Submittal Section Litigation 1.5.1 - Broward Sheriff's Office Promotional Testing and Assessment Services

This is a litigation disclosure form required by the Broward Sheriff's Office (BSO) for the Request for Letters of Interest (RLI) 26004JD for Promotional Testing and Assessment Services. Proposers must complete this form if they answered affirmatively to question 1.5.1 on the Submittal Section Questionnaire, disclosing all current litigation, judgments, settlements, and court cases related to providing the services outlined in the solicitation that have occurred within the past three years, with the exception of bankruptcy cases, which must be disclosed for the past seven years. The form requires detailed information about each case, including the type of action, the court or regulatory agency where the action was filed, case or file numbers, the named parties (the proposer and/or its principals), a summary of the action's nature, and the current status or disposition. Proposers must also disclose whether they or their principals have been debarred or suspended from doing business with any government agency or professional board.

Proposers bear an ongoing obligation to update this form and notify the designated BSO Purchasing Agent of any litigation initiated or reopened during the solicitation process and until contract execution if awarded. The form defines "principals" to include corporate officers and controlling shareholders for corporations; managing members and partners with controlling interests for partnerships and associations; and parent and subsidiary companies. The definitions specify controlling interest as ownership of more than 50 percent of voting power or beneficial ownership. If no litigation or regulatory action has been filed against the firm, proposers must provide a written statement to that effect. For joint venture or team proposers, requested information must be submitted for each member. Failure to maintain an updated case list may result in automatic disqualification of the proposer or termination of the award if previously awarded.
