About this file
This document is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman, applicable to the State of Utah Division of Purchasing's request for qualifications (RFSQ) for WIC Compliance Buys and Private Investigations services through the Department of Health and Human Services. The procurement seeks qualified companies to evaluate authorized WIC vendors annually through undercover compliance investigations designed to prevent fraud, waste, and abuse of WIC program funds. The contract term is five years with an option for an additional five-year renewal. This is a design professional services and consultants procurement conducted under Utah Procurement Code 63G-6a Part 15, with the highest-ranked vendor selected to proceed to contract negotiations at fair and reasonable compensation rates to be determined through that negotiation process.
The confidentiality claim form allows bidders to protect trade secrets and commercial financial information in their submissions by providing both redacted and non-redacted versions of their proposals, as permitted under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit a concise statement of reasons supporting any confidentiality claim and identify specific pages and paragraphs requiring protection. The form emphasizes that making a confidentiality claim does not guarantee protected classification status if the government receives a records request under the Government Records Access and Management Act (GRAMA). Bidders are instructed not to include pricing information in their qualifications submissions, with final compensation to be negotiated only with the selected vendor.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
