About this file
This attachment document outlines the mandatory minimum requirements and technical scoring criteria for the MK26-31 WIC Compliance Buys and Private Investigations contract, issued by the State of Utah Division of Purchasing on behalf of the Department of Health and Human Services. The procurement seeks qualified vendors to conduct undercover compliance investigations of authorized WIC vendors annually to prevent fraud, waste, and abuse of WIC funds. The contract is structured as a 5-year agreement with an option for a 5-year renewal, and the state intends to award the contract to the highest-ranked qualified vendor through a competitive request for statements of qualifications process under Utah Procurement Code 63G-6a Part 15.
Vendors must satisfy three mandatory minimum requirements to advance in the evaluation process: demonstrated experience as a secret shopper or covert investigator, submission of at least two completed performance or professional references using the provided reference form, and submission of a technical response documenting private investigative and secret shopper experience. The technical evaluation encompasses five scored criteria, each assessed on a 0-5 scale: investigator qualifications and vetting processes; covert procedures and evidence collection methodology; safe food handling and donation protocols; reporting accuracy and timeliness; and schedule adherence and fair hearing capacity. Vendors must demonstrate capacity to complete 15-25 compliance investigations per store location with two to three purchases per store, with all investigations completed by August 31st annually. Original compliance investigation reports must be submitted to DHHS within five working days, and investigators must be available to testify at Fair Hearings when requested. The procurement specifically states that pricing should not be included in vendor submissions, as compensation will be negotiated based on fair and reasonable terms with the highest-ranked selected vendor.
