About this file
This document is an amendment to a solicitation for a design-build services contract for the Mike Mansfield Federal Building and U.S. Courthouse Seismic Retrofit and Limited Modernization project in Butte, Montana.
The amendment provides answers to questions received regarding the solicitation. Key details include: the selected Construction Manager, confirmation that progressive collapse mitigation is not required, and clarification that only daylight-applied fragment retention film on exterior windows is required for blast mitigation. The amendment also notes that small business subcontractors may rely on their team's capabilities to meet the past experience criteria. The solicitation closing date remains July 9, 2024. The overall project involves the design and construction of a seismic retrofit to bring the historic building to current standards, along with limited modernization of building systems and architectural elements.

Amendment 0005, June 14, 2024 Continuation of Block 14 of Standard Form 30 Solicitation 47PJ0024R0061 – D-B Services – Mike Mansfield FB/CH Seismic Retrofit & Ltd Modernization
Amendment 0005 is issued to: 1) provide answers to questions received in writing in response to the solicitation document.
1. Answers to questions are provided as follows:
Question 19: Has the Construction Manager been selected for the project? If so, which company will be filling that role?
Answer 19: The Construction Manager as Agent (CMa) selected for this project is Johnson, Mirmiran & Thompson, Inc.
(JMT). Ms. Debbie Drews is the designated Project Manager from JMT.
Question 20: Please confirm that Factor 1A projects will receive a neutral rating for Factor 4 Technical Qualifications if the client is not willing/able to complete a new Past Performance Questionnaire in the allotted timeframe.
Answer 20: The bases of evaluation for subfactors 4A and 4B informed offerors that the Government may rely for its evaluation upon "and any A/E firm" (subfactor 4A) or "General Contractor" (subfactor 4B) "past performance information that the Government becomes aware of." (Section VI.G Non-Price Factors, Subfactors 4A and 4B)
GSA may rely upon other records of relevant past performance apart from Past Performance Questionnaires as noted above in the "Basis for Evaluation" paragraphs of subfactors 4A and 4B, and as noted in Section III.H., "Contractor Performance Information," of the solicitation.
A neutral rating will be given to offerors without a record of relevant past performance or for whom information on relevant past performance is not available.
Question 21: For the Go-No Go Factor and Factor 1, please define substantial completion and advise if this applies to design or construction.
Answer 21: Refer to the response provided to Question #13 in Amendment 0003. Refer to GSAM 552.211-70 included in
The Agreement - Draft - Mansfield Seismic Retrofit DB.
Question 22: Please confirm that a Passive House Certification will not receive additional consideration as the solicitation is a nonresidential facility.
Answer 22: Refer to The Solicitation, Section VI.G Non-Price Factors, Evaluation Factor 3: Lead Designer, which provides for additional favorable consideration may be given to the extent that “The LD as Passive House Certification.”
Question 23: The Mike Mansfield FB/CT Seismic Retrofit/Limited Modernization Program Development Study –
Butte, Montana, 100% Submittal, October 31, 2023, notes that “After careful consideration, the FSC made a risk-based decision to decline the progressive collapse and blast mitigation requirements for FSL IV, as these would have a significant impact on usable space, tenant operations, and historic attributes.
Furthermore, blast strengthening of the exterior walls to meet FSL III blast resistance requirements were also waived. Instead, the recommendation was to limit the blast mitigation measures to the installation of daylight-applied fragment retention film on the glazing for all exterior windows per ISC and GSA requirements for windows for FSL III existing facilities.” However, Attachment 08 P100 Facilities Standards for Public Buildings, sections 4.5.1 and 4.5.2 indicate that we need to be in conformance with GSA ISC Interpretation Document (Blast Design) and with General Services Administration Alternate Path Analysis & Design Guidelines for Progressive Collapse, Revision 1, January 28, 2016.
Can you confirm that the scope is to limit the blast mitigation measures to the installation of daylight-applied fragment retention film on the glazing for all exterior windows per ISC and GSA requirements for windows for FSL III existing facilities and not include progressive collapse mitigation requirements
FSL IV?
Answer 23: The scope is limited to the installation of daylight-applied fragment retention film on the glazing for all exterior windows per ISC and GSA requirements for windows for FSL III existing facilities.

Question 24: Are FSL III progressive collapse structural mitigations required for the project?
Answer 24: FSL III progressive collapse structural mitigations are not required.
Question 25: If small business A/E firms do not meet the Similar Project criteria, but have teamed with partners to fulfill those criteria, is there a limit to how many projects each small business A/E firm should submit to show respective qualifications in their specialties for historic, MEP, local architectural, etc? It’s my understanding that 1 project (4 page limit) should be submitted for the Seismic Project, and 1, but no more than 3 Special Projects should be submitted for the prime offeror. Is there a limit for projects considered for the small business subcontractors (see Evaluation Factor 1).
Answer 25: In accordance with The Solicitation, Section VI.G. Non-Price Factors, Evaluation Factor 1: Technical Qualifications -- Past Experience of the General Contractor and A/E Firm:
Under Evaluation Subfactor 1A,"when an offer of a small business prime contractor includes a proposed team of small business subcontractors and specifically identifies the first-tier subcontractor(s) in the proposal, the head of the agency must consider the capabilities, past performance, and experience of each first tier subcontractor that is part of the team as the capabilities, past performance, and experience of the small business prime contractor if the capabilities, past performance, and experience of the small business prime does not independently demonstrate capabilities and past performance necessary for award." Please note the requirement of similarly situated businesses at the prime and first-tier subcontractors.
Each offeror (regardless of size) shall provide sufficient documentation in order to demonstrate the extent of the Offeror’s past experience for at least one (1) but no more than three (3) SPs total completed by the A/E Firm.
All other terms and conditions remain unchanged.
The Phase 1 proposal submission remains 1:00 PM Mountain Time, July 9, 2024.
