government agencies for whom the offeror has worked—during the three-year-period immediately preceding the publication-date of this Solicitation—on requirements similar to the requirements described in this Solicitation.” In the case of team bids, “all companies and
Government agencies” worked for during the past three years could yield a very large number of writeups. Would DOT consider limiting this requirement to the three most relevant recent contracts?
8. ANSWER: No.
9. QUESTION: Section L, Proposal Volume V: Financial / Organizational Proposal, on p. 198, 2nd bullet at top of page states “The electronic submission(s) of the Business Proposals shall allow the Government to interact with the data.” Some required items may be in the form of images and pdfs that, although legible, do not allow evaluators “to interact with the data.” Could you clarify if the intent is to ensure clarity, legibility, and compatibility for viewing in MS Office vs. actual interactivity?
9. ANSWER: The subject Solicitation is hereby amended so as to say the following: “To the extent possible, the electronic submission(s) of the Business Proposals shall allow the Government to interact with the data.”
10. QUESTION: Section C, p. 52 states “The Contractor shall designate by name a contract administrator for the contract and its task orders …. The Contractor’s designated contract administrator is a key person (see H.10 “Key Personnel”)”. H.10 does not include contract administrator as Key Personnel.
Could you clarify whether the Contract Administrator is a key person on this contract and revise the solicitation accordingly?
10. ANSWER: This Amendment No. 3 STRIKES, from the subject Solicitation’s Section C, the statement that “The Contractor shall designate by name a contract administrator for the contract and its task orders …. The Contractor’s designated contract administrator is a key person (see H.10 “Key
Personnel”)”—because no “Contract Administrator” position will be needed on the contract awarded from the subject Solicitation, because the PM’s duties will include contract-administrator-responsibilities.
11. QUESTION: Re: Section C, part C.1, page 29 states, “The government recommends placing a point of contact (POC) in each office or field subdivision.” Where are these offices located?
11. ANSWER: Under the contract to be awarded from this Solicitation, the schedulers should be using collectors from collection sites in all 50 states, Puerto Rico, U.S. Virgin Islands and certain locations in the Western Pacific area, e.g., Guan , American Samoa, etc. And so this Solicitation’s resulting contract-awardee should have a POC in these locations.
12. QUESTION: Re: Section L, Table of Other Commitments, p. 190 requires estimates for key personnel’s other assignments for all years of this contract (2023-2028). This estimate is highly speculative and subject to surges and fluctuations beyond contractors’ control. Also, some personnel may be contingent hires pending award. Would you consider, instead of this table, bidders’ providing a
Letter of Intent with Key Personnel resumes affirming their intention to work in their respective roles for the duration of the contract, if awarded?
12: ANSWER: Each offeror need only show, in its proposal submitted to DOT, “Other Commitments” which are already made reasonably clear in one or more other awarded contracts currently held by the offeror-company or currently held by one or more of the offeror-company’s proposed subcontractors.
13. QUESTION: Re: Section L, Past Performance Questionnaires, p. 191, states “Each prime offeror should attempt to include…one Questionnaire describing work performed by each separate proposed major subcontractor.” Can more than one PPQ for a major subcontractor be submitted?
13. ANSWER: The subject Solicitation is hereby AMENDED so as to state that there is no upper limit on the number of completed Past Performance Questionnaires that can be included, for any proposed subcontractor, in any offeror’s proposal.
14. QUESTION: Re: Section C.3. Task 1 Drug Collection and Transportation Requirements. “Drug collection kits and forms shall be obtained by the contractor from the DOT contract laboratory in sufficient time to ensure the schedule is not delayed.” Please clarify, is the processing laboratory designated by contractor to include kits and CCF or will DOT designate their own contract laboratory?
14. ANSWER: DOT will designate its own contract laboratory.
15. QUESTION: Re: Page 193, “The offeror shall provide proof of insurance.” This directive falls within
Section L. Is the offeror meant to include a Certificate of Insurance (COI) in the offeror’s Volume I
Proposal submitted to DOT? Is the offeror to include DOT as an additional insured? Before award?
15. ANSWER: Each offeror shall include, in its Volume V Proposal submitted to DOT, proof that the offeror will be in compliance with all applicable Insurance Requirements of the FAR, including FAR Part
28, as of the performance-starting-date of the new Drug Testing Contract to be awarded from the subject Solicitation.
16. QUESTION: Re: Section L, Page 184: There is the requirement that Volume I address Evaluation-
Criterion “A” as set forth in Section M. Page 199 DOT suggests dividing Volume I into three (3) Parts.
Based on page 184, the offeror would be inclined to organize Volume I to address the Evaluation-
Criterion “A” in the order listed in Section M. Page 199 suggests addressing the Evaluation-Criterion “A” in a different order than as presented in Section M. Since the instructions on page 199 fall after the instructions on page 184, can the offeror presume that DOT prefers to address the Criterion listed under
A in a way that groups them as presented on page 199 and not in the order provided in Section M?
16. ANSWER: The Solicitation’s controlling proposal-organization-language is set forth between horizontal lines immediately below in this ANSWER 16, and that language set forth immediately below over-rides any other Solicitation-language which an offeror believes is inconsistent with the language set forth immediately below in this ANSWER 16:
Required Proposal-Volumes:
Each offeror’s proposal shall be presented in the following volumes (electronic-files):
1. ~ a Volume I Capability Proposal addressing major-Evaluation-Criterion “A” as set forth below in Section M of this Solicitation; and
2. ~ a Volume II Technical Plan Proposal addressing major-Evaluation-Criterion “B” as set forth below in Section M of this Solicitation; and
~3. a Volume III Past Performance Proposal addressing major-Evaluation-Criterion “C” as set forth below in this Solicitation, and including at least three completed-by-a-customer versions of the Past Performance Questionnaire Form displayed in this Solicitation’s Attachment J-17;
17. QUESTION: In reference to the Scope of Work: Section - Distribution Requirement - page 23 states:
“Copy 2 - Send in a confidential envelope to the MRO, FAA DPC, or Substance Abuse Awareness
Testing Office (SAATO) as appropriate immediately via overnight courier (no later than 24 hours) after the testing site is completed.” – Are we allowed to transmit Copy 2 of the CCFs to the MRO via secure fax or secure email? Copy 2 of CCF will be transmitted to the MRO no later than 24 hours from the time of collection, as required per DOT regulations.
17. ANSWER: No, Copy 2 of the CCF is not permitted to be sent to the MRO via secure fax or secure email; it must be sent by overnight courier (no later than 24 hours) after the testing site is completed.
18. QUESTION: In reference to the Scope of Work: Section - Collection Site Designation - page 211 states:
“The testing site shall be in commuting distance for the applicant in all but rare cases…..” – Could you please provide the desired/reasonable maximum distance (in miles) from the applicant’s location to the collection site? For example, collection site shall be within 25-mile radius of the applicant’s location.
18. ANSWER: The preferred/acceptable maximum distance is within a two-hour drive for an applicant/employee. However, there may be cases where an applicant/employee resides in a remote area and would need to travel a greater distance.
19. QUESTION: Could you please provide the name of your contracted HHS-SAMHSA laboratory?
19. ANSWER: The current laboratory if Abbot Toxicology.
20. QUESTION: Could you please provide the name of your current contractor for DOT urine collection and breath alcohol testing services
20: ANSWER: The current contractor is Forensic Drug & Alcohol Testing, LLC.
21. QUESTION: Does the incumbent contractor possess any Collective Bargaining Agreement(s) (CBAs) which are relevant to the project envisioned in this Solicitation?
21. ANSWER: The incumbent contractor has stated, to DOT, that it does not possess any such relevant
CBA(s).
22. QUESTION: Which U.S. Department of Labor Wage Determinations and / or Collective Bargaining
Agreement assumptions and /or Bureau of Labor Statistics assumptions would appear to be applicable to one or more portions of the work to be performed in any contract awarded from the subject
Solicitation?
22, ANSWER: At least one prospective offeror has pointed out the fact that the foregoing could be a difficult question to answer in complete detail, since various chunks of any resulting contract’s work could end up being performed in currently-un-finalized-amounts in a number of locations around the
United States. The contracting officer has received an indication that the latest version of Wage
Determination 2015-4281, as issued for the Washington D.C. area by the U. S. Department of Labor
(DOL), might be applicable to some of the work to be performed by this Solicitation’s resulting contract-awardee. The contracting officer is asking that each offeror include, in its Cost Proposal submitted to
DOT in response to this Solicitation, a statement outlining any DOL-Wage-Determination-Assumptions and / or Collective-Bargaining-Agreement-assumptions and / or Bureau-of-Labor-Statistics-Assumptions, and any other assumptions, used by the offeror in compiling its Cost Proposal. No offeror’s Cost
Proposal shall, on its face, show a pricing-system that cannot be plausibly interpreted as being in compliance with DOL Wage Determinations and Collective Bargaining Agreements and Bureau of Labor
Statistics findings.
23. QUESTION: Re: Section M, part A, pages 204 – 205, list of evaluation criteria. The paragraphs are misnumbered in this section, with #2 omitted and both #5 and 6 duplicated. Since bidders need to refer to these paragraphs in their proposals, could you please correct this numbering?
23. ANSWER: Set forth between horizontal lines appearing below this Amendment No. 3’s revised
Pricing-Tables is a re-write of the questioner’s referenced list-of-Part-A-evaluation-criteria, presented in a way that establishes an un-broken continuity for the numbering of those Part-A-evaluation-criteria, but which does not change the substance of the Evaluation-criteria-layout presented in the version of the subject FORMAL Solicitation published in SAM.gov on June 15th, 2023.
