PROPOSAL INSTRUCTIONS

PROJECT: WV NP NERI 107(2)

OFFERORS PLEASE NOTE: Before preparing the proposal, carefully read the Instructions to

Offerors. While preparing the proposal, comply with the following:

The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals from all eligible Contractor firms/teams (Offerors) for technical acceptability. After all of the technical proposals have been evaluated, the Offerors that are found technically acceptable will be ranked according to the price and the lowest Offeror will be awarded the contract.

EVALUATION OF PROPOSAL DOCUMENTS

STEP 1 - TECHNICAL ACCEPTABILITY – Experience in MSE wall construction

TECHNICAL ACCEPTABILITY EVALUATION DESCRIPTION

Competing technical proposals will be evaluated against the solicitation requirements; they are not compared with each other. Each of the technical evaluation factors described below will be rated on a pass/fail basis and must receive a passing score for an Offeror's proposal to receive further consideration. Failure to receive a passing score for any technical evaluation factor will result in rejection of an Offeror's proposal notwithstanding passing scores for other technical evaluation factors. Technical acceptability will be determined by evaluating each responsive proposal and comparing the results of that evaluation against the technical requirements specified in the solicitation. Proposals which satisfy the technical requirements of the solicitation, in light of the evaluation criteria, will be determined technically acceptable.

Offerors will be evaluated on the Offeror’s past performance and experience in construction of MSE walls.

TECHNICAL PROPOSAL EVALUATION FACTORS

The Offerors need to submit the following qualifications and information, and label it as the Technical Proposal. Offerors must include names, titles, phone numbers, and email address for all references submitted.

(a) Key Personnel. The Offerors need to submit resumes of key personnel proposed for this contract. The Government will review and evaluate each Offeror's proposed key personnel, including technical similarities between the Offeror's experience and the work described in this solicitation, of the Offeror’s proposed key personnel. Include names, titles, phone numbers, and email addresses for all references submitted. Submit documentation for all key construction personnel to be involved in the construction of the project: The Offerors will be required to submit the following:

Amendment 0001

(i) Superintendent: The Offerors need to show that the Contractor’s Superintendent has a minimum of five years of Mechanically Stabilized Earth (MSE) wall construction experience.

(ii) Foreman: The Offerors need to show that the Contractor/subcontractor’s MSE Wall Foreman has a minimum of five (5) years of MSE wall construction experience in the last 10 years since the solicitation date of this contract.

(b) Construction Capability and Resources. The Government will review and evaluate the information about each Offerors' past performance in the design and construction of MSE wall construction projects based on the Offeror's record and reputation for satisfactorily completing projects similar in size and scope. The Offerors will be required to submit the following:

(i)Organizational structure, identifying major participants and describing their roles in the project. Identify how the Contractor/subcontractor was involved with construction engineering support and the MSE wall construction.

(ii) Documentation that shows direct experience of the Offeror, and/or experience of subcontractors that the Offeror proposes to utilize in the execution of this project.

Submit documentation that shows direct experience of the Contractor/subcontractor in constructing MSE walls by providing at least three (3), but no more than five (5) MSE wall construction projects completed in the past ten (10) years similar in scope and size to the Cunard River Access Road project. Offerors are to include the experience of the entire prime and subcontracting team that will perform the work on this project.

(iii) For each project included under (b)(ii), offeror required to provide owner contact information, including name, title, company, phone number, email address, and provide initial and final construction cost, reasons for cost changes, and initial and final durations, including reasons for schedule changes.

(c) Technical Approach to Construction.

(i) Approach to wall construction. The Offerors need to describe the construction of the MSE wall project, including excavation and installation. In addition, offeror must describe how Occupational Safety and Health Administration (OSHA) requirements will be implemented on the project. Also, describe how the contractor plans to remove the existing earth retaining structure and how it will connect the existing (to remain) retaining structure with the new MSE wall.

(ii) Construction staging. The Offerors required to describe how they will stage construction to stay within the limits shown in the plans.

(iii) Approach to maintaining temporary traffic control. The Offerors must describe how they will maintain construction signing. Describe how you will provide emergency access to Government personnel, if possible.

(iv) Environmental considerations and compliance during construction. The Offerors must describe how work will comply with the environmental documents for this project.

(d) Project and Management Plan. The Offerors required to provide the following:

(i) Proposed Quality Assurance and Quality Control plans for construction in order to deliver a quality construction project on-time and within budget (see Sections 153 and 155).

(ii) Approach to coordinating with the EFLHD, NPS, entities such as Fire & Rescue, Police and local jurisdictions; and approach to public safety and public awareness.

(iii) Approach to meeting the tight contract construction schedule.

Technical Proposals shall not exceed 10 single sided pages of 8.5” x 11” size using Times New Roman font with a size of 12-point. All pages must be numbered. Only pages numbered 1 through 10 will be considered during the evaluation process. Additional pages consisting of photos, brochures, resumes, or other pre-printed material may be submitted as long as the exact item to be incorporated is identified. This material may not exceed an additional 10 pages. Gantt charts, site maps, or charts can be submitted on single sided sheets up to 11” x 17”. If tabs are used and contain project-specific information, they will be counted as pages.

STEP 2 - LOWEST PRICE - Cost to Perform the Proposed Work

LOWEST PRICE EVALUATION DESCRIPTION

Only Cost Proposals from Offerors that passed the technical acceptability phase will be evaluated.

Cost Proposals from Offerors that did not pass the technical acceptability phase will be returned unopened. All acceptable Cost Proposals will be reviewed and evaluated for completeness and reasonableness.

COMPLETING THE PROPOSAL SCHEDULE

Complete the Proposal Schedule(s) by handwriting in ink or typing. Specify a Unit Bid Price, in figures with cents to only two decimal places, for each pay item in the Unit Bid Price column for which a quantity is given. Do not enter or tender a Unit Bid Price for any pay item for which no estimated quantity appears in the Bid Schedule. Determine the products of the respective unit prices and quantities, and show them, in figures, in the Amount Bid column. If a Unit Bid Price and Amount Bid have been inserted by the Government for a pay item, do not change the Unit Bid Price and Amount Bid for the pay item. Determine the Proposal Total for each specific individual Schedule of Work by adding the amounts of the listed items and show it in the block provided for that individual Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.

To be eligible for award, offerors must submit prices for each pay item.

Review Subsection 109.05 of the FP (standard specifications book) regarding scope of payment for direct and indirect payment work.

Fill in the Proposal Total(s) for each individual Schedule of Work as directed on the Proposal Summary page. Fill in the Evaluation Total Price of Project in the space provided on the Proposal Summary page.

The amount in Block 17 of the SF 1442 should be completed as follows:

Schedule A - $ .

Schedule B - $ .

Schedule C - $ .

SCHEDULES OF WORK

The Proposal Schedule is comprised of the following separate schedules and options of work:

Schedule A (Base Contract) - Pages B-1 thru B-3 Schedule B (Government Option 1) - Pages B-4 thru B-6 Schedule C (Government Option 1) - Pages B-7 thru B-9

The Government will award the project as a Base Contract (Schedule A) with the option to award Schedule B and Schedule C (Government Options 1 and 2); see FAR Clauses 52.217-4 and 52.217-5.

The purpose of the multiple schedules and options is to give the Government maximum flexibility in completing the project in a timely manner and at a cost-effective price, by proper utilization of programmed funds and upon receipt of any additional funds required to award the contract. If complete funding is in place at the time of award of Schedule A (Base Contract), the Government may award Schedules B and C (Government Options 1 and 2) at that time. If additional funding is required for the award of Schedules B and C (Government Options 1 and 2), and is received after the award of Schedule A (Base Contract), the Government has the right to exercise Schedules B and C (Government Options 1 and 2) at the unit prices bid according to the following schedule:

Schedule B (Government Option 1): No later than June 30, 2024.

Schedule C (Government Option 2): No later than June 30, 2024.

COMPLETION OF WORK

If the Government awards the contract as Schedules A + B + C, all construction activities at the project site must be completed by no later than April 15, 2025.

If the Government awards the contract as Schedule A only, the performance period to complete all Schedule A work will be 96 calendar days and will start on the effective date of Schedule A’s Notice to Proceed.

If Schedule B (Government Option 1) is exercised after the award of the original contract, the performance period to complete all Schedule B work will be 30 calendar days and will start on the effective date of Schedule B’s Notice to Proceed.

If Schedule C (Government Option 2) is exercised after the award of the original contract, the performance period to complete all Schedule C work will be 25 calendar days and will start on the effective date of Schedule C’s Notice to Proceed.

In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the FP and Special Contract Requirements (SCR’s). Specific work limitations may be (but are not limited to): National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items are (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc). The Government also considered time required for preparing material and drawing submittals, and the allowable Government review times for those submittals (Subsection

104.03 of the FP and SCR’s).

Offerors are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-15) may result in the start of construction activities no be no earlier than March 2024. See Subsection 108.01 of the SCRs for additional details.

BASIS FOR AWARD

The contract will be awarded to the responsive, responsible bidder with the lowest Evaluation Total Price of Project, which is defined as:

Schedule A (Base Contract) Bid Total + Schedule B (Government Option 1) Bid Total + Schedule C (Government Option 2) Bid Total.
