About this file

This document is a solicitation from the General Services Administration (GSA) for Construction Manager as Constructor (CMc) services to construct a new Land Port of Entry (LPOE) at Highgate Springs, Vermont.

The solicitation is a two-step, advisory multi-step process under FAR Subpart 15.202. Offerors will first submit a Phase I technical proposal, and an advisory shortlist will be developed. All offerors will then be notified whether they were included on the shortlist. Shortlisted offerors will then submit a Phase II proposal including technical and price components. The anticipated award is for design phase services, with options for construction phase services at a later date. The estimated total construction cost range is $110-130 million.

The new LPOE will have expanded capacity to accommodate increased traffic volume expected from the completion of Canada's Autoroute A35 project. The work is to be performed in compliance with various sustainability and green building requirements, including achieving LEED Gold and SITES Silver certification. The solicitation also seeks suppliers and manufacturers of low embodied carbon construction materials such as asphalt, concrete, glass, and steel to participate in the project.

Upon the conclusion of the government’s review of Phase I Technical Proposals, an Advisory Shortlist shall be developed, and offerors will be notified as to whether their firm was included on or excluded from the advisory shortlist. It shall be noted that exclusion from the advisory shortlist shall not preclude offerors from submitting a Phase II Proposal. Thereafter, a Phase II solicitation will be issued around April/May 2024. Offerors shall respond to the Phase II solicitation by submitting a Phase II Technical Proposal and a Phase II Price Proposal as described herein. The government anticipates conducting two pre-proposal conferences, one prior to the submission of Phase I Technical Proposals and the other in conjunction with a site visit prior to the submission of Phase II Technical and Price Proposals, in Highgate Springs, VT.

Important Note: The Phase II solicitation requirements contained herein are for informational purposes only and are subject to change with the Phase II solicitation.

Examples include, but are not limited to, the sustainability requirements and pricing structure.

Notice of Equal Employment Opportunity (EEO) Compliance Plan

GSA has partnered with the Department of Labor to ensure compliance with equal employment opportunity requirements that apply to this project. An EEO Compliance Plan is required after the award.

Note: The Inflation Reduction Act of 2022 (IRA), Pub. L. No. 117-169, enacted in August 2022, provided GSA with significant funding for (a) measures necessary to convert facilities to high-performance green buildings, (b) acquisition and installation of construction materials and products with substantially lower levels of embodied greenhouse gas emissions, and (c) emerging and sustainable technologies. The Contract resulting from this Solicitation will be funded in part by IRA appropriations, and it contains numerous IRA-specific requirements. Requirements include, but are not limited to, requirements regarding pricing, invoicing, submittals, materials, and construction. In addition, please note that this Solicitation contains an evaluation factor favoring certain construction materials with the lowest possible levels of embodied carbon. Offerors shall carefully review this Solicitation, the Agreement, the Statement of Work, the Specifications, and the Drawings. Offerors are responsible for accurately pricing and, if successful, fully performing all Contract requirements.

Phase II Technical Proposal

The Technical Proposal shall include the information requested below for the non-price factors described in Section VII.

(5) Sustainability (15%) – Phase II

Background and Overview

This project is funded in part by Section 60503 of the Inflation Reduction Act of 2022

(IRA), which provides funding for purchase of construction materials with substantially lower levels of embodied greenhouse gas emissions.

GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for certain EPA-approved construction materials: concrete (and cement), asphalt, steel, and glass (IRA-

Eligible Materials). For each material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits), and better than industry average (Better Than Average Limit).

This Evaluation Factor calls for Offeror commitments to furnishing IRA-Eligible Materials with the lowest possible GWP values. IRA Limit commitments proposed under this evaluation factor will be incorporated into the successful offeror’s resultant contract.

Individual materials’ GWP values may be found on individual manufacturers’ environmental product declarations (EPDs). EPDs must meet the standards reflected in

Technical Acceptability and Scoring

Offerors will only meet the standard for technical acceptability under this Factor if they commit to furnish all required IRA-Eligible Materials with a GWP better (lower) than each IRA-Eligible Material’s Better Than Average Limit.

Offerors meeting the standard for technical acceptability will receive a number of Raw

Scores, one for each IRA-Eligible Material required by the Contract:

● Offerors will receive a Raw Score of 100 for each IRA-Eligible Material commitment that is better (lower) than GSA’s Top 20% Limits.

● Offerors will receive a Raw Score of 40 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Top 40% Limits.

● Offerors will receive a Raw Score of 20 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Better Than Average

Limit.

Offerors shall self-score* this Factor by filling out the table below with: the applicable

IRA Limit they commit to meet for each IRA-Eligible Material; the associated Raw

Score; and the Weighted Score.

Total Weighted Score (sum of Weighted Scores)

* The Weighted Score for each material must be rounded to the nearest hundredth decimal (i.e., two decimal places to the right of the whole number). The Total Weighted

Score (sum of Weighted Scores) must be rounded to the nearest whole number in accordance with generally accepted rounding methods (i.e., numbers 5 through 9 are rounded up to the next whole number; numbers 1 through 4 are rounded down to the next whole number).

** Required construction product assemblies (such as window assemblies) are included in IRA-Eligible Materials categories and will be bound by IRA Limit Commitments. At least 80% of the assembly’s total cost or total weight must be composed of compliant

IRA-Eligible Materials.

*** Where provision of concrete that qualifies under these GSA IRA Limits is impractical, GSA’s IRA Limits for cement may be applied to the cement being used in the concrete mix.

****If an offeror is utilizing multiple manufacturers/suppliers within one LEC material subcategory, and those materials achieve different GSA GWP limits, they shall, for evaluation purposes, self-score based on the material/product offered that has the highest GWP. (For example: within the 4,000 PSI concrete subcategory, if Offeror A's

4,000 PSI structural concrete meets GSA’s Top 40% GWP limit, and their 4,000 PSI site concrete meets GSA’s Top 20% limit, Offeror A shall use Top 40% in their scoring.)

In addition, for each IRA-Eligible Material identified in the table above, offerors shall submit EPDs listing that material’s GWP. Such EPDs must meet the standards reflected in GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements (see Compliance Documentation criteria listed for each IRA-Eligible

Material).

Note: By submitting an offer, Offerors consent to GSA sharing supplier names and the

GWP values associated with supplier materials with the successful offeror. Such information may also be disclosed publicly or used to inform other low embodied carbon procurement activities. Technical solutions, supplier pricing and supplier-offeror terms and conditions will not be shared.

(6) Small Business Participation (5%) – Phase II

Description

This factor is used to evaluate (a) the offeror’s past performance indicating the extent to which the offeror attained applicable goals for small business participation under contracts that required subcontracting plans; and (b) the offeror’s proposed approach to small business participation under this requirement.

Submittal Requirements

Offerors shall submit a Small Business Participation Plan which describes how small businesses, including Small Disadvantaged Businesses (SDB), Women-Owned Small Businesses (WOSB), Veteran-Owned Small Businesses (VOSB), Service-Disabled Veteran-Owned Small Businesses (SDVOSB) and Historically Underutilized Business Zone (HUBZone) Small Businesses, will play an active role throughout the life of this contract. Include a demonstration of your company’s commitment to small businesses under similar contracts.

This factor will evaluate:

1. The extent to which small business firms are specifically identified in the proposal,

2. The extent of commitment to use such firms (enforceable commitments are to be weighted more heavily than non-enforceable ones),

3. The complexity and variety of the work small firms are to perform, https://www.gsa.gov/system/files/Asphalt%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf https://www.gsa.gov/system/files/Concrete%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf https://www.gsa.gov/system/files/Glass%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf https://www.gsa.gov/system/files/Steel%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf

4. Past performance of the offerors in complying with requirements of the clauses at FAR 52.219-8, Utilization of Small Business Concerns, and 52.219-9 Small Business Subcontracting Plan,

5. The extent of participation of such firms in terms of the value of the total award, and

Greater weight will be given to offerors who:

• Identify specific small businesses meeting at least one socio-economic category

• Have enforceable commitments with identified small businesses

• Demonstrate corporate commitment to all types of small businesses, such as through successful partnering under similar contracts or through participation in federal agencies’ small business mentor-protege programs.

Specifically identified small businesses will be listed in the resultant contract.

II.D. Price Proposal – Phase II

(1) Contents

• Price Proposal on SF-1442 (signed) – Solicitation, Offor, and Award. The Price Proposal shall consist of the SF-1442 and the Agreement. Indicate the Total Contract Price from the completed Contract Price Form in Block 17 of the SF 1442, which must be fully executed by the Offeror.

• A completed Contract Price Form included in Section II of the Agreement.

• GSA Form 527, Contractor’s Qualification and Financial Information.

(2) Qualifications, Exclusions and Conditions

If the Offeror communicates in its proposal any qualifications, exclusions, or conditions to the proposed prices not provided for in the Contract Documents, the Contracting Officer may reject the proposal and exclude the Offeror from further discussions.

(3) Additional Proposal Requirements

GSA is required to track spending for each of the three appropriations it received under the Inflation Reduction Act of 2022 (IRA) -- for low-embodied carbon (LEC) materials, emerging and sustainable technologies, and high-performance green building measures

-- and has established “budget activities” for each of these appropriations. A contract line item number (CLIN) for each of these budget activities has been included in the

Agreement as necessary. In addition, subCLINs will be used to track spending on each of the LEC materials designated for IRA funding -- asphalt, concrete, glass, and steel.

Offerors must include separate prices for IRA work under the corresponding IRA CLINs and subCLINs.

Amounts for each IRA CLIN should reflect all expenses necessary to accomplish acquisition and installation of IRA work elements. A list of possible expenses follows below; this list is not exhaustive.

● Expenses of acquiring and transporting products and materials required for IRA-funded work to the construction site;

● Labor, general and administrative expenses, and overhead and profit reasonably attributable to installation of IRA-funded work;

● Expenses for materials, tools, riggings and equipment (including safety equipment) required to install IRA-funded work;

● Design, submittal and documentation expenses reasonably attributable to

IRA-funded work;

● Demolition and disposal expenses reasonably necessary for and attributable to IRA-funded work;

● Expenses necessary to return space to its condition preceding IRA-funded work;
