Amendment No. 0002 Project WV NP NERI 107(2)
New River Gorge National Park and Preserve Solicitation: 693C73-24-R-000010
The purpose of this Amendment is to:
1) Respond to bidder questions.
2) The proposal due date is extended to January 30, 2024 at 2:00 pm EST.
Responses to Questions
1) Question: Per the general summary, there is nothing indicating how the asphalt shall be replaced. Considering the amount of material that is being removed and replaced (and the overabundance of traffic in and out) how will the existing asphalt roadway be paid to be replaced in its entirety?
Response: Asphalt paving is not included under this project but will be completed under a future project. Only gravel resurfacing of the slide location is to be done under this project. Please review the project plans for the required work.
2) Question: Upon an extensive site visit, we observed that the only access to Cunard Road is a bridge with a 20-ton weight limit. Will the contractor be granted the ability to create an easement for bypassing the bridge and it’s 20-ton weight limit? Are there any additional access points that can be created for the project during this work operation?
Response: The bridge in question is not on the Park’s Right Of Way (ROW), and the Government has requested a bridge inspection report from the State DOT. The State DOT advised on January 18, 2024, that they will be providing the requested information as much as they can, but the 20-ton limit is correct and will remain. The Government will post the additional information as soon as it is received. It is up to the Contractor to obtain easements outside of the Park’s ROW on state, county, or private property. The Government cannot think of any alternate access points since the only detour has a collapsed culvert that may not be repaired soon enough by the State.
3) Question: What are the clearing limitations? There are several areas along Cunard Road that would become more accessible for work if clearing limitations were defined or extended. Can additional areas be cleared for access points?
Response: The only Limits of Disturbance (LOD) that are currently allowed are those that are shown in the plans. Contact the CO after the award if additional ground disturbance is proposed outside the LOD shown in the plans, however, this is unlikely to be allowed since the Government may need to revise NEPA and the Contractor may need to obtain permits.

4) Question: Are blasting and explosives permitted within this contract?
Response: The Contractor may approach the CO about blasting after project award. Blasting is not included in the NEPA documentation. Blasting may require consultation with USFWS and would likely not be allowed during the active bat protection season, April 1- Nov 15. The Park may have restrictions on blasting also due to nearby recreational uses and natural resources. The wall design assumed some weathered rock excavation (rippable rock). Contractor should contact the CO during construction if sound rock is encountered, and the Government will decide if further excavation is required based on the design requirements. Even though we do not expect excessive amount of sound rock excavation, the Contractor needs to account for this risk. Blasting is not the only method used for sound rock excavation. The use of a rock hammer or multiple rock hammers can also work.
5) Question: There is a single lane gravel/stone road running parallel along the existing river, is this all able to be utilized within the work limits for staging, loading, stock(pil)ing, etc.?
Response: The road can be used for staging, loading and stockpiling during the project within the first half mile from the parking lot where it is wider than one lane. The road needs to remain open to the public outside of the November 1st to March 24th Cunard River Access Road full closure period.
6) Question: Considering the rocky topography. How would you like contingency proposals for hammering or blasting rock?
Response: The Government provided boring data as part of the solicitation. The data includes the soil types and classification. The Government will not consider contingency proposals for rock removal. This work is to be bid under the roadway excavation pay item.
7) Question: Would FHWA consider allowing for the MSE Walls to be constructed as Section 257 – Contractor-Designed Retaining Walls?
Response: The Offeror(s) are to bid on the project as is. After the award to the low bidder, the Contractor can present Value Engineering proposals which may or may not be approved by the CO. See Subsection 103.03 of the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP-14) for the Value Engineering Requirements.
