About this file

This Scope of Work document outlines the compliance investigation requirements for the State of Utah Department of Health and Human Services (DHHS) WIC Compliance Buys and Private Investigations contract. The contractor will conduct undercover compliance investigations at 15–25 WIC authorized vendors annually to evaluate approximately 5% of all authorized vendors and prevent fraud, waste, and abuse of WIC funds. The contract establishes a comprehensive framework requiring the contractor to schedule a kick-off meeting within 60 days of contract execution, complete the first compliance investigation within 90 days of receiving the vendor list, and conduct all investigations by August 31st annually. Each selected vendor will receive between two and three compliance purchases conducted by trained investigators who will attempt various violation scenarios, including purchasing non-food items, attempting cash exchanges, buying unauthorized quantities, and testing other fraudulent activities. The contractor must prepare detailed confidential case files for each vendor investigation, submit original compliance investigation reports to DHHS within five working days of each purchase, and ensure investigators are available to testify at fair hearings as required.

The scope specifies detailed investigator qualifications and operational procedures, including requirements that investigators be at least 18 years old, possess no criminal convictions, present as typical WIC participants, and maintain inconspicuous conduct throughout investigations. Investigators must document all store conditions, cashier interactions, pricing verification, and transaction procedures; photograph purchased items and store fronts; preserve perishable foods in coolers with ice; and donate all purchased items to local food banks or pantries within 24 hours of purchase, including donation receipts in final reports. The contractor bears full responsibility for investigator training, coordination with DHHS on compliance procedures, and ensuring all documentation meets federal and state WIC transaction standards. DHHS will provide the names and addresses of vendors to be investigated prior to each calendar year, assign specific stores for investigation, and specify follow-up visit dates, with compliance investigations to be conducted on different days and times than initial visits when possible.
