About this file
The document is an Addendum #3 to a Request for Proposals (RFP) issued by the Port Authority of New York and New Jersey for expert professional engineering design services to be procured on a task order basis over a four-year term. The RFP specifically seeks proposals for Climate Resilience and Sustainable Design services, with proposers required to submit three to seven relevant projects per service subset. The proposal submission deadline is set for 2:00 P.M. on December 22, 2023, with questions accepted up to seven days before the due date. The selection process will evaluate proposals on a pass/fail basis, considering technical qualifications and cost.
The RFP outlines specific requirements for prime consultants, including that proposer requirements must be met independently by the prime firm and cannot rely on subconsultant experience. Proposers must complete an MBE/WBE/SDVOB Participation Plan, listing potential minority, women-owned, and service-disabled veteran-owned business participants. The hourly rates should be listed for 2024, with subsequent year rate adjustments following the standard agreement provisions. Insurance requirements are primarily the responsibility of the prime consultant, who must ensure adequate coverage for subconsultants. The task orders may encompass temporary staffing or project-specific work, providing flexibility in service delivery.

SUBJECT: REQUEST FOR PROPOSALS FOR THE PERFORMANCE OF EXPERT
PROFESSIONAL ENGINEERING DESIGN SERVICES AS REQUESTED
ON A “TASK ORDER” BASIS DURING A FOUR-YEAR TERM –
ADDENDUM #3
Dear Sir or Madam:
The Port Authority of New York and New Jersey (the “Port Authority” or “Authority”) hereby amends the subject Request for Proposals (RFP) as follows:
• On Page 7, Attachment E: Firm Qualifications and Experience, under Relevant Projects, replace the sentence in its entirety and replace with the following:
“(Include a minimum of three (3) projects and no more than seven (7) projects comparable to the services contemplated under this solicitation.)”
The following are questions from RFP recipients. The questions and the corresponding Authority answers are provided for your information and use, as appropriate.
Question #1: Regarding “Proposer Requirements” under these solicitations does the Prime
Consultant need to meet all of the staff and project requirements independently or can the staff and project requirements be met by a combination of the Prime Consultant along with their designated Subconsultants for each contract?
Answer #1: No. Proposer requirements can only be met by the Prime firm to be considered for the subject services.
Question #2: Under the Instructions and Additional Information – Selection Process the language states that “Proposals will be evaluated on a pass/fail basis on the technical qualifications demonstrated in the proposals with consideration of cost, as appropriate”. How specifically will cost will be considered?
Answer #2: Cost will be considered only if a firm “passes.” Should a firm “pass” the Authority will look at the multiplier and hourly rates at a proposal level and Task Order level.
Question #3: In RFP Section 7 – MBE/WBE/SDVOBs Participation Plan there is a requirement to include Attachment F – MBE/WBE/SDVOB Participation Plan. Considering specific Tasks are not included in this RFP, what are the Authority’s expectations in how this Attachment should be completed? Also see the bottom of page 9 of the Agreement regarding requirements to submit forms PA 3760C and PA 3760 SDV1 with task order proposals.

Answer #3: The selected Consultant(s) shall submit to the Authority for review and approval prior to commencing any services, along with invoices, the Statement of Subcontractor Payments in the form of the MBE/WBE Participation Report (Form PA 3760C) and/or SDVOB Participation Plans (Form PA 3760SDV1) for each Task Order to perform work. For the purposes of this RFP, provide the names and addresses of all MBE/WBE/SDVOBs that shall be included in the Plan. If none are identified, describe the process for selecting participant firms in order to achieve the good faith goals under this Agreement. If possible, indicate the percentage of MBE/WBE/SDVOB participation expected to be achieved with the arrangement described in the Plan, and describe the specific scope of work the MBE/WBE/SDVOBs will perform. If possible, provide proof of MBE/WBE/SDVOB certification status with the Authority.
Question #4: Are the rates being submitted in RFP Section 8 – Cost (Attachment G) solely for cost comparison purposes and to be utilized in the selection process as indicated in the Instructions and Additional Information – Selection Process section of the documents? Is the expectation that rates for individual tasks (that will be subject to the compensation and rate adjustment terms outlined in Section 9A of the Agreement) will be set at the time of individual Task Order engagement?
Answer #4: The hourly rates should be listed for 2024 and rate adjustments will follow the language in the Standard Agreement, Section 9.A. for following years of the program.
Question #5: Are subconsultants subject to the rate adjustment provisions (outlined in the Standard Agreement, Section 9.A, including items – items a, b, c & d)?
Answer #5: Yes.
Question #6: Under Agreement Section 26 – Liability Insurance and Workers Compensation Insurance there is differing language in certain insurance subsections. For the Commercial Liability (A1), Workers Compensation and Employers Liability Insurance (A2) and Professional Liability Insurance (A5) sections, the “Consultant and its’/their Subconsultants” language is utilized or can be interpreted within A5. For Additional Coverages (A3 and A4) solely “Consultant” is utilized. Should we interpret that Subconsultants are not required to provide the Additional Coverages outlined in sections A3 & A4 and to incorporate these subconsultant overhead costs within our multiplier calculations?
Answer #6: The Consultant in contract with the Port Authority is required to provide the insurance. The prime Consultant is responsible to ensure subconsultant insurance is in place and adequate based on the scope of work and will typically incorporate subconsultant overhead cost in the Proposal.

Question #7: The RFP does not request an organization chart. Does the Authority expect consultants to submit an organization chart with the proposal?
Answer #7: It is a business decision if a firm would like to submit an organization chart within their Proposal.
Question #8: Does the Authority anticipate requiring interviews or presentations as part of the selection process?
Answer #8: No.
Question #9: Apart from the MWBE utilization form, the RFP does not contain any additional individual forms for subconsultants or any request for Business Registration Certificates or Certificates of Authorization for New York or New Jersey. Please confirm that no additional individual forms or certificates are required from subconsultants for this submission?
Answer #9: That is correct.
Question #10: Is there a deadline to submit questions pertaining to this RFP?
Answer #10: Questions for this RFP shall be received no later than seven (7) days before the due date.
Question #11: Will the Authority be considering information from the firm’s Professional Services Firm Questionnaire (PSFQ) as part of the Pass/Fail decision-making process?
Answer #11: No.
Question #12: Specifically for the Climate Resilience and Sustainable Design RFP - Three projects are required for each service; can a relevant project overlap and be used to demonstrate both services?
Answer #12: Yes. Indicate in the project title that it is for both subsets.
Question #13: Will this Agreement be for full time “staffing” positions, or temporary work, or a combination of both?
Answer #13: These agreements are on a task order basis. Task orders may be for temporary staffing or project specific projects.
Question #14: Attachment E states no more than seven (7) projects can be included in this section.
Should this be interpreted as seven (7) projects total or seven (7) projects per service (Climate Resilience and Sustainable Design)?
Answer #14: Up to seven (7) projects per subset.

Question #15: Is the minimum/maximum project number for the Proposer and each of its subs, or for the entire Proposer/sub team?
Answer #15: Subconsultant experience cannot be utilized to fulfill the Proposer Requirements therefore, only the Prime experience should be included.
Question #16: Does the Authority want all Proposers to use the Word template RFP for all qualifications (resumes and projects), or are we permitted to include additional attachments about each firm’s background and experience for consideration?
Answer #16: The template should be utilized to the maximum extent possible. A Proposer is not precluded from attaching relevant material.
Question #17: Please confirm if the salary rate schedule is for the Prime and subconsultants.
Answer #17: The Salary Schedule is for the Prime firm only.
The date for receipt of proposals for the subject RFP remains 2:00 P.M. on December 22, 2023.
