About this file
This is a Prevailing Wage Rate Requirements and Compliance document for a construction project managed by El Paso County Hospital District d/b/a University Medical Center of El Paso in Texas. The document establishes mandatory prevailing wage rate requirements applicable to all workers and subcontractors performing work on the West Emergency Department project, which is a new approximately 10,000 square foot emergency department facility with treatment, triage, and urgent care functions, along with completion of permanent patient parking on the west side of El Paso. The project is funded through the Owner's bond-financed capital program and may involve construction activities that impact occupied clinic environments, requiring detailed coordination with UMC representatives regarding phasing and infection prevention and control measures.
The contractor must pay all workers no less than the applicable prevailing wage rates adopted by the Owner and issued with the solicitation package or by addendum. The contractor is responsible for maintaining accurate time and payroll records identifying worker name, classification, hours worked, hourly rate, and deductions, and must flow down prevailing wage requirements to all subcontractors. Certified payroll records must be submitted monthly and with each pay application as a condition of payment, with the Owner retaining the right to review payroll records, conduct site interviews to verify compliance, and withhold progress payments if noncompliance is identified. Any prevailing wage violations identified by the Owner may result in corrective action requirements, payroll corrections, and restitution to affected workers. Questions regarding prevailing wage requirements must be submitted in writing to the Point of Contact identified in the solicitation, as verbal guidance is not binding.

These requirements apply to all tiers of subcontractors and all work performed on the Project that is subject to Texas Government Code Chapter 2258 and applicable Owner policy.
Applicable Wage Rates Prevailing wage rates for this Project are those adopted by the Owner and issued with the solicitation package or by addendum. If a Prevailing Wage Rate Addendum is included with the solicitation, it forms part of the Contract documents.

Maintain accurate time and payroll records that clearly identify worker name, classification, hours worked, hourly rate, and deductions as applicable.
Flow down prevailing wage requirements to all subcontractors and require subcontractor compliance.
Post prevailing wage information at the Project site in a location accessible to workers, as required by law and Owner policy.
Certified Payroll Submittals The Contractor shall submit certified payroll records for itself and each subcontractor as a condition of payment, in the form and frequency required by the Owner.
