About this file
This is a submittal section document for litigation disclosure required by the Broward Sheriff's Office Department of Fire Rescue and Emergency Services (BSODFRES) for an RFP concerning a Hazardous Materials Train Derailment Synchronization Matrix Workshop and full-scale exercise in Florida. Proposers must disclose all current litigation, judgments, settlements, and court cases related to providing the requested services within the past three years, with bankruptcy cases required to be disclosed for the past seven years. The disclosure requirement applies to the proposer and all principals, including corporate officers, directors, controlling shareholders, managing members, general partners, and parent/subsidiary entities. Proposers must also indicate whether they or their principals have been debarred or suspended from conducting business with any government agency or professional board.
Proposers have an ongoing obligation to update litigation information throughout the solicitation process and until contract execution if awarded. The disclosure must include the type of action, the court or regulatory agency where the action was filed, the case or file number, the named parties, a summary of the action's nature, and the current status or disposition. Failure to maintain an updated case list may result in automatic disqualification during the solicitation process or contract termination if the proposer is awarded. For joint venture or team proposers, litigation information must be submitted for each member. If no litigation or regulatory action has been filed, proposers must provide a statement confirming this fact.
