The purpose of Amendment 0004 for solicitation number 47PJ0018R0250, Operation and Maintenance (O&M) Services for the Colorado Service Center (CSC), is to provide the following;

1) Answers to questions pertaining to the above listed requirement in conjunction with providing amended language for various sections of Attachment C1 and Attachment D1.

2) Amend Attachment E1: Offeror Experience from;

● Similar Size (all of the following)

○ O&M work in one or more buildings totaling at least 1 million SqFt.

○ O&M work with a total value of at least $7,000,000 in one or more buildings.

TO:

● Similar Size (all of the following)

○ O&M work in one or more buildings totaling at least 500,000 SqFt.

○ O&M work with a total value of at least $5,000,000 in one or more buildings.

3) To add the following to Attachment C1: Commercial Item Clauses:

(11) Adjusting Payments

(i) Under the Inspection of Services clause of this contract, payments may be adjusted if any services do not conform with contract requirements.

The Contracting Officer or designated representative will inform the Contractor, in writing, of the type and dollar amount of proposed deductions by the 10th workday of the month following the performance period for which the deductions are to be made.

(ii) The contractor may, within 10 working days of receipt of the notification of the proposed deductions, present to the Contracting Officer specific reasons why any or all of the proposed deductions are not justified.

Reasons must be solidly based and must provide specific facts to justify reconsideration and/or adjustment of the amount to be deducted. Failure to respond within the 10-day period will be interpreted to mean that the contractor accepts the deductions proposed

(iii) All or a portion of the final payment may be delayed or withheld until the Contracting Officer makes a final decision on the proposed deduction.

If the Contracting Officer determines that any or all of the proposed deductions are warranted, the Contracting Officer shall so notify the contractor, and adjust payments under the contract accordingly.

(12) Monetary Reductions For Deficient Work And Work Not Performed or Completed

(i) When the Contractor reports work as being complete, and that work is subsequently rejected by GSA as being deficient, a single follow-on inspection will performed by GSA at no additional cost to the Contractor.

However, any further re-inspection costs will be billed to the Contractor at the established Service Center assessment rate, currently at $65.00 per hour, multiplied by the actual time (rounded to the nearest thirty (30) minutes), needed to perform and document the follow-on re-inspection.

(ii) Should any required services not be performed, be found unsatisfactory and not corrected, or be otherwise deficient, a monetary reduction will be made to the Contractor using the Additional Services hourly wage as shown in the Price Proposal Schedule.

(iii) If any deficient work is to be performed by others, then the actual charges to correct the work plus appropriate administrative charges will be deducted.

(iv) Monetary adjustments may also be made for actual time expended by GSA personnel to administer, follow-up and resolve any Customer Complaints in excess of 10 complaints per month.

(v) All monetary reductions will be assessed monthly. Frequent months where service call or other customer complaints total more than 10, or consistent failure by the Contractor to provide required services may cause the Government to elect to terminate the contract for default.

(vi) Service Calls versus Complaints;

Service Call: A call placed by GSA/an agency customer/or by personal visit, which denotes a service which was not performed, or performed unsatisfactorily, usually the previous night. These type calls are a normal day-to-day occurrence and are NOT considered complaints. Generally, work orders shall be generated through our CMMS system for corrective action(s).

Complaint: A call placed by GSA/an agency customer/or by personal visit, which denotes a custodial service of a substantive or repetitious nature, which was not performed or performed unsatisfactorily, or when an incident such as described below occurs. Some examples of complaints might be:

(a) When a significant area of a building (at least a wing or large open area), was not cleaned or serviced the night before.

(b) When theft or damage occurs to Government property, or agency equipment, and is reported and determined to be through the fault of the Contractor, subcontractor or employee negligence.

(c) When repetitious occurrences and repeat calls happen that equate to three or more, for the same incident, during a one month period.

(d) When urgent or emergency services are requested and these services were either not provided, or deficiently provided.

(e) When follow-up corrective actions are not taken to work order requests or inspection reports.

(f) When unsuitable behavior or actions are reported.

4) Attachment D5 - Additional Services Job Classification is being removed from the solicitation per this Amendment. Please do not fill out this form as it is no longer apart of the solicitation documents. It is only necessary to fill out the Pricing Schedule.

Per C.1.1(e) in Attachment D1 (Pg. 15), the following is stated;

“All Building Monitor and Controls (BMC) system are within the scope of this contract. These BMC systems may include Building Automation Systems (BAS), Digital Lighting Systems and Public Address Systems, Energy Management Systems or other building controls systems. BMC systems will be connected to the GSA Network and access to these systems will require GSA ENT network credentials (see section C.35.4.1.1 for details). Contractor will be responsible for hardware and software for listed systems excluding computerized operating systems (For example Windows Server 2008, Linux, etc.). Software maintenance must include security patching and minor revision updates as recommended by system installer. A minor revision is an incremental patch or update to the existing software or firmware version with low risk to existing interoperability.”

However; the language provided in Attachment D1, Section C.35.4 BAS Control Systems is being incorporated via Amendment and takes precedence. Please bid in accordance with language provided in this section. It states the following;

“Control systems shall be maintained as designed. The Contractor shall perform maintenance required to ensure that all BAS devices function properly and repair or replace components that fail. GSA will be responsible for BAS software and firmware upgrades and security patches. The Contractor shall cooperate with GSA and the BAS vendor to facilitate any upgrades GSA deems necessary for the functionality and/or security of the BAS. The Contractor shall not upgrade or patch any BAS device. The Government may upgrade or change control system software or reprogram control systems during the performance period of the Contract. If the Government provides operator level training and operator level documentation for the Contractor’s use, the Contractor shall not claim additional payment for changing to the new or upgraded software or control programs. The Contractor will not modify sequences of operation or control programs or run systems manually without prior approval of the CO or their designee and regional subject matter expert (SME). Where sequence or operation changes are approved, the Contractor is required to provide accurate edits to the Sequence of Operation to document the changes made.”

5) Attachment D1: Performance Work Statement, Section C.35.7 Consumables, is hereby amended to incorporate “$2500.00 per building.”

The language in C.35.7 Consumables, is changed from:

The Contractor is responsible for any consumables (including fuel) used during day-to-day operation of a generator, i.e., exercising the generator, testing, etc.

Operation of a generator for an extended period (more than 4 hours per event) or due to a power loss would be treated as a reimbursable expense. If the operation of the generator is caused by Contractor negligence, the Contractor shall be liable for the full cost of refueling, any other provisions notwithstanding. The contractor shall not allow the fuel level to drop below 75%. The contractor shall provide fuel up to $2,500.00 per contract year. The contractor shall maintain a running log containing the amount of fuel used with associated costs and have available to the CO or designee upon request. GSA will pay for all fuel after the $2,500.00 limit is reached each year the contract is in effect.
