Summary

This is a Full-Service Deputy License Agreement between the Denton County Tax Assessor-Collector (DCTAC) and a private company to provide motor vehicle registration, titling, and registration renewal services as authorized under Texas Administrative Code Title 43, Chapter 217. The agreement enables the contractor to operate as a full-service deputy at a single physical location specified by the contractor, offering these services to the general public during stated business hours. The contractor must comply with all Texas Transportation Code and Administrative Code requirements, Texas Department of Motor Vehicles (TxDMV) regulations, and DCTAC procedures. The agreement becomes effective upon the contractor's provision of an assumed name certificate, valid surety bond, insurance policy, and deputization of at least one employee as a Receiving Deputy, with failure to provide these items within 30 calendar days constituting a breach. The contract may be voluntarily terminated by either party with 90 days' written notice or immediately by DCTAC for any breach by the contractor.

The contractor must post and maintain a $100,000 surety bond payable to the DCTAC, which limits the contractor's authority to process titles and issue registration stickers to that bonded amount; the DCTAC may increase the bond requirement at its discretion with five business days' notice. The contractor is responsible for all costs associated with leased equipment (one basic RTS workstation and related network equipment provided by TxDMV), including annual lease fees, T1 circuit line costs, implementation fees, electrical requirements, equipment insurance naming DCTAC and TxDMV as additional insureds, and repair or replacement costs for damage or loss. The contractor must collect all prescribed taxes and fees via ACH transfers only from customer accounts to the DCTAC's account, remitting funds daily, and may retain portions of processing and handling fees plus approved convenience fees and title transaction fees as authorized under Texas Administrative Code. The contractor must install remote-viewing capable surveillance equipment at its own expense covering all workstations, customer service areas, inventory and money storage areas, and all entrances/exits, with live and recorded footage accessible to DCTAC and authorized state and federal agencies at any time without notice. All employees performing services must be deputized Receiving Deputies who have completed background checks, pre-deputization training including TxDMV cyber security training, and taken a notarized oath of office; the contractor must notify DCTAC within four business hours of any deputy separation. The contractor is subject to audit by DCTAC, Texas Department of Transportation, the Texas Comptroller, or certified public accountants at any time during business hours without prior notification.
