About this file

This is a Claim of Business Confidentiality form submitted in connection with Davis Technical College's Request for Proposals for a 50-year anniversary institutional history and historical publication project in Utah. The document allows the submitting company to assert claims protecting specific information included in their proposal from public disclosure under Utah Code Annotated Sections 63-2-304 and 63-2-308. The claimant may designate information as confidential if it constitutes trade secrets as defined in Section 13-24-2, or if it qualifies as commercial or non-individual financial information where disclosure could reasonably result in unfair competitive injury or impair the governmental entity's ability to obtain necessary information in the future, provided the submitter has a greater interest in confidentiality than the public has in access.

The form requires the submitting party to identify the specific pages and paragraphs of their proposal containing confidential information and to cite the relevant reason for the claim. Upon receipt, the governmental entity will notify the claimant if any protected record is classified as public or if the entity determines the record should be released after balancing interests under the applicable Utah statutes. This document serves as a procedural mechanism to protect proprietary business information during the competitive bidding process for the project, which carries a budget of $50,000.
