About this file
This is a Certification of Current Capacity form (Form 525-010-46) issued by the Florida Department of Transportation (FDOT) for use by contractors submitting bids on FDOT lettings. The form requires bidders to certify that any proposal submitted does not exceed the firm's current capacity, defined as the maximum capacity rating less total uncompleted work. The form includes a Status of Contracts on Hand report that requires contractors to provide complete information about all prime contracts and subcontracts, whether in progress or awarded but not yet begun. The certification requires contractors to list all projects by owner, location, description, contract amounts, amounts sublet to others, and the balance of uncompleted work. The report must reflect uncompleted work as of the 15th day of the month preceding the letting date if the letting occurs before the 25th of the month, or as of the 15th day of the month of the letting if it occurs after the 25th. All new contracts awarded within five days before the letting date must be included in the report and charged against the firm's total rating.
The form requires the contractor to attest under oath that all information provided is accurate, with signature and date required from an authorized representative. Contractors are permitted to consolidate and list as a single item all contracts that individually do not exceed 3 percent of total contracts and that in aggregate amount to less than 20 percent of the total. This certification process is confidential under Florida Statute Chapter 337.14(1) and applies only to FDOT pre-qualified contractors bidding on state transportation projects.
