About this file
This amendment to a federal solicitation provides responses to bidder questions about Project WV NP NERI 107(2) located in Fayette County, West Virginia. The project involves roadway improvements including granular backfill, MSE wall construction, geotechnical patching, pipe culverts, inlets, manholes, curb and gutter, asphalt paved waterway, and guardrail replacement. The responses clarify that the 20-ton weight limit bridge will not be bypassed but may be upgraded, vegetation can be removed year-round except for trees over 3 inches in diameter from November to April, and that full road closures will only be permitted from November 1, 2024 to March 24, 2025. The amendment maintains the proposal due date of January 30, 2024 and confirms the intent is to award all schedules by June 30, 2024 and issue notice to proceed concurrently for schedules A, B, and C.

The purpose of this Amendment is to:

Responses to Questions
1) Question: Upon an extensive site visit, we observed that the only access to Cunard Road is a bridge with a 20-ton weight limit. Will the contractor be granted the ability to create an easement for bypassing the bridge and it(s) 20-ton weight limit? Are there any additional access points that can be created for the project during this work operation?
Updated Response: The Government spoke with the West Virginia Department of Highways (WVDOH) District Bridge Engineer. The 20-ton current posting for the bridge at 38.001089, -
81.041468 is correct. The bridge is less than 20 feet long, thus, there is no inspection report requirement for the bridge and no inspection report available. The WVDOH’s current plan is to replace the culvert at 37.998773, -81.039622 and immediately afterwards, perform a superstructure rehabilitation on the bridge which will remove the 20-ton posting. This work is supposed to be finished by November 1, 2024.
2) Question: The Specifications do NOT allow us to remove or trimming of vegetation larger than 3-inches diameter at breast height (DBH) (…) from April 1 to November 15.
If we are unable to remove vegetation between April 1 and November 15, there is no way we can start work and meet (the a. Below is the 2nd excerpt on Time Allowed. If we are issued a contract in March then an NTP hypothetically shortly after we will not be able to achieve the schedule below. My first question is, will the NTP be delayed until November 15 due to trimming of vegetation?
Response: The Special Contract Requirements (SCRs) are clear that the vegetation can be removed at any time, and only trees that are larger than 3-inches in diameter at breast height can be removed between November 15 and April 1. The Government hopes that the project will be awarded by March 1, and the Contractor can remove the vegetation between mid-March and April 1, and, if that is not possible, they can remove it after November 15.

3) Question: My next question is, based (on the calendar days duration on Page 30 of the Solicitation (page B-10), why) wouldn’t the Schedule B days of 30 days and Schedule C days of 25 days be added in succession to the 96 days for Schedule A? It appears that if Schedule B and/or C are awarded after Schedule A, a new NTP will be issued for these Schedules. By how it is worded, we could potentially have to complete A, B, and C all in the same time frame. We are recommending that if B and C are awarded, they be in awarded the days noted, BUT in succession to A. I believe that is the intent because by adding 96+30+25 = 151 days. 151 days after November 15 is April 15, 2025, which is what is noted in yellow above. Please advise if this is correct.
Follow up question: Due to the very difficult nature of accessing this project, we will need to take up both lanes (while) performing our work, therefore, we won’t be able to start until Nov 1, 2024.
Since there is only one way in and out it is impossible to be able to put multiple crews on multiple areas at a time. We can only do one section at a time due to stone deliveries etc. Based on this, for us to perform the work in Schedule A is going to take 156 days, which is well above the 96 days given in the schedule below. In order to complete Schedule A in this 156-days we also need to work 6 days a week at 24 hours/day (which we are capable of doing). So based on the fact that we need to work 6 days a week at 24 (hour)/day it is not possible to achieve the 96-day schedule.
My question is, can we be allowed the 96 days, plus the Option 1 of 30 days and the Option 2 of 25 days for a total of 151 days to complete Schedule A if just Schedule A is awarded? If Schedule B and/or is Schedule C is awarded, would we be allowed to complete those in the Fall of 2025 (After Nov 1) no later than April 15, 2026?
Response: The intent is to award all schedules by June 30, 2024, and to issue the Notice To Proceed (NTP) for all schedules at the same time. It is expected that all work will be completed concurrently. The Government will permit full roadway closure only from November 1, 2024, to March 24, 2025. In accordance with the SCRs - weekend, National Legal Holiday, and night work is not permitted on this project. In accordance with Subsection 156.08 of the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects – FP-14, daylight is defined as “one-half hour after sunrise to one-half hour before sunset”. It is up to the Contractor on how to plan and organize the work and on how many crews will be working at the same time.
