About this file

This document is a special flood hazard areas regulation adopted by the Puerto Rico Planning Board. It establishes the requirements and procedures for managing development within special flood hazard areas in Puerto Rico. The regulation covers topics such as the adoption and mapping of special flood hazard areas, classification of flood zones, requirements for development in different flood zones, permitting and review processes, exceptions and variances, and enforcement. Key details include:

  • The Planning Board is designated as the state coordinating agency for the National Flood Insurance Program and has the authority to adopt regulations and maps for flood hazard areas.
  • The regulation classifies special flood hazard areas into zones such as floodway, coastal high hazard zone, and other flood zones based on FEMA's designations. It provides specific requirements for development in each zone.
  • The regulation establishes permitting, review, exception, and variance procedures that developers must follow for construction, substantial improvements, and other development activities in the flood hazard areas.
  • The regulation aims to minimize flood risks, reduce public expenditures, and ensure compliance with NFIP requirements in order for Puerto Rico to maintain eligibility for flood insurance and disaster assistance.
