About this file

This is a Maintenance Bond document for the City of Fort Worth, Texas, related to the 2027 Asphalt Resurfacing Contract 6 (City Project No. 106821). The bond secures the contractor's obligation to maintain the completed work, which includes approximately 2,710 linear feet of curb and gutter, 15,221 square feet of concrete driveway, 17,248 square feet of concrete sidewalk, 50,465 square yards of two-inch asphalt pavement with surface milling, 15,635 square yards of three-inch asphalt pavement with pulverization, 253 tons of cemlime, and 76 barrier-free ADA ramps. The Principal (contractor) and Surety (corporate surety authorized to do business in Texas) are jointly and severally bound to the City of Fort Worth for the contract amount, with the bond becoming effective on or after the date the contract is awarded.

The Maintenance Bond obligates the Principal to ensure the Work remains free from defects in materials or workmanship for a period of two years following Final Acceptance by the City. Should defective work be identified within this Maintenance Period, the Principal must remedy it to the City's satisfaction at no cost, or the City may perform the repairs and corrections with all associated costs borne by both the Principal and Surety under the bond. The bond is continuous in nature, allowing for successive recoveries for successive breaches. Venue for any legal action is established in Tarrant County, Texas, or the United States District Court for the Northern District of Texas, Fort Worth Division. The bond must be signed by duly authorized agents of both the Principal and Surety, with certification requirements for Surety officer authority and identification of both physical and mailing addresses if different.
