(d) Absence of Lead Based Paint. If paint testing shows that no lead based paint is present in the non-habitable structures to be removed in the project, the resulting waste would not be considered as a Special Waste as per the DRNA’s regulations. This determination pertains only to the presence of lead based paint on the waste, and does not apply if other hazardous characteristics independent of the lead content of the waste are present. If no lead based paint is detected in the project, the generated waste can be disposed in any DRNA/EPA approved facility. In the case of non- habitable structures such as guardrail and guardrail components that do not have lead-based paint, the material will be delivered to appropriate locations as established in Section 606 of these specifications.
931.07 Removal of Special Waste. For non-habitable structures that will not be recycled by a DRNA certified facility in Puerto Rico, the contractor shall perform the removal and abatement of the lead based paint on-site. The process for on-site lead-based paint removal and disposal shall be implemented as described in the DRNA-approved PMG. For the collection and transportation of lead-based paint, the contractor shall obtain DRNA permit for collection of special waste and transporting of non-hazardous waste (DS-1). Refer to PMG form PGC-005.
During the removal of the lead-based paint on non-habitable structures and generation of special waste, the Contractor shall prevent the contamination of the surrounding environment as part of the works covered in this specification at no additional cost to the Government.
931.08 Disposal of Special Waste. The contractor shall perform required testing in compliance with subsection 931.06(c) to determine packaging, tracking, transportation, and destination for the disposal of special waste.
(a) Hazardous Waste – If TCLP testing indicates that the waste contains more than 5 PPM (mg/L) for lead, the waste is deemed as hazardous waste and the material shall be managed and disposed of at an approved EPA facility under the RCRA regulations. At
SCR Changes 6 of 9 present, there are no such facilities approved for final disposal in Puerto Rico, and therefore, the contractor will need to coordinate for the waste to be shipped to approved facilities in the continental United States.
(b) Non-hazardous Waste - If TCLP testing indicates that the waste has less than 5 PPM (mg/L) for lead, this special waste is classified as non-hazardous. This special waste can be disposed locally at an approved Sanitary Fill System (SRS by its Spanish Acronym) facility in Puerto Rico. A Permit to dispose special waste must be obtained from the DRNA as set forth in Rule 1558 of the Regulation for the Control of Lead Based Paint Mitigation Activities (RCLBPMA) and the PUI. For non-habitable structures that will be recycled, the contractor shall ensure the removal, handling, and recycling of the materials containing lead-based paint and any related disposal of non-hazardous waste by the DRNA qualified recycling entity that are in compliance with required laws and regulations.
(c) Packaging and transporting of waste. All special waste and hazardous waste from the described activities shall be stored and transported to their final destination using DOT approved containers and DRNA and DTOP licensed transporters. These containers shall be labeled indicating its contents. For hazardous waste, the contractor shall prepare the Uniform Hazardous Waste Manifest (EPA Form 8700-22) for tracking the chain of custody for the waste from the point it leaves the site to final disposition in accordance with DRNA requirements and submit for the Engineer’s signature.
