About this file
This is a Criminal History Screening Practices Certification form required by Broward County, Florida for vendors seeking contracts valued at $100,000 or more. The certification pertains to the Separated Shared Use Path – Phase 1 project at North Perry Airport (HWO) for the County's Aviation Department. The project involves the fixed-price development and construction of a separated shared use path in accordance with specified requirements and specifications. Vendors must submit all solicitation responses electronically through BPRO by the closing date and time to receive a Submission Receipt, with the County strongly encouraging vendors to provide all available documentation, including optional items, to enable timely and comprehensive review. County and state licensing and bonding requirements apply to this solicitation.
The certification requires vendors to implement, or commit to implementing upon contract award, policies, practices, and procedures that prohibit inquiry into an applicant's criminal history until the applicant is selected as a finalist and interviewed for the position for all U.S.-based positions that will foreseeably perform work under the contract. Vendors may claim exemption only if required by applicable federal, state, or local law to conduct background checks at prohibited times or if the vendor is a governmental agency. Failure to comply with this requirement constitutes a material breach of contract and entitles Broward County to pursue available remedies, including contract termination and potential vendor debarment or suspension proceedings. The certification form (Form Date 9/9/24) must be completed and returned with the vendor's submittal or within three business days of the County's request, with failure to comply resulting in the vendor being deemed nonresponsive.

Section 26-125(d) of the Broward County Code of Ordinances (“Criminal History Screening Practices”) requires that a Vendor seeking a contract in the amount of $100,000 or more with Broward County shall certify:
A. D. If Vendor fails to comply with Section 26-125(d) at any time during the contract term, Broward County may, in addition to all other available remedies, terminate the contract and Vendor may be subject to debarment or suspension proceedings consistent with the procedures in Chapter 21 of the Broward County Administrative Code.
