PERFORMANCE WORK STATEMENT (PWS)
FOR
RENOVATION AND EQUIPPING OF MEXICAN BASIC REHABILITATION UNITS (UBRs)
(MULTIPLE LOCATIONS)
11 June 2020
DESCRIPTION OF SERVICES: The NORAD & USNORTHCOM J49 Foreign Humanitarian Assistance (FHA) Program requires construction and procurement support for the renovation of 17 UBRs across 4 Mexican states in partnership with The System for the Comprehensive Development of the Family (DIF) in support of J49’s mission to build capacity in Mexico and The Bahamas.
1.1. ORGANIZATION BEING SUPPORTED: NORAD & USNORTHCOM J49

1.1.1. MISSION: The FHA Program, in partnership with the interagency, plans, coordinates, and executes FHA to build Partner Nation (PN) capacity in the sectors of Disaster Preparedness/Disaster Risk Reduction, Health, Education and Infrastructure.
1.2. OVERVIEW OF SERVICES REQUIRED: The FHA Program, in coordination with DIF, requires support for the renovation and equipping of 17 UBRs throughout 4 Mexican states (Chiapas, Guerrero, Oaxaca, Veracruz) to ensure better care for the most vulnerable citizens in Mexico. A recently completed site survey of all locations allows the contractor to review all necessary modifications of the buildings and their systems, as well as the required equipment for each site.
1.2.1. UBR LOCATIONS: Chiapas: Altamirano, Chamula, El Parral, Larrainzar, Ocosingo, Oxchuc, Zinacantan. Guerrero: Coyuca de Catalán, Coyuca de Benitez, Zirándaro, Metlatonoc, Zochistlahuaca, Tlapa de Comonfort, Buenavista de Cuellar. Oaxaca: San Juan Valley Nacional, San Felipe Jalapa de Díaz. Veracruz: Playa Vicente.
1.3. SPECIFIC REQUIREMENTS:
REQUIREMENT 1: RENOVATION OF EXISTING GOVERNMENTAL BUILDINGS
1.3.1.1. The contractor shall provide all labor, equipment, supplies, transportation, tools, materials, and all other items and/or non-personnel services necessary to complete the renovation of 17 UBRs. The main requirements include the repair and modification of buildings, utility systems, structures, mechanical and electrical systems, water systems, fire suppression and detection systems, hazardous waste transfer, communication devices, interior and exterior lighting, landscaping, and ground repairs.
1.3.1.2 The contractor shall make modifications and repairs to buildings, equipment, facilities, and systems according to the work requests for each UBR. Each work request will detail all work required for the units. It will include an estimate for all work required, the standards, specifications, and drawings or sketches to be followed. Special requirements for coordination or time schedule for performance of work will be annotated. Should the contractor require modifications to approved estimates, supporting documentation will include a review of the estimates by a licensed contractor in Mexico. Adjustment requests will include but are not limited to electrical, mechanical, plumbing, carpentry, painting, electronic, and equipment.
1.3.1.3. The contractor shall repair or install 100 percent of the: plumbing (equipment including but not limited to sinks, showers, toilets, water heating units), sanitation, and electrical (including but not limited to fuses, wiring, lighting, sockets) systems; structures (including but not limited to interior and exterior walls and painting); roofing; flooring; landscaping (including but not limited to concrete walkways, weeding of perimeter, rough cutting of perimeter as required).
REQUIREMENT 2: EQUIPPING OF RENOVATED UBRs
1.3.2.1 The contractor shall be responsible for the procurement, transportation, and installation of fully functioning equipment as requested for each renovated UBR. If substitutions are required, the contractor shall coordinate with the COR to determine suitability, ensure items meet local regulations, and adhere to SAMM Ch. 12. The contractor is also responsible for disposing of all external packaging and internal packaging materials for the equipment purchased and installed. The contractor will be responsible for all equipment damaged during transport and installation and will ensure equipment functions at 100% following installation.
REQUIREMENT 3: MANAGEMENT OF ENVIRONMENTAL/SAFETY/QUALITY CONTROL/QUALITY ASSURANCE
1.3.3.1. The contractor shall establish a complete environmental/safety management program to assure all federal, state, and local regulations are met. Copies of the contractor’s program shall be provided to the COR prior to starting any work under this contract.
Changes to the program must be provided in writing to the COR within five calendar days.
1.3.3.2. The contractor shall develop Standard Operating Procedures, checklists, and other compliance procedures for all areas of this
PWS.
1.3.3.3. The contractor shall develop and maintain an inspection system on both a scheduled and unscheduled basis, as well as a method of identifying deficiencies in the environmental/safety management program and recommended corrective actions.
1.3.3.4. The contractor shall develop and maintain an effective Quality Control Program (QCP) to ensure renovations and equipment procurement are completed in accordance with PN standards, which will be delivered to USNORTHCOM within 30 days following contract award. The QCP must be approved by USNORTHCOM prior to initiation of the contract and will include all applicable evaluation metrics. Any changes made to the QCP must be submitted to the COR within five working days in writing.
1.3.3.5. The Government will monitor the contractor’s performance under this contract using the quality assurance surveillance procedures.
REQUIREMENT 4: REQUIRED PERIODIC REPORTS, BRIEFINGS, AND MEETINGS
1.3.4.1. The contractor shall provide and prepare as required the following periodic reports, briefings, and meetings.
1.3.4.2. The contractor shall establish and provide reviews monthly, to include renovation timelines, of project requirements and expenditures in each state. Progress meetings after the reviews are submitted will enable proper communication between the contractor and the Government to ensure successful performance.
1.3.4.3. The contractor shall provide a record of all inspections conducted by the contractor and any corrective actions taken.

1.4. CONTINUITY OF OPERATIONS:
1.4.1. The contractor shall consult with the COR to coordinate the work performed for each unit in such a way to minimize interruptions to daily operations. The contractor will provide 48 hours notice when any equipment or system is turned off. All service interruptions require prior approval so as to minimize impact to daily UBR operations.
1.4.2. In the event equipment or UBRs are damaged due to unplanned natural events or disasters, the COR will determine emergency actions and may direct emergency work performed. If emergency work is directed, the contractor shall develop written plans and submit them to the COR for review, approval, and/or award of additional contract.
4.0. GENERAL INFORMATION:
4.0.1. The contractor is responsible for complying with all federal, business, state, and local laws applicable to their operations.
Contractor bears the responsibility to validate other partners (including subcontractors, if applicable) also adhere to all applicable regulations.
4.1. LANGUAGE PROFICIENCY: The contractor and/or subcontractor performing work under this contract shall understand, interpret, write, and speak in Spanish. Contractor(s) shall have superior proficiency in Spanish or ability to execute the requirements of this PWS at no additional costs to the Government.
4.2. SECURITY REQUIREMENTS: The contractor is responsible for ensuring contractor and any subcontractors obtain appropriate clearances required for the work performed.
4.3. PHYSICAL SECURITY: The contractor is responsible for safeguarding and returning all assets at the completion of project should contractor need access to government sourced equipment, intellectual property, and/or materials. The contractor is responsible for the security of work areas and sites. The contractor shall implement procedures for ensuring only authorized personnel access construction sites. Should the contractor coordinate services locally, efforts between governments and the contractor will not be duplicated nor will tasks be duplicated in the contract. The contractor is responsible for removing any unauthorized contractor and/or subcontractor personnel from work areas.
4.4. IDENTIFICATION OF CONTRACTOR EMPLOYEES/SUBCONTRACTORS: The contractor shall identify all contract personnel whose interactions may not immediately indicate their contractor status to avoid creating an impression to the public that they are Government Officials. The contractor shall ensure all documents and/or products are suitably marked as contractor products and contractor participation is appropriately disclosed.
4.5. DATA RIGHTS: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the COR. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.
4.6. ORGANIZATIONAL CONFLICT OF INTEREST. Contractor and subcontractor personnel performing work under this contract may be part of existing engagements, receive, have access to/or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.), which may create a current or subsequent Organizational Conflict of Interest (OCI) as defined in FAR Subpart 9.5. The contractor shall notify the COR in writing whenever such access or participation may result in any actual or potential OCI and shall promptly submit a plan to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the COR. In the event the COR unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the COR may affect other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.

The publications listed in this section are generally referenced in the PWS. The Directive/Guidance (D/G) column indicates the extent of contractor compliance with the publication that is prescribed by the PWS. A “D” in the column means the publication is a “directive publication,” that requires mandatory compliance by the Contractor. A “G” in the column means the publication is a “guidance publication.” These publications provide guidance for the contractor to perform particular tasks or operations in a manner compatible with Air Force procedures. However, the contractor is required to comply with the intent of the publication.
Additionally any procedures developed by the contractor shall be compatible with the intent of the “G” publications. *D/G stands for Directive and/or Guidance
