About this file
This document is an AIA (American Institute of Architects) Standard Form A312 Payment Bond for the Madison County Mass Transit District, specifically for the "Trail Crossing Safety Improvements" project (Project No. 26-1-25200) located in Pontoon Beach, Illinois. The payment bond is designed to ensure that the contractor pays all labor, materials, and equipment suppliers involved in the construction project, and provides legal protection for subcontractors and material suppliers by guaranteeing payment for work performed.
The bond follows the Illinois Compiled Statute 30 ILCS 550 Public Construction Bond Act, which establishes specific requirements for claims and notices. Key provisions include a requirement that any claimant must file a verified notice with the Owner's Managing Director within 180 days of the last work performed, and provide a copy to the contractor within 10 days. The bond requires the Surety to respond to claims within 60 days, detailing undisputed amounts and the basis for challenging disputed amounts. The total obligation of the Surety is limited to the bond amount, with additional provisions for reasonable attorney's fees in certain circumstances.

If, however, the Surety fails to discharge its obligations under Section 7.1 or Section 7.2, the Surety shall indemnify the Claimant for the reasonable attorney’s fees the Claimant incurs thereafter to recover any sums found to be due and owing to the Claimant.
