About this file

This document is a Question and Answer (Q&A) document related to RFP 47PB0024R0033 for Construction Manager as Constructor (CMc) Services for the Land Port Of Entry (LPOE) in Highgate Springs, Vermont. The key details include:

The RFP seeks CMc services to construct a new LPOE facility to handle increased traffic volume due to the completion of Canada's Autoroute A35 project. The project is targeted to achieve LEED Gold and SITES Silver certifications. The Q&A addresses topics such as equivalent sustainability certifications, submission of RFIs, escalating project costs to meet thresholds, defining "similar" projects, staffing plan requirements, and availability of additional RFP documents. The RFP uses a two-step, best-value trade-off source selection process, with the combined weight of non-price factors being greater than price. The estimated construction cost range is $110-$130 million, with a planned award for design services in August 2024 and construction services in Spring 2026. The RFP also seeks expressions of interest from suppliers of low embodied carbon materials to support the Inflation Reduction Act requirements.

Question # Question Date Received Respond To Q&A

Document Date

Response

1 For the above referenced solicitation, Section II.C, Technical Proposal, identifies “similar” projects and includes LEED Certification as one of the defining criteria.

Would GBI Certification for the High Performance Sustainable Building for Federal Buildings, Green Globes, or Florida Green Building Council Certifications be considered equivalent to LEED Certification and meet this requirement?

04/03/2024 All Potential Offerors 04/26/2024 LEED equivalent certifications include GBI Green Globes and other international or national point-based third party sustainability certifications. Projects that have achieved an equivalent certification will be considered "similar" for the purpose of this technical evaluation factor.

2 During last Wednesday’s pre-proposal conference, you mentioned responding to submitted RFIs after April 19 (twenty days prior to the proposal due date) by way of a “Q&A document.” Will RFIs submitted prior to the April 19 date be answered sooner? We’re accustomed to receiving rolling responses to RFIs during the proposal period, and we’re concerned that if RFIs are not addressed until after April 19, it may be too late to react adequately to the RFI responses in the Phase I submission.

04/18/2024 All Potential Offerors 04/26/2024 The revised due date for Requests for Clarification or Interpretation is 05/10/24. The Government will not warrant that requests received past this date will be answered.

3 With respect to Evaluation Factor 1 and the criterion “Total Construction Costs greater than $30,000,000,” is it permissible to escalate a submitted project’s contract value to today’s dollars in order meet that threshold? In other words, will a project whose contract value may have been just below the $30,000,000 threshold at the time the project was completed be considered as meeting the requirement if its escalated value is greater than $30,000,000?

04/18/2024 All Potential Offerors 04/26/2024 If an Offeror can provide the inflation-adjusted calculation to show the current-day, equivalent contract value, GSA will consider that information. Proposal evaluations are conducted in accordance with the standards for evaluation detailed in Request for Proposal (RFP) Solicitation Section VII, Method of Award.

4 With respect to Evaluation Factor 1 and the definition of “similar” projects, will the use or function of the completed project, the client for whom the project was completed, or the type(s) of construction incorporated into the project be considered in any way when evaluating the submitted projects?

04/18/2024 All Potential Offerors 04/26/2024 GSA has defined "similar" to the best of its ability by identifying those criteria that it considers to be the most important in determining whether a submitted project is “similar” in nature to the Highgate Springs Land Port of Entry (LPOE) requirement. Additional information is provided in the standards for evaluation detailed in RFP Solicitation Section VII, Method of Award. Criteria not specifically stated in the RFP may still be considered by GSA should it be determined to be pertinent to the requirement and reasonably within the general scope of the other, listed criteria.

5 With respect to Evaluation Factor 2, Staffing Plan(s), is it required that the staffing plan include each and every role identified in the bulleted list in Evaluation Factor 3?

Further, do any of the roles in this bulleted list specifically require a dedicated team member?

04/18/2024 All Potential Offerors 04/26/2024 PLEASE SEE AMENDMENT 0001 TO THE RFP.

6 With respect to Evaluation Factor 3, we are directed to Section II.C.4 of the CMc Statement of Work to find expertise required of team members. Please provide the CMc Statement of Work; it does not appear to have been included among the documents posted.

04/18/2024 All Potential Offerors 04/26/2024 PLEASE SEE AMENDMENT 0001 TO THE RFP.

7 Section I.B of the Solicitation, item (1) F, identifies the “Highgate Springs Master Attachment List” as part of the Solicitation Documents. Please provide this Highgate Springs Master Attachment List and any of the attachments named in this document that are not already included among the posted documents.

04/18/2024 All Potential Offerors 04/26/2024 PLEASE SEE AMENDMENT 0001 TO THE RFP.

8 Does applicable law or regulation provide for a process to seek a waiver of the PLA requirement? Who has authority to grant a waiver of the PLA requirement?

04/18/2024 All Potential Offerors 04/26/2024 Federal Acquisition Regulation (FAR) Subpart 22.504(d) addresses Exceptions to Project Labor Agreement (PLA) requirements.

9 During the pre-proposal conference it was noted that a successful proposer’s commitments to provide LEC materials at the levels proposed and scored in the Phase II submission would become a requirement of resultant contract. In administering the CMc’s obligation under contract, by what standard will compliance with these commitments by judged (i.e. absolute compliance, best effort, etc.)? What will be the penalty or damages assessed, if any, for any failure to meet these commitments?

04/18/2024 All Potential Offerors 04/26/2024 PLEASE SEE AMENDMENT 0001 TO THE RFP.

10 The CMc Agreement, I.H. Statement of Work, Specifications, Drawings, Exhibits, and Other Attachments, lists (3) IRA D&C Submittal: Contract Reporting Form as an attachment to the Agreement.

Please provide a copy or sample of the IRA D&C Submittal: Contract Reporting Form.

04/18/2024 All Potential Offerors 04/26/2024 PLEASE SEE AMENDMENT 0001 TO THE RFP.

11 Can the number of required “key personnel” can be reduced for the Phase 1 submission. Given the amount of time between now and the actual construction phase we feel that it would be more accurate to reflect fewer people now and then work to build out the team for secondary positions as the work actually gets closer.

04/19/2024 All Potential Offerors 04/26/2024 The due date for receipt of Phase I proposals is being extended with Amendment 0001 from 05/09/24 to 05/30/24. This should allow sufficient time to respond to Evaluation Criteria 3.
