About this file
This is a Final Waiver and Release of Lien form prescribed by Florida Statute Section 713.20, utilized by the Marion County Board of County Commissioners for construction projects. The document serves as a statutory lien release instrument that lienors must execute upon receipt of final payment for labor, services, or materials furnished to county projects, including the NE 148th Terrace Bridge Repair project. The form requires completion of payment amount, project description and information, and execution before a notary public, with required fields for the lienor's name, address, and authorized signature with printed name identification.
The waiver and release operates as a condition of final payment and may include conditional language allowing the lienor to void the release if the payment check does not clear. Florida statute prohibits county agencies from requiring lien waivers that deviate from this prescribed statutory form, ensuring standardized protection for both contractors and county entities. Lienors must have the document notarized with proper identification verification and notarial seal affixed. The form includes provisions for conditional release contingent upon check clearance, protecting the lienor's rights while simultaneously releasing all lien claims against the subject property upon receipt of final payment.
