About this file

This is a Trench Safety Act Requirement form document for a fixed contract solicitation issued by a Florida county for the development and construction of a separated shared use path at North Perry Airport (HWO) for the Aviation Department. The project is subject to Florida Trench Safety Act compliance (Sections 553.60 through 553.64, Florida Statutes) and OSHA excavation safety standards (29 C.F.R. Section 1926.650) for any trenches exceeding 5 feet in depth. Vendors must submit the completed form with their initial solicitation response or within three business days of the County's request, with failure to comply potentially resulting in a nonresponsive designation. All solicitation responses must be submitted electronically through BPRO by the specified closing date and time, with vendors strongly encouraged to provide all requested documentation at the time of initial submittal to enable timely and comprehensive review.

Vendors are required to affirm awareness of trench safety requirements and commit to full compliance with applicable standards, including special shoring requirements if applicable. The form mandates that vendors identify both the anticipated methods and associated costs for compliance with trench safety standards, with cost and method information to be detailed in either the Open-end Contract section (with unit prices per linear feet or square feet) or the Fixed Contract section (with quantities and unit prices). Vendor submission must include company name and form date, and all assurances regarding trench safety compliance are legally binding on all vendor employees and subcontractors. County/State license requirements and bonding requirements apply to this solicitation, and vendors are directed to review the full solicitation documents and submit questions through BPRO by the specified questions due date.

TRENCH SAFETY ACT REQUIREMENT

The completed form should be returned with the Vendor’s submittal. If not provided with the submittal, Vendor must submit the form within three business days after County’s request. Vendor may be deemed nonresponsive for failure to fully comply with the stated timeframes.

Florida Trench Safety Act, Sections 553.60 through 553.64, Florida Statutes, incorporates the Occupational Safety & Health Administration (OSHA) excavation safety standards, 29 C.F.R. Section 1926.650, as Florida's own standards. The Trench Safety Act will apply to any individual project that has trenches in excess of 5 feet deep.

The Vendor, by virtue of the solicitation submission, affirms that the Vendor is aware of this Act, and will comply with all applicable trench safety standards, including any special shoring requirements, if applicable. Such assurance shall be legally binding on all persons employed by the Vendor and subcontractors.

The Vendor is also obligated to identify the anticipated method and cost of compliance with the applicable trench safety standards. The Vendor further identified the costs and methods summarized below: (fill in either the Open-end or the Fixed Contract section)
