Sole-Source Determination Memo
This sole-source determination memo, issued by the Oregon Department of Human Services Office of Contracts and Procurement on behalf of the Oregon Health Authority, authorizes a single-source procurement from Roche Diagnostics Corporation for reagents, parts, calibrators, consumables, and equipment support products related to a COBAS e411 analyzer at Oregon State Hospital. The procurement will provide immunoassay testing capabilities for both the Salem and Junction City OSH campuses, enabling in-house testing for hormone levels (Prolactin), Hepatitis status (Anti-HCV, Anti-HBs, Hep A Total, Hep A IgM), and thyroid function (Thyrotropin/TSH, Free Thyroxine/Free T4), which are currently referred to external reference laboratories. The estimated total contract value is $275,000.00. The determination was approved by Kirk N. Rhoades, Designated Procurement Officer, on June 6, 2023. Protests to this sole-source determination are due within seven calendar days after posting on OregonBuys and must be submitted to Victoria Crosby at the Oregon Department of Human Services Office of Contracts and Procurement.
The sole-source justification is supported by the finding that efficient utilization of existing goods requires compatible products from only one source, specifically because OSH currently operates another Roche instrument that uses multiuse reagents and parts, and the new COBAS e411 analyzer can interface with the existing Roche interface already connected to the OSH lab information system. Roche Diagnostics Corporation has moved sales of this product in-house and is no longer available through alternative distributors. The agency notes that Roche has demonstrated superior customer service, and maintaining the same vendor enables cost savings by eliminating the need for an additional deionized water line, as the Roche analyzer has a self-contained water system. Current spending on referred testing for these capabilities is approximately $50,000 annually. The contract specialist is Victoria Crosby, and the contact at Roche Diagnostics Corporation is Stacy Walker at 800-428-5074.

1. Background: This sole source justification applies to the purchase of:
a) This sole source justification applies to the purchase of an immunoassay analyzer, interface, and a service agreement for the Oregon State Hospital’s laboratory.
This instrument would serve the needs of patients at both OSH campuses (Salem and Junction City).
The Reagents for the COBAS e411 analyzer to be purchased will enable the OSH lab to test hormone levels (Prolactin), Hepatitis status (Anti-HCV, Anti-HBs, Hep A
Total, Hep A IgM), and thyroid function (Thyrotropin/TSH, Free Thyroxine/Free
T4). These tests are currently being referred to a reference lab. The OSH lab spends approximately $50,000 with this referred testing per year.

The lab currently owns a different Roche instrument, so interfacing equipment should be considerably easier and cheaper than utilizing a different vendor.
The reasons the agency is seeking this procurement method is due to Roche
Diagnostics Corporation taking the sales for this product in-house and it is no longer available through any other distributor. Roche has demonstrated superior customer service. Staying with the same vendor also enables the lab to have multiuse reagents and parts. This Roche analyzer also has a self-contained water system . The finances saved from not having to run an additional deionized water line is important to note. The Roche Cobas e411 interface, Service
Agreement, and Warranty on instruments are only covered when serviced by a
Roche technical service member.

Agency reserves the right to purchase additional goods, services to include on-call maintenance, preventative maintenance, repair (unless available on DAS price agreement), or training.
3. Written findings of fact (market research):
The findings below must include factual information supporting the determination that meet the sole source requirement in statute.
Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services. Market research includes utilization of the internet, trade journals, agency vendor lists, professional organizations, studies, catalogs/industrial periodicals, vendor sources, yellow pages, etc.
For information technology contracts, any ownership or proprietary issues should be fully addressed with written documentation to support facts.
Agency must select at least one of the findings and prepare the determination as it specifically relates to the good or service being procured. More than one finding can be addressed. The findings are as follows:
Pursuant to ORS 279B.075 (2)(a): Provide findings supporting the determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
The OSH lab currently uses another Roche instrument which uses multi‐use reagents and parts.
mailto:Victoria.A.Crosby@odhsoha.oregon.gov
The purchase of the Reagents for the Roche Cobas e411 interface will enable the
OSH lab to use those same multiuse reagents and parts. This new Roche instrument will also need to be interfaced with OSH lab information system. Due to the current Roche instrument that is already interfaced with the OSH lab information system, the new instrument would be able to use that same Roche interface to connect to the information system.
