Solicitation 47PH0218R0005

Amendment PA02 Operations & Maintenance Services

New Orleans, LA

Solicitation Questions and Answers

Q : I just wanted to verify that 47PH0218R0005 Operations and Maintenance Services for New Orleans, LA can be submitted via email. The submission will be received in three separate parts, but no hardcopy needs to be mailed.

A : Please review L.4.2.3 of the solicitation. All submissions are to be broken down in three parts. Each part shall be in a separate sealed package and contain 1 Electronic CD-R. Each separate sealed package shall contain one of the following: 1 - CD-R of the Technical Proposal (Part 1), 1 - CD-R of the Price Proposal (Part 2), and 1 - CD-R of the Miscellaneou Documents (Part 3). Also see the SF 30 Continuation Sheet within Amendment PA02.

Q : Section L.5.2 Experience has 2 subsections:

L.5.2.1. The offeror must submit a minimum of 2 projects within the last 5 years that detail experience that is similar to scope and magnitude of this requirement. The offeror must demonstrate experience providing contract services for the management, supervision, labor, materials, equipment and supplies in the services described in Section C that are similar in nature to the size, scope, and complexity of the services being required by this solicitation. To be considered similar the projects provided should cumulatively demonstrate: (list provided).

Then, L.5.2.2. The offeror must submit a minimum of 2 projects but may elect to provide up to 5 projects to demonstrate experience. Each project should be submitted separately. For offers from Joint Venture, Partnerships, and other teaming arrangement, project may be submitted from any firm listed in offerors submittal for L.4.2.6 Joint Ventures, Partnerships and other teaming arrangements. An offeror may also submit a project for any ventures in which they were a member of a teaming arrangement, however, they must clearly specify their role and contribution to the project. An offeror’s experience as a sub-contractor will not be considered.

Question – Are the minimum of 2 projects provided to respond to both L.5.2.1 and L.5.2.2 cumulatively, or, must Offerors provide a set of projects for L.5.2.1 AND another set (possibly the same projects) for L.5.2.2?

A : The minimum of 2 projects may be duplicated from L.5.2.1. And L.5.2.2.

Q : 1. Per RFP Section L.4.2.3, each proposal volume must be submitted in a separate sealed package. Is it the government’s intent for each volume to be self-contained on a separate CD? Will the government allow offerors to submit all 3 volumes on the same CD in 3 individual folders or zip folders?

A : Per Section L.4.2.3., each of the three parts of an Offeror’s proposal shall be submitted in a separate sealed package. It is intended that Offerors only include one part of their proposal per CD-R within each envelope. Therefore, there should be a total of three separate envelopes, and one CD-R with one of the three parts of the proposal within each CD-R.

Q : Reference RFP Section L.5.3.2. Past Performance Questionnaires. This section includes two sentences that appear to be contradictory.

a. The first sentence of the third paragraph states “The Offeror shall e-mail the Past Performance Questionnaires to the Past Performance references and instruct the references to e-mail their responses directly to the GSA Contract Specialist, Phillip Cleveland at phillip.cleveland@gsa.gov.”

b. However, the first two sentences of the fifth paragraph state “The Offeror shall complete the Contract Identification portion of the Past Performance Questionnaires and forward to the party providing the reference for completion. Upon completion, the Past Performance Questionnaire should be return to the offeror for submission with their technical proposal.”

Please clarify whether past performance questionnaires are to be submitted directly from offeror reference points of contact to the government or included in the offeror’s technical proposal.

A : The specification has been amended to clarify that Past Performance Questionnaires shall be submitted directly from the reference to the GSA Contract Specialist, Phillip Cleveland at phillip.cleveland@gsa.gov . Please see Amendment PA01.

Q : RFP Section L.6, Pricing Proposal Requirements, requires that Part 2 Price Proposal only include FIGURE_B-3_PRICING_OF_SERVICES_-_OPERATIONS_AND_MAINTENANCE.xlsx. The RFP package also includes FIGURE_B-1_Staffing_Declaration.xls and FIGURE_B-2_New_Format_for_Mechanical_Comb_Union_and_Non_Union_Contracts.xls

x. Is it the government’s intent that offerors also complete both of these spreadsheets?

Please clarify and advise where these are to be included in our proposal package.

A : As stated in Section B.2., The Figure B-1, Contractor Staffing Declaration must be completed by the contractor and submitted to the Contracting Officer (CO) 21 calendar days prior to the contract start date. This form must also be submitted to the CO when any modifications to the contract by GSA result in changes in staffing. A blank Figure B-1 is included as part of the solicitation for reference only. Therefore, the Figure B-1 shall not be included within your proposal. The Figure B-2 Spreadsheet is provided as a sample only and will be used for annual Service Contract Act (SCA) and/or Collective Bargaining Agreement (CBA) wage adjustments mailto:phillip.cleveland@gsa.gov during the exercise of Option year periods after award; therefore, the Figure B-2 shall not be included with the proposal.

Q : Per Section L.5.1.1. Management Plan Narrative of the RFP there is a 10 page limit to this section. A significant amount of information is asked for in this section. Would the government consider increasing the page count to 20 pages?

A : District Court is a extension of Boggs consider them the same building.

Q : Figure L-1 CBA Employees Does the staffing listed in L-1 CBA employees reflect the current staffing on site now?

A : No, the supplied L-1 is a baseline.

Q :

Q : C.1.1. Contractor Responsibility for Equipment and Systems

o. The Contractor is not responsible for the costs of software, firmware updates, and licensing for the BAS and Tridium Niagra systems. However, the Contractor is responsible for the labor to update/install software/firmware, when necessary, to latest revision and update software licenses for BAS controls only. QUESTION: Are you saying that we are not responsible for the cost of the BAS software upgrade but are responsible for the labor to install the upgrade?

A : If costs are associated with the update/install, software/firmware update the shared liability will apply. If there is a panel that needs to be replaced that requires new software or reprogramming the shared liability applies as well. If a software upgrade is required across the BAS system that does not require hardware replacement or an upgrade GSA is responsible for these costs.

Q : C.2.15. Consumable Parts

“Consumable parts” or components are parts or components that customarily require regular replacement rather than repair in a maintenance program and shall be disposed of properly. Examples include, but are not limited to: oil, grease, belts, filters, ballasts, lamps, etc.

Q : C 17. BUILDING MANAGEMENT SUPPORT SERVICES

The chart shows hourly overtime rates that are significantly lower than the any of the overtime hourly rates shown in the Collective Bargaining Agreement (CBA). For example, the INITIAL overtime hourly rate in the chart is $30.50 per hour, and the GMW overtime rate, which lowest job classification in the CBA, is $36.39 per hour starting April 2018 ($24.26 x 1.5 = $36.39), so the Contractor would be losing $5.89 per hour (which does not include the additional cost of payroll taxes and fringes). QUESTION: Is this an error? If not, the Contractor will lose money for each hour worked by its employees, is this the Government’s intention?

A : GSA will comply with the CBA rate as long as the employee is covered on the CBA. $30.50 an hour is an Error. The Initial Per Productive hour should be $36.39 for a GMW.

Q : C.20. LABELING OF ELECTRICAL OUTLETS. QUESTION: Is labeling up to date?

A : GSA expects any new work that is performed during the contract that proper labeling is done for the new work. However, if the O&M discovers incorrect labeling during the performance of this contract it is their responsibility to notify the COR.

Q : C.23.3. Emergency Call Back (after hours). QUESTION: Please provide your advice on how we should allocate the 734 hours between the buildings?

A : The 734 hours is an annual amount per contract year to cover all the facilities in this solicitation. There is no way to predict the hours each building will use emergency and non emergency hours during the course of each contract year.

C.23.3 and C.35.1 have been changed via Amendment PA02.

A : See above highlighted Green.

Q : Please provide the Current manpower for buildings as assigned.

A : GSA will not provide this information.

Q : Please provide a list of any GFE and building location.

A : Not available at this time.

Q : (Ref. B.1.1) Please advise if the government will incorporate a block which requests:

Total Cost (Base + All Option Periods) for Monthly Operations and Maintenance & Annual Total Maintenance for evaluation purposes?

A : Matt to answer. The total cost is for evaluation purposes only, and is included within the Figure B-3 spreadsheet. It is not a necessary part of the Section B pricing.

Q : (Ref. B.1.2) Please clarify how the offeror can be compensated for example “Reimbursable Repairs” or “Additional Services” which may involve only labor?

A : Refer to C.40.3. Which is Reimbursable Repairs and C.2.3. / H.18. are Additional Services.

Q : These requirements are outside of basic recurring services?

A : This question is not clear.

Q : (Ref. B.2 & B.5) Please clarify if “Figure B-1” must be submitted with the Offerors proposal for evaluation purposes or only when the offeror is notified of he/she is the successful offeror? There seems to be a conflict with para B.2 & B.5?

A : Matt to answer.

Q : (Ref. C-III) Please clarify which buildings have metering systems and the types so that the offeror can project material costs for what’s in existence now?

A : Each building in the solicitation has a water, gas, and electric meter.

Q (Part 1) : (Ref. C.1.1) Please clarify who is responsibility for “replacement” vs “repair” of equipment when it comes to “Shared Liability”?

A (Part 1) : Contractor is responsible up to the shared liability threshold for replacement and repair of equipment. For example: Such as if water heater failed and replacement of the water heater is required, shared liability applies. If the water heater can be repaired and does not require complete replacement the shared liability also is applied. This also applies to all other equipment, systems, parts...etc as well. All modifications to install or repair/replacement equipment/components is part of the shared liability.

Q (Part 2) : Does this mean the offeror is responsible for “UP TO SHARED LIABILITY LIMIT OF $2500 and GSA responsible for the remaining balance?

A (Part 2) : Yes.

Q : (Ref. C.1.1(e)) Please clarify the meaning of “Limited to $200/3 Hrs service call threshold”……does this mean a total of $200 or 3 Hrs for entire contract year? After this threshold amount has been met the government takes full liability for the remainder of the contract year.

A : C.1.1 (e). Architectural and structural systems, fixtures, and equipment within the site (to the property line). Limited to $200/3 hour per service call threshold. C.39.1 General:

The Contractor shall maintain, repair, replace, modify, and restore all of the architectural and structural components of the building. The Contractor shall conduct routine inspection and minor maintenance and repair of interior and exterior architectural and structural systems components. Region 7 GSA sets the threshold of these type repairs at $200/3 hours of labor. We are not expecting you to replace the facade of a building, but if a piece has come off, we would expect you to repair it if it is under the service call threshold of $200/3 hours. This is per occurrence not per year.

Q : (Ref. C.1.1(o)) Please clarify that offeror will be allowed to apply “Markup Coefficient” to remaining balance for “labor” associated for updating/installing software/firmware for BAS Controls? Reference B.1.2 “Markup Coefficient” which states this does not apply to labor….how does the offeror recover cost for manage of subcontractor doing work on BAS Controls that exceed Shared Limit of liability?

A : The O&M Contractor is not allowed to mark up the labor for work they perform nor allowed to mark up the labor on work that is subcontracted out.

Q : (Ref. C.2.3.7) Please clarify that the offeror is only responsible for costs UP TO the SHARED LIMIT OF LIABILITY (Parts and Labor)?

A : It doesn’t become shared liability unless the parts or materials are over $2,500. Labor is not included in this.

Q : (Ref. C.8.7.4) Please confirm that when the Contractor provides “escorts” after hours that the contractor will be paid based on our loaded rates which are based on required CBA wage rates per classification of the employee?

A : This depends on what the escort requirement is for. Please refer to the following Sections:

C.17., H.1.4.1., H.1.4.3., H.1.4.4., and H.3.

Q : (Ref. C.17) Please clarify how GSA can pay different rates when the Contractor is required to pay the loaded hourly rates plus fringe benefits as outlined in the Collective Bargaining Agreement (CBA) times 1.5 for overtime? Please confirm the Offeror is authorized to legally pay different rates as GSA has outlined in this paragraph which is different from what’s mandated in the CBA attached to this solicitation?

A : GSA will comply with the CBA rate as long as the employee is covered on the CBA. $30.50 an hour is an Error. The Initial Per Productive hour should be $36.39 for a GMW.

Q : (Ref. C.22.1) Please clarify that the Contractor will be allowed to apply the coefficient to LABOR for using a subcontractor to program software and/or conduct firmware updates for this requirement or will GSA issue its own contract to perform any software programming or firmware updates?

A : If costs are associated with the update/install, software/firmware update the shared liability will apply. If there is a panel that needs to be replaced that requires new software or reprogramming the shared liability applies as well. If a software upgrade is required across the BAS system that does not require hardware replacement or an upgrade GSA is responsible for these costs. Again GSA does not pay markup on labor.

Q : (Ref. C.22.2) Please clarify that the Contractor will be allowed to apply the coefficient to LABOR for using a subcontractor to program software and/or conduct firmware updates for this requirement or will GSA issue its own contract to perform any software programming or firmware updates?

A : If costs are associated with the update/install, software/firmware update the shared liability will apply. If there is a panel that needs to be replaced that requires new software or reprogramming the shared liability applies as well. If a software upgrade is required across the BAS system that does not require hardware replacement or an upgrade GSA is responsible for these costs. Again GSA does not pay markup on labor.

Q : (Ref. C.23.3) Please clarify that GSA will reimburse the Contractor based on specific employee classification per the CBA at the loaded rates for any after hours work?

A : Since the question may pertain to subcontractors and in house workforce please refer to the following paragraphs: C.17., H.1.4.1., H.1.4.3., H.1.4.4., H.3., as well as C.23.3, and C.35.1 (C.23.3 and C.35.1 have been changed by Amendment PA02).

Q : (Ref. C.23.5) Please clarify whether GSA will reimburse the Contractor for routine work which goes past “Normal Working Hours” and “Weekends” in accordance with the required loaded rates per the CBA for any work performed by an employee after hours or on weekends?

A : If the CO or designee authorizes this type of work to be accomplished after hours or on weekends the CO or designee may authorize the hours could be used from the 734 hrs identified in the blue paragraph C.23.3 and blue paragraph C.35.1.

Q : (Ref. C.33) Please clarify whether GSA will reimburse the Contractor for routine work which must be performed “outside of normal working hours” in accordance with the required loaded rates per the CBA for any work performed by an employee after hours or on weekends?

A : If the CO or designee authorizes this type of work to be accomplished after hours or on weekends the CO or designee may authorize the hours could be used from the 734 hrs identified in blue paragraph C.23.3 and blue paragraph C.35.1

Q : (Ref. C.35.1) How many days’ notice in advance of contract date will GSA give the successful offeror to insure they adequate time to prepare a “Preventive Maintenance Schedule” since this deliverable is required “10 Days prior to Contract start date”?

A : 10 Days prior to Contract start date.

Q : (Ref. C.35.4) Please clarify that the Contractor will be allowed to apply the coefficient to LABOR for using a subcontractor to program/update software and/or conduct firmware updates or for performing “periodic backups when the Regional Office FMSP does not provide this function?

A : If costs are associated with the update/install, software/firmware update the shared liability will apply. If there is a panel that needs to be replaced that requires new software or reprogramming the shared liability applies as well. If a software upgrade is required across the BAS system that does not require hardware replacement or an upgrade GSA is responsible for these costs. Again GSA does not pay markup on labor.

Q : (Ref. C.35.4.1.1(e)) Please clarify that GSA expects the Contractor to be responsible for any breaks in copper and fiber cabling for IP Network Communication in accordance with PBS Telecommunication Distribution and Design Guide? If so, this appears that a subcontractor will be required due to the specialized nature of this type of work….therefore will GSA allow the coefficient to be applied to all costs including LABOR that’s over the shared limit of liability?

A : GSA will only allow the coefficient to be applied to parts, material, or equipment. Again GSA does not pay markup on labor.

Q : (Ref. C.36.5) Please clarify why GSA will not allow the “shared liability threshold” to apply to “coupon racks” which GSA is requiring the Contractor to absorb this purchase and installation costs? Ex. The average costs to purchase and install the 3 systems may average $1200 per building times 4 buildings for a total cost of $4800 minus $2500 (shared liability)=$2300 which the Contractor will be responsible to absorb this cost.

A : GSA will not require installation of new coupon racks!

Q : (Ref. C.40.1) Please clarify that GSA agrees that Contractor’s are allowed to apply coefficient to the entire amount which exceeds the $2500 shared liability limit based on the following: “the cost of the subcontractors labor and material WILL be treated as a “REPAIR PART” for the purposes of calculating the repair threshold?

A : The contractor shall not apply the coefficient to labor costs. Again GSA does not pay markup on labor.

Q : (Ref. C.40.2) Please clarify why “no labor cost” is allowed for “specialized work which requires a “subcontractor” and is allowed per C.40.1 which all is approved by the Contracting Officer in advance?

A : If the CO or their designee approved the work to be performed by a sub-contractor to the prime contractor and the work falls under the shared liability definition, GSA does pay the labor performed by the sub-contractor. However, the O & M will not markup the labor portion of the invoice provided by the sub-contractor. The sub-contractor must separate the materials and labor on their proposal and invoice! Again, GSA will not allow the contractor to markup the labor.

Q : (Ref. C.40.5) Please clarify the conflict with C.40.3 “Reimbursable Repairs” and Contract clause 52.245-26 “Limit of Liability” which holds the Contractor liable for all costs (parts & labor) up to $2500 limit of liability threshold. A repair will consist of parts;

materials; and labor so why is labor excluded in this example and who pays for LABOR costs exceeding $2500 shared liability threshold?

A : No conflict found. Section C.40.5 is an example of how the shared liability is applied. C.40.3 is the definition of Reimbursable Repairs which answers this question. The shared liability doesn’t get applied until the parts or materials exceed ($2,500 base price of materials before your mark-up is applied) (not including labor). GSA pays costs above the $2,500 (Reminder GSA will not allow the contractor to markup the labor).

Q (Part 1) : (Ref. C.40.8) Please clarify that a repair estimate ordered by GSA from an outside source if it includes “Parts and Materials” only or does it include “Parts;

Materials; and Labor”?

A (Part 1) : All cost proposals shall include labor hours, labor rates, and cost of parts and materials. All sections must be broken out by material, parts, and labor cost.

Q (Part 2) :Lastly, please confirm that if “Labor” is included in the Governments repair cost from an outside source that the Government will only be deducting $2500 ONLY from “Parts and Materials” and not the total cost from their source which normally will include costs for part; materials; and labor?

A (Part 2) : All cost proposals shall include labor hours, labor rates, and cost of parts and materials. All sections must be broken out by material, parts, and labor cost. It becomes a shared liability when the parts and materials exceed ($2,500 O&M cost price of materials before your mark-up is applied) (not including labor).

Q : (Ref. C.41.16.3(b)) Please provide the contact details i.e. email address POC within “USDA” which the Contractor is required to submit its monthly cost?

A : Yes.

Q : (Ref. H.18.6) Please clarify what guidance takes precedence i.e. C.40.1 allows “labor” to be added to materials for purposes of calculating the repair threshold but H.18.6 states markup of the coefficient in price schedule applies to parts and material only and not labor?

A : Yes (Reminder GSA will not allow the contractor to markup the labor).
