BOND REQUIREMENTS
For construcon or facility improvement contracts or subcontracts exceeding the Simplified Acquision Threshold, the Federal awarding agency or pass-through enty may accept the bonding policy and requirements of the non-Federal enty provided that the Federal awarding agency or pass-through enty has made a determinaon that the Federal interest is adequately protected. If such a determinaon has not been made, the minimum requirements must be as follows:
(a) A bid guarantee from each bidder equivalent to five percent of the bid price. The “bid guarantee” must consist of a firm commitment such as a bid bond, cerfied check, or other negoable instrument accompanying a bid as assurance that the bidder will, upon acceptance of the bid, execute such contractual documents within the me specified.

It is further understood and agreed that to the extent the defaulng bidder's bid guaranty shall prove inadequate to fully recompense Agency for the damages occasioned by default, then the bidder agrees to indemnify Agency and pay over to Agency the difference between the bid guarantee and Agency’s total damages so as to make Agency whole.
The bidder understands that any material alteraon of any of the above or any of the material contained herein, other than that requested will render the bid unresponsive.
Performance Guarantee. A Performance Guarantee in the amount of 100% of the Contract value is required by the Agency to ensure faithful performance of the Contract. 3. It conspicuously states that it is an irrevocable, non-transferable, “standby” Leter of Credit.
4. The Agency is idenfied as the Beneficiary.
5. It is in an amount equal to 100% of the Contract value. This amount must be in U.S. dollars.

The issuing bank’s obligaon to pay will arise upon the presentaon of the original Leter of Credit and a cerficate and dra to the issuing bank’s representave at a locaon and me to be determined by the pares.
