About this file
This Sole Source Justification document details the General Services Administration's (GSA) procurement of five (5) BMW R 1250 RT-P motorcycles for the Federal Protective Service (FPS). The motorcycles are specifically required for Law Enforcement duties and ceremonial events, with a Period of Performance of 60 business days ARO. The procurement will be a brand-name requirement competed among BMW authorized contractors, with a focus on motorcycles customized to Law Enforcement specifications.
The justification highlights several unique qualifications for selecting BMW motorcycles, including the need to limit physical risk in law enforcement environments, specialized training requirements, and efficient servicing capabilities. The market research conducted confirmed that only BMW brand motorcycles can meet the government's needs, with two potential sources identified (Bob's Motorcycles and Morton's BMW Motorcycles). The solicitation will be posted on SAM.gov, and the government will utilize multiple price analysis techniques to ensure fair and reasonable pricing. The procurement is being conducted under simplified acquisition procedures and is not expected to exceed the simplified acquisition threshold.

Sole Source Justification – BMW R 1250 RT-P motorcycles declined to quote this requirement based on the customizations. BMW of North America stated that this should be competed among the BMW dealerships authorized to customize their products.
For the above reasons utilizing BMW of North America (the manufacturer) directly is not possible so this will be a brand name requirement for the BMW brand and will be competed among all BMW authorized contractors able to complete the work.
6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERORS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE,
INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED
BY SUBPART 5.2, AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES
FAR 5.202(a)(13)(i) through (iii) “Exceptions” is applicable to this requirement. The requirement is:
(i) for an amount not expected to exceed the SAT.
(ii) The solicitation will be made through SAM.gov
(iii) SAM.gov allows the public to see and respond to the solicitation.
Further, FAR 5.102(a)(6) requires that the CO shall include the documentation with the solicitation when it is posted. This documentation will be made available with the solicitation when published on SAM.gov.
7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED
COST WILL BE FAIR AND REASONABLE
This requirement is single source brand-name; therefore, the Government will be utilizing at least two (2) price analysis techniques outlined in FAR 13.106-3 to determine whether pricing submitted is fair and reasonable. These techniques include, but are not limited to the following:
● Requesting recent commercial and Government sales history
● Making indirect pricing comparisons to:
o the same or similar items in the marketplace;
o competitive published price lists;
o independent government cost estimates.
8. A DESCRIPTION OF MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE
RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED
The market research conducted by the Contracting Officer (CO) and information submitted by the customer for review indicates that only BMW brand-name motorcycles can meet their needs.
FPS provided two (2) possible sources: Bob’s Motorcycle (dba Bob’s Used Parts, Inc. – UEI SSMFBGVX4F23), and Morton’s BMW Motorcycles (Morton-Massey Inc.- UEI XFB5H89LA9K7).
Bob’s Motorcycles is registered in SAM.gov and has expressed interest to the program office
Sole Source Justification – BMW R 1250 RT-P motorcycles regarding this requirement.
On July 21, 2025, the CO searched bmwmotorcycles.com and confirmed Bob’s Motorcycles and Morton’s BMW are within a 50 mile radius of the requiring activities location in Springfield, VA. In addition, two other BMW dealerships were identified within a 50 mile radius: BMW Motorcycles of Dulles and BMW Motorcycles of Gaithersburg. However, the CO was unable to confirm if the Dulles and Gaithersburg locations have accounts registered on SAM.gov.
Based on the results of the above market research there is a reasonable expectation of receiving competition via posting the solicitation on SAM.gov.
No other sources expressed interest in this requirement.
The brand name BMW motorcycle is currently the only reasonable brand capable of meeting the Government’s needs. Prior to any subsequent procurement, the Government will once again review the market using various methods to assess whether any other qualified sources are available and are able to meet the Government’s requirements.
