Phase I Proposals

• The Phase I submission shall be organized in precisely the order and format below. The proposal volumes shall be tabbed and organized into the following sections, with associated page limitations. Submissions that do not follow these instructions, or otherwise include documentation that is difficult to read, may result in lower ratings or may be rejected completely.

Phase I Proposals (cont.)

• Please refer to additional proposal submission, content, and format requirements in RFP Section II, Proposals;

• Please follow requirements exactly so as not to lose consideration during Government proposal evaluations;

• Standards for Government evaluation of factors are contained in RFP Section VI.F., Non-Price Factors.

Evaluation Factor 1 – Experience in Providing Design Phase Services and Construction Phase Services on Similar Projects

(30%)

This factor considers the Offeror’s experience as a firm in providing comparable Design Phase and Construction Phase Services for “similar” projects that the Offeror has completed.

• Please note “Similar Project” definition;

• Provide three (3) “similar” projects completed in the last ten (10) years in which the Offeror performed as a Construction Manager-as-Constructor, a Construction Manager-at-Risk, a Design-Builder, or a Design-Builder with Bridging;

• Current similar projects must be 100% complete to be considered relevant for this factor;

• Please note narrative requirements for this evaluation factor. Respond to every detail requested.

Evaluation Factor 2 – Management and Technical Approach (Design Phase Services and Construction Phase Services)

(20%)

This factor considers the Offeror’s project management plan which indicates the methods and means they will employ to ensure management of the project in a manner which will maximize the opportunity for successful completion that is on-time, on-budget, and within quality expectations.

The Offeror shall provide a detailed project management plan that includes the following:

• Overall approach;

• Staffing Plan;

• Quality Control Plan;

• Safety Plan;

• LEED Strategies, Green Building Process, and Recycling

Evaluation Factor 3 – Qualifications and Experience of Key Personnel (15%)

The Offeror shall identify the personnel they propose to fill the key team member positions listed below and state their roles and responsibilities on the Project. The Offeror shall provide evidence of the competency, past performance, qualifications and related experience of key team members.

• The Offeror shall provide resumes for each key team member clearly indicating their currently held position/title, proposed project position/title, education, qualifications, professional licensing, personal awards received, and work experience (including roles) over the last ten (10) years;

• Offerors shall provide a matrix chart clearly identifying the roles that key team members held on the projects submitted under Evaluation Factor 1.

Evaluation Factor 3 – Qualifications and Experience of Key Personnel (15%) (cont.)

• If the key team members did not work on any of the three projects submitted under Evaluation Factor 1, provide contact information for two references for each such individual who has thorough knowledge of the details of the individual’s performance in a similar position on a similar project;

• Team members shall include those with the expertise listed in Section II.C.4 of the CMc Statement of Work. Suggested team members are listed in the RFP.

Evaluation Factor 4 – Past Performance in Providing Design Phase Services and Construction Phase Services on Similar

Projects Provided under Factor #1 (15%)

This factor considers the Offeror’s Past Performance with regard to the projects submitted under Evaluation Factor 1, as a predictor of the Offeror’s compliance with contract requirements and overall quality of performance.

• For each of the (3) “similar” projects submitted under Evaluation Factor 1, the Offeror must submit a Past Performance Questionnaire (PPQ), completed by the applicable client. Completed PPQs should be submitted with the proposal;

• Also include performance recognition documents received within the last (6) years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

• The Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting System (CPARS), for all offeror team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror's proposal;

• While the Government may elect to consider data from a variety of sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Proposal Evaluations

• The Government will award a contract resulting from this Solicitation to the responsible Offeror whose offer conforming to the Solicitation will be the best value to the Government, Total Evaluated Price and other factors considered. In addition to Total Evaluated Price, the following non-price factors shall be used to evaluate offers:

• PHASE I:

• Experience in Providing Design Phase Services and Construction Phase

Services on Similar Projects (30%);

• Management and Technical Approach (Design Phase Services and

Construction Phase Services) (20%);

• Qualifications and Experience of Key Personnel (15%);

• Past Performance in Providing Design Phase Services and Construction Phase

Services on Similar Projects Provided under Factor 1 (15%)

Proposal Evaluations (cont.)

• PHASE II:

• Sustainability (15%);

• Small Business Participation (5%)

• In total, Non-Price Factors, when combined, are significantly more important than the Total Evaluated Price. The degree of importance of price could become greater depending upon the equality of the non-price proposals. Price becomes more controlling as the equality of competing non-price proposals becomes greater;

• The Government intends to make contract award without discussions with offerors. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. However, the Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. 20

Important Considerations for the Phase II RFP – Thinking Ahead

Phase II Requirements of Note

• Magnitude of Construction;

• Price;

• Sustainability (i.e., IRA) – NEW Requirement;

• Small Business Subcontracting Plan;

• Project Labor Agreement (PLA) – NEW Requirement;

• Cost Accounting Standards (CAS) and Open Book Accounting

Magnitude of Construction

• The estimated Total Contract Price is between $110M and $130M;

• Offerors are cautioned that price proposals exceeding this range may be determined ineligible for award based on budgetary limitations;

• This range does not include potential Inflation Reduction Act (IRA) funding (CLINS 0003 and 0004) and the construction portion of the optional Indoor Firing Range.

Price

• The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s);

• Total Evaluated Price shall be calculated using the prices indicated in the Price Proposal, using the following formula:

Highgate Pricing Sheet - Phase I Demonstration https://drive.google.com/file/d/1R594QSkcSBnnNFg3fx3rIwPApqtFXX5a/view?usp=drive_link

Sustainability Evaluation Factor (15%)

• This project is funded in part by Section 60503 of the Inflation Reduction Act of 2022 (IRA), which provides funding for purchase of construction materials with substantially lower levels of embodied greenhouse gas emissions;

• GSA’s IRA Low Embodied Carbon (LEC) asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for certain EPA-approved construction materials;

• For each material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits), and better than industry average (Better Than Average Limit).

Sustainability Evaluation Factor (cont.)

• This Evaluation Factor calls for Offeror commitments to furnishing IRA-Eligible Materials with the lowest possible GWP values. IRA Limit commitments proposed under this evaluation factor will be incorporated into the successful offeror’s resultant contract;

Sustainability Evaluation Factor (cont.)

• Offerors meeting the standard for technical acceptability will receive a number of Raw Scores, one for each IRA-Eligible Material required by the Contract:

• Offerors will receive a Raw Score of 100 for each IRA-Eligible Material commitment that is better (lower) than GSA’s Top 20% Limits;

• Offerors will receive a Raw Score of 40 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Top 40% Limits;

• Offerors will receive a Raw Score of 20 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Better Than Average Limit.

• Offerors shall self-score* this Factor by filling out the table below with: the applicable IRA Limit they commit to meet for each IRA-Eligible Material; the associated Raw Score; and the Weighted Score.

Small Business Subcontracting Plan

• A Small Business Subcontracting Plan, in accordance with FAR 52.219-9, is required to be submitted with Phase II offers. See Attachment 5 for a model plan;

• There is also a Small Business Participation non-price evaluation factor worth 5% overall. This factor is used to evaluate (a) the offeror’s past performance indicating the extent to which the offeror attained applicable goals for small business participation under contracts that required subcontracting plans; and

(b) the offeror’s proposed approach to small business participation under this requirement.

Project Labor Agreement (PLA)

• Executive Order (E.O.) 14063, Use of Project Labor Agreements for Federal Construction Projects, was issued on February 4, 2022. E.O. 14063 mandates Federal Government agencies require the use of project labor agreements (PLAs) for large-scale Federal construction projects, where the total estimated cost to the Government is $35 million or more, unless an exception applies.

• Federal Acquisition Regulation (FAR) Provision 52.222-33 Notice of Requirement for Project Labor Agreement (Jan 2024) Alternate I (Jan 2024)

• (b) The apparent successful offeror shall—

• (1) Negotiate or become a party to a project labor agreement with one or more labor organizations for the term of the resulting construction contract;

and

• (2) Require its subcontractors to become a party to the resulting project labor agreement.

Project Labor Agreement (cont.)

• Federal Acquisition Regulation (FAR) Provision 52.222-33 Notice of Requirement for Project Labor Agreement (Jan 2024) Alternate I (Jan 2024)

• (e) The apparent successful offeror shall submit to the Contracting Officer a copy of the project labor agreement prior to contract award;

• The project labor agreement reached pursuant to FAR 52.222-33 Alt I shall supersede the terms of any other collective bargaining agreement that conflict with the terms of such project labor agreement;

• If, for any reason, the apparent successful offeror fails to furnish such project labor agreement within the time stated above, the Government may, in its sole discretion, eliminate the proposal from consideration and select the next apparent successful offeror.

Cost Accounting Standards (CAS)

• The Offeror must submit certification from a Certified Public Accountant (CPA) that the Offeror’s accounting system provides for the following:

• The accounting system is in accordance with Generally Accepted Accounting

Principles (GAAP);

• There is proper segregation of direct costs and indirect costs;

• There is proper identification and accumulation of direct costs by contract.

• There is a labor time distribution system that charges direct and indirect labor appropriately.

• The GAAP Certification must be provided from the accountant directly to the Government within 10 days of submission of a proposal.

Cost Accounting Standards (CAS) (cont.)

• Large Business Offerors only – The Offeror must submit all disclosures in accordance with FAR 52.230-1, Cost Accounting Standards Notice and Certifications and FAR 52.230-7, Proposal Disclosure – Cost Accounting Practice Changes.

Requests for Clarification or Interpretation

The Government will attempt to answer all requests for clarifications or interpretations of the Solicitation Documents prior to the date set for receipt of offers, but does not warrant that all such requests will be answered if submitted less than twenty (20) calendar days from the date set for receipt of offers.

Prospective Offerors should make such requests by email to the CO Jim Adamo at james.adamo@gsa.gov and the Project Manager Cristina Clow at cristina.clow@gsa.gov, but under no circumstances less than twenty (20) calendar days prior to the date set for receipt of offers.
