About this file
This document is a Business Request for GRAMA Business Confidentiality Claim form issued by the Office of the Government Records Ombudsman at the Utah State Archives. The form is designed to help businesses protect trade secrets and commercial financial information from public disclosure under Utah Code § 63G-2-305. The form requires companies submitting confidential information to a governmental entity to provide a detailed confidentiality claim, including a concise statement of reasons supporting the claim and both redacted and non-redacted versions of their proposal.
The form emphasizes that making a confidentiality claim does not guarantee protected classification if the government receives a records request. Companies must specify the exact pages, paragraphs, and reasons for their confidentiality claim. The Division of Purchasing will not redact proposals on behalf of claimants, so businesses must proactively submit their own redacted versions. The form includes fields for company information, contact details, specifics about the confidentiality claim, and a section for the company representative to sign and date the document.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
