About this file

Summary: Amendment 0002 to RFP 47PA0826R0001 - FY26 GSA Retail Utility Procurement Competitive Electricity Supply

This document is Amendment 0002 (effective February 18, 2026) to a Request for Proposals for competitive electricity supply services issued by the General Services Administration (GSA) through its Office of Facilities Management, Retail Utility Services Branch. The amendment updates the FY26 GSA Retail Utility Procurement solicitation by providing answers to 37 clarifying questions submitted by potential offerors, updating Attachment 3 (Economic Price Adjustment components) for PJM, NYISO, and MISO markets, updating Attachment 13 (Final Exhibit 1) with current PJM auction specifications, and providing a new guidance document titled "Tips on Preparing a Subcontracting Plan." The solicitation covers retail electricity supply for approximately 354 end-use utility accounts across 44 federal agencies in eight states across three regional transmission organizations: PJM (District of Columbia, Delaware, Pennsylvania, New Jersey, Maryland, Ohio), MISO (Midwest), and NYISO (New York).

Key contractual parameters include firm fixed pricing per kilowatt-hour for base contract terms up to 60 months, with optional extensions up to 12 additional months under market-movement adjustment provisions. Offerors must demonstrate technical acceptability through financial documentation (A or better credit rating, or recent audited financial statements from January 1, 2024 forward), current Dun & Bradstreet reports, PJM/MISO/NYISO market-specific experience (ten retail customers exceeding 1,000 kW peak demand or one customer with 15,000 kW aggregate demand), and transmission service agreements. Technical proposals are due February 26, 2026 at 3:00 p.m. EST, with pricing submissions occurring via internet auction on dates specified in the final Exhibit 1 files. Award will be made to the lowest-priced, technically acceptable offeror(s). Large businesses exceeding $900,000 contract value must submit small business subcontracting plans. The energy procurement support contractor (Enel X, Inc.) administers the auction platform, and contractors must pay $0.0007 per kWh fee directly to this support contractor.

Q&A 47PA0826R0001 FY26 Electric Solicitation

1. Will the GSA please provide the names of the installations/ agencies who will require a bill upload to a third-party site? We would appreciate any details you can share regarding these billing concerns as this will help our team provide accurate billing costs to serve and recognize ahead of award any external upload requirements.

A: GSA is coordinating with included agencies whose accounts require dual billing to collect information on their invoice submission processes including any requirements for online invoice submittal. GSA will provide the information to prospective Offerors prior to the auction dates listed in the solicitation.

2. Would you mind directing us to the section of the solicitation that defines the “Economic

Price Adjust” referenced in the Attachment 3? We have attached the Attachment 3 for your reference:

Auction Revenue Rights (ARRs) Economic Price Adjustment

Reliability Must Run (RMR) Economic Price Adjustment

FERC Order 745 and FERC 494 / EL05-121-009 Compliance Costs Economic Price Adjustment

Offshore Wind RECs (ORECs) Economic Price Adjustment

A: See Section 552.216-77 Economic Price Adjustment – Electric Supply (March 2020) in Attachments 14 and 16.

3. Attachment 13 – Price Component Table – PJM: Row 15 lists various Transmission costs that are to be handled as “Economic Price Adjustment”. Supplier is seeking clarification on two of the transmission components listed: (1) Financial Transmission Rights [FTR]: We are unclear of the intent here. Typically, an FTR is a hedge instrument purchased by the supplier to manage congestion risk associated with serving retail load. It is unclear what FTR settlement is intended to be passed through as part of transmission costs. (2) Transmission Reallocation Costs [TEAC]: Supplier is unfamiliar with this charge. Can you reference a PJM Billing Line Item?

A: See Section 552.216-77 Economic Price Adjustment – Electric Supply (March 2020) in Attachments 14.

4. Section A.1: Section A.1 has the statement: “The Contractor shall be liable for all Costs assessed to facilities arising out of or relating to the non-delivery of firm requirements.” This statement is problematic as the supplier does not deliver power. The customer receives power. Power is delivered by the local utility, and the supplier has no control over power curtailment or outages. Please explain the intent here.

A: The Contractor is required to furnish electricity to the delivery point that is sufficient to meet each facility’s full electric requirements during the term of this contract. The delivery point is defined as the solicitation is the utility. GSA understands that utilities have final responsibility to deliver the electricity the Contractor provides them on to the facilities.

5. FAR 52.212-1 (page 25): FAR 52.212-1 has the statement: “The offeror agrees to Hold the prices offered in response to this solicitation until 1:30 pm Eastern on the Auction date specified in Exhibit 1 for each auction of which the offeror submits pricing.”

In the event of an adverse market movement before notification of award, can the offeror withdraw pricing before 1:30 pm Eastern? What is the process to notify GSA of the withdrawal of pricing?

A: While GSA strongly encourages all offerors to hold their prices until 1:30 p.m. per the solicitation requirements, Offerors may withdraw bids up until a notice of award via email has been sent by GSA. Intent to withdraw bids must be provided to the Contracting Officer specified in the solicitation in writing.

6. FAR 52.212-4 (g)(2) (page 42): Indicates payment will be made 10 days after receipt of a proper invoice. Section A.7 of the solicitation indicates payment in accordance with the Prompt Payment Act – which is 30 days. Which are the correct payment terms?

A: GSA requirements for dual billing will be in accordance with the prompt payment act - 30 days. All requests for utility consolidated or single billing will be in accordance with utility requirements.

7. Given the large size of the load behind PJM, will GSA consider staggering the auction dates for the various pricing groups (when available) in PJM rather than bidding the entire PJM load on a single day.

A: No.

8. Is GSA currently aware of any future closing, sale or non-renewal of a lease agreement of any buildings that are on this RFP?

A: No. Any such changes will be handled consistent with the specific circumstances and in accordance with the terms of the contract.

9. Can you please confirm that any closing, sale or non-renewal of a lease agreement of any buildings will be subject to damages per the Termination for Convenience clause?

A: See answer to Question 8.

10.Do any of the facilities in this RFP have existing or planned behind-the-meter generation, including but not limited to, cogeneration, solar, wind, fuel cell, etc.? If so, can you please provide as many details as possible including installation date, fuel type, historic output, intended future output, etc.?

A: Behind the meter generation projects that GSA is aware of are noted in the Exhibit 1 file.

11. Is GSA aware of any other significant changes to their current load?

A: Any projects or load change expectations that GSA is aware of are noted in the Exhibit 1 file.

12.Contractor requests the right to withdraw its price(s) at any time prior to bid being awarded.

A: Offerors may withdraw bids up until a notice of award via email has been sent by GSA. Intent to withdraw bids must be provided to the Contracting Officer specified in the solicitation in writing.

13.Contractor requests the right to supplement or amend any of the questions, clarifications, by the due dates stipulated for general questions or for account questions.

A: GSA will provide additional details when they become available. If a clarifying question or response necessitates a formal change, it will be issued and posted as an official amendment. Please review future amendment postings for any schedule changes.

14.Has the Government installed (within past 24 months), is currently installing, or has plans to install, any behind the meter generation, at any of the facilities, that will reduce the Contractors serviceable load? If so, can the Government provide the size of generation (kW), fuel type, purpose (backup, peak shaving, base load), and the in-service date? This has often been noted in the various Exhibit 1s historically.

A: See answer to Question #10.

15.Regarding A.12. Please verify that the Renewable Energy being requested in this section is equivalent to RECs.

A: Yes. If required, Renewable Energy requirements will be posted in Attachment 13: Final Exhibit 1 for each auction. If applicable, a contractor will be required to deliver RECs in accordance with Section A.12.

16.Regarding A.14 and 52.212.4: Is each cap on after-imposed charges and taxes on a by occurrence basis, or collectively for all such changes during the term?

A: The cap for after imposed charges as a result of approved change in law is at the contract level based on collective or cumulative occurrences.

17.Section “A.14 ELECTRICITY REGULATORY CHANGES”, states: “The ceiling price for after-imposed regulatory costs is limited to 50% of the contract price.”. Contractor has experienced some very large changes recently with various market rules changing. While many of these items are currently passed through, these can be unforeseen and very large.

Contractor requests GSA accept the industry practice in which case the customer is responsible for all after imposed regulatory costs, and which is equitable in light of the Government receiving all after- relieved charges.

A: No. Please refer to Section A.14 ELECTRICITY REGULATORY CHANGES and review the final paragraph in its entirety for further clarification.

18.For pricing for all Ohio service accounts, transmission and transmission-related costs/ancillaries are billed by the utility and won’t be included in our pricing.

A: Noted.

19.Please confirm that no Maryland accounts with a residential rate class will be included.

A: Confirmed.

20.Please confirm that costs associated with orders issued by the Department of Energy under

Section 202(c) of the Federal Power Act are to be passed through in all applicable ISOs.

These costs are new, highly variable, unpredictable in nature, and inconsistently charged between ISOs (i.e. not always PLC or NSPLC or kWh based in each territory).

A: Confirmed. See updated Attachment 3 in Amendment 0002 for cost treatment.

21.If an agency fails to renew or fund an account-level task order during the term of the base contract as specified in the last paragraph of Section A.7, will the supplier be able to charge for a full early termination even if the reduction in load does not exceed the 20% bandwidth threshold provided in Section A.13? If not, will such termination be factored into the bandwidth going forward?

A: Yes. The account will have to be terminated at the base contract level in advance before termination discussions can begin. Please reference Attachments 14 through 16 Termination for Government’s Convenience.

22.Contractor has experienced significant delays in Delivery Orders, often coming well after the contracted period of performance. Please confirm that the Contractor is to continue to serve each account as outlined in the base IDV unless there is some other formal modification issued by the GSA Contracting Officer.

A: Confirmed. The Contractor shall continue to serve each account as outlined in the base IDV unless there is some other formal modification issued by the GSA Contracting Officer. Contact GSA if the agency has not issued a funding order.

23.The generation and supply of retail electric power does not offer opportunities for participation from subcontractors under contracts with its customers. Suppliers either produce the power directly through our own generating facilities or obtain it via large-scale commodities trading and have no ability to track where specific units of power come from for purposes of servicing our customer contracts. Accordingly, we do not have the ability to include subcontractors in the generation and supply of electric power under this proposal, including small business subcontractors.

A: See ATTACHMENT 5: COMMERCIAL AND INDIVIDUAL MODEL SUBCONTRACTING PLANS and Tips on Preparing a Subcontracting Plan.

24.Section A.7 Payment and Billing states: “Each invoice shall include itemized charges levied by the utility.”. Can the Government confirm that Dual billed invoices, issued by the Contractor, do not need to include utility delivery charges?

25.Can the Government confirm that any extension has to be mutually agreed upon by both parties? The current language seems to be absent the requirement for the Contractor to agree to provide an extension price and confirm that any presented price remains valid for an executable extension transaction.

A: Confirmed. Any extension request shall be bilateral and mutually agreed upon by both parties.

26.While there isn’t a transaction yet, and there appears to be a chance to ask questions on each region once a final accounts list is released, Contractor has provided several questions for the NYISO piece now:

a. Can the Government confirm that the contract price cannot be changed due to annual changes in ICAP tags?

b. Attachment 3 - PRICE COMPONENT CONFIRMATION TABLE for NYISO includes “Fuel Costs” as a Price Component. Can the Government provide additional detail regarding what this component refers to?

A: See updated Attachment 3 under amendment 0002.

c. Attachment 3 - PRICE COMPONENT CONFIRMATION TABLE for NYISO, in column B “Treatment”, includes both (i) Economic Price Adjustment and (ii) Pass Through At Cost. Can the Government confirm that these terms are interchangeable and both should be treated as: “…passed through with no markup to the Government.”

d. Attachment 3 - PRICE COMPONENT CONFIRMATION TABLE for NYISO lists:

“…New York Renewable Portfolio Standards (RPS), Renewable Energy Standards (RES), Clean Energy Standards (CES)…”. Can the Government confirm that the following costs will be passed through to the Government without mark-up:

i. TIER 1

ii. TIER 4.

e. Attachment 3 - PRICE COMPONENT CONFIRMATION TABLE for NYISO does not list the transmission costs associated with the Climate Leadership and Community Protection Act (CLCPA) Facilities Charges (CFC). Can the Government confirm that CFC costs are to be passed through to the Government without mark-up?

f. Can the Government confirm that the following components do not currently have costs associated with them but have been approved, and if costs begin within the term of the award, Contractor may pass through to the Government without mark-up.

i. i. Offshore Wind RECs (OREC) – NY Public Service Commission approved cost obligation, expected to begin in 2027

ii. ii. Bulk Energy Storage (BES) – NY Public Service Commission approved cost obligation, expected to begin in 2027

27.Section A.8 Extension Provisions states: “…Energy Commodity Costs line item in Attachment 3 - Price Component Confirmation Tables included in this original auction price under the awarded contract.” Please confirm that costs for line losses should also be included as line losses are an energy commodity.

A: Energy Commodity cost under Section A.8 is in reference to the monthly around the clock zonal settlement price. All other fixed items including line losses are not included in the extension calculation.

28.Conservative Operations. During winter of 2025 and 2026, PJM implemented “Conservative operations” resulting in significant ancillary costs. Is the GSA agreeable to costs associated with Conservative Operations being passed through as an adjustment in exchange for lower fixed ancillary prices? Conservative Operations are defined as follows: "Conservative Operations can be declared when the PJM RTO (or a portion of the RTO) is undergoing, or has the potential to face, adverse impacts from weather, environmental, physical or cyber security events and requires enhanced RTO reliability efforts. The declaration of Conservative Operations may include additional actions, including recalling/cancelling non-critical maintenance outages, reductions in transfers into, across or through the PJM RTO, increased reserves, and/or additional requests placed upon PJM member TOs and GOs."

A:All Ancillaries including costs to conservative operations are to be fixed per the attachment 3.

29.While the RFP mentions the prompt payment act for 30-day payment, it also references that bills will be paid 10 days after receipt. For dual billed sites, can the GSA confirm the payment terms required for the RFP?

A: See Answer #6.

30.Regarding the Interest Clause: Item 6 – Interest (Page 28 of the solicitation): Respective of the answer to address dual billed payment terms, can the GSA amend the language to state that any overpayment or credits incurred would be applied to the next invoice’s open balance?

A: At agency’s discretion

31.Is usage invoiced for the quantity at the meter, or is usage grossed up by the applicable loss factor? Additionally, is the same methodology applied to all non-demand billing line items?

A: All usage is to be invoice for the quantity at the meter and would be applied to all non demand billing line items. Line losses are to be billed as a separate line item per the Attachment 3.

32.Regarding the ability to extend 12 months, will the GSA include any change in law events into the contract price for the evaluation for the ability to extend for the adjusted market movement comparison?

A: All executed modifications that result in a change in contract price throughout the full term of the base agreement will be included in all extension offers.

33.Can the GSA please provide supplemental information regarding the future operations of the

AOC cogeneration facility over the expected term of the contract (i.e., a monthly operational projection)?

A: All account information including projections of future operations and usage expectations will be included in the Final Attachment 13 Exhibit 1.

34.As the operations for WMATA are uniquely different than the remainder of the sites being solicited, can the GSA separate the WMATA accounts to their own bid group as done in the prior solicitation?

A: Any changes to accounts or bids groups will be posted in the Final Attachment 13 Exhibit 1.

35.Could the GSA confirm/clarify the intended treatment of Bulk Energy Storage costs in

NYISO? This is a new component as of January 2026. This was introduced as a $0/MWh cost, but this amount will likely change in future years. Will these changes be viewed as a change in law to modify the charge over the contract term similar to other CES costs?

36.In NYISO, beginning in 2027, there will be another new CES component under the CDG H-Value Order. While it is known to occur, values are unknown. Can the GSA confirm the language associated with change in law would qualify for this order as the value becomes known in the future?

A: Any future regulatory change to CES costs as a result of a newly implemented charge or unforeseen event would be handled as a regulatory change under Section A.14.

37.The following accounts were rejected as active accounts. Please confirm the replacement accounts for the sites listed below:

A: All questions regarding specific accounts and account data will be addressed during the Pre-Proposal Calls. Those calls will take place after the final Exhibit 1 files have been released for each ISO/RTO. See Attachment 12 - Pre-Proposal Call Schedule for the specific dates.

FY26 GSA RETAIL UTILITY PROCUREMENT COMPETITIVE ELECTRICITY SUPPLY

SECTION A: SCOPE OF WORK

A.1 GENERAL

The U.S. General Services Administration (GSA or Government) is requesting proposals for the supply of all electricity supply commodity components up to the Delivery Points as specified in Attachment 13:

Preliminary Exhibit 1 of this solicitation. The Delivery Point for such electricity shall be the independent system operator (ISO)/utility interconnect for the specific facilities identified in Attachment 13:

Preliminary Exhibit 1 of this Solicitation. The Local Distribution Utility (LDU) (hereafter referred to as “Utility”) will then distribute the electricity to the Government’s individual meters. Pricing is to the Delivery Point and shall include all cost components specified in Attachment 3: Price Component Confirmation Tables of this solicitation. The Contractor shall supply the full requirements of such electricity for a term of up to sixty (60) months for the full monthly billing cycles. In the final Exhibit 1 files, the Government will place its requirements into pricing groups, as indicated in Attachment 13:

Preliminary Exhibit 1. The service start date for all accounts shall begin with the first utility meter read date as specified by the utilities for the contract month specified in Attachment 13: Preliminary Exhibit

1. Multiple awards are contemplated for this solicitation. Contracts may be awarded at different times throughout the fiscal year as specified in Attachment 13: Preliminary Exhibit 1. Note the preliminary auction dates may be updated by GSA. Notice will be provided to Offerors who are deemed technically acceptable by GSA for each auction.

All quantities required to be supplied to facilities included in this contract shall be considered firm requirements (“firm” means electric supply that shall not be interrupted except as permitted under this contract) for delivery by the Contractor to the Delivery Point. The Contractor shall be liable for all costs assessed to facilities arising out of or relating to the non-delivery of firm requirements. The electricity provided under this contract shall conform to the tariff of the interstate/intrastate transmitting utility at the Delivery Point.

A.2 DEFINITIONS

For purposes of this contract, the following definitions apply to the contract and its attachments:

Balancing Authority: Also known as Control Area, is an electric power system or combination of electric power systems bounded by interconnection metering and telemetry to which a common generation control scheme is applied. For example, the Pennsylvania-New Jersey-Maryland Interconnection (PJM)) operates as one Balancing Authority.

Delivery Point: The Delivery Point for each account is specified in the final Exhibit 1 files.

Governing Applicable State Regulatory Entity: The board, agency, division, commission or other unit or subunit which has the general power to regulate and supervise the business of each public utility within its jurisdiction.

FY26 GSA RETAIL UTILITY PROCUREMENT COMPETITIVE ELECTRICITY SUPPLY

Kilowatt Hour or kWh: means 1000-watt hours and represents one kilowatt of power expended for one hour of time.

Local Distribution Utility (LDU): a company that distributes electricity to end users.

Locational Marginal Price (LMP): is defined as the marginal price for energy at the location where the energy is delivered or received. For accounting purposes, LMP is expressed in dollars per megawatt-hour ($/MWh).

Megawatt or MW: means a unit for measuring power that is equivalent to one million watts (equivalent to one joule per second).

Renewable Energy Certificate or REC: means the technology and environmental (non-energy) attributes that represent proof that 1 megawatt-hour (MWh) of electricity was generated from an eligible renewable energy resource, and can be sold separately from the underlying generic electricity with which it is associated. (Sec. VII of M-22-06). These are unique certificates that represent all the environmental attributes or benefits of a specific quantity of renewable generation. RECs are created when a renewable energy facility generates electricity.

Renewable Energy: means marine energy (as defined in 42 U.S.C. 17211), or electric energy produced from solar, wind, biomass, landfill gas, geothermal, municipal solid waste, or new hydroelectric generation capacity achieved from increased efficiency or additions of new capacity at an existing hydroelectric project. Renewable Energy and biomass shall have the definitions as specified by the Energy Policy Act of 2005, currently codified at 42 U.S.C. 15852(b)(2).

A.3 NOMINATING AND BALANCING RESPONSIBILITIES

It is the Contractor’s responsibility to conduct all required nominations on behalf of the facilities specified in the final Exhibit 1 files. The Contractor shall be fully familiar with the imbalance, transmission grid loss and line loss policies of both the utility and the interstate/intrastate transmission companies. The Contractor shall be liable for all costs arising out of or relating to these items.

A.4 CREDIT FOR DEFAULT SUPPLY SERVICE

If at any time, unless as a result of an Excusable Delay (see FAR 52.212-4(f)), an account covered by this contract is forced to accept default supply service from the utility serving in its capacity as the utility supplier of last resort or is forced to switch to the a Non-volunteer Provider of Last Resort solely as a result of action/inaction by the Contractor, the Contractor shall be responsible for payment of any additional costs incurred.

A.5 RISK OF LOSS

Risk of loss of electricity supplied under this contract shall remain with the Contractor prior to the Delivery Point and shall pass to the Government at and after the Delivery Point specified for each facility.

FY26 GSA RETAIL UTILITY PROCUREMENT COMPETITIVE ELECTRICITY SUPPLY

A.6 PROTECTION OF CONTRACT INFORMATION

The Government shall take the necessary and usual steps to maintain the confidentiality of information submitted by offerors prior to award of the contract. The Contractor is advised that the Government shall make all contract prices publicly available for the full contract period.

A.7 PAYMENT AND BILLING

The Contractor expressly agrees and acknowledges that each government agency to which supplies or services are provided pursuant to this contract shall be separately responsible for and liable to pay for any such supplies or services. For the avoidance of doubt, GSA shall be the responsible party for purposes of making payments for the accounts only where GSA is listed as the Agency in the final Exhibit 1 files.

The final Exhibit 1 will specify which accounts require dual billing and which require consolidated billing through the applicable utility.

For dual billed accounts, the Contractor shall submit a monthly invoice to the government agency for supplies and services rendered the previous month. The invoice should include the amount of kWhs measured at each meter and shall be consistent with the rules of the responsible state regulatory entity regarding issuance and format of bills. The Contractor shall use the utilities meters, meter readings, and billing cycles for the computation of bills. The Contractor shall establish a unique supplier account number for each end-use Government account and provide the corresponding utility account number on each monthly bill. The Contractor also expressly agrees and acknowledges they shall be required to submit invoices in accordance with each end use agency’s billing requirements and systems which can include requirements for invoices to be submitted through online systems.

It shall be the Contractor’s responsibility to know and understand the specific details and requirements for monthly billing, reporting, and coordination with the utilities. Payment shall be in accordance with FAR 32.9 (Prompt Payment). If payment is to be made by electronic funds transfer, the provisions of FAR 32.11 (ELECTRONIC FUNDS TRANSFER), including the clause at 52.232-33 shall apply. The Contractor shall be responsible for any late charges and/or penalties associated with prompt payment requirements that may be required by internal procedures and/or controls of the utility. The Government requires that each bill contain itemized account level detail on a building or facility basis. Each invoice shall include itemized charges levied by the utility.

Contractor’s invoices shall match the company name and payment information for the Contractor in SAM.gov Unique Entity ID, Tax Identification Number and Cage Code specified in Attachment 2:

Contractor Information.

For consolidated billing accounts, the Government shall pay the Contractor through monthly utility bills rendered by the applicable utility for each account included in this contract in accordance with the utilities’ billing procedures, which are fully regulated by applicable state regulatory authority. It shall be

the Contractor’s responsibility to understand the specific details regarding the utilities’ requirements for consolidated billing.

Each customer agency utilizing this base utility supply contract vehicle may have unique fund obligation and account-level task order processes. Regardless of what is stated in these agency account-level task orders, the base IDV contract awards the estimated volumes to the supplier for the full term of the base contract, subject to the band range referenced in Section A.13 LOAD CHANGES DURING THE TERM OF THE CONTRACT. If an agency fails to renew or fund an account-level task order during the term of the base contract, it will be treated as an early termination pursuant to the methodology provided for each ISO/RTO in Attachments 14 through16, Tailored Addendum To FAR 52.212-4(I) - Termination for the Government’s Convenience.

A.8 EXTENSION PROVISIONS

The Government may request extension of performance, one or more times, in accordance with the existing contract terms and conditions, so long as the total additional performance period does not exceed twelve (12) months.

Pricing for the extension term will be in accordance with market movement comparing market prices on the day of contract award with settle prices for the previous trading day to the day the Government requests a contract extension.

For purposes of this solicitation, the comparison will be based on applicable pricing zones’ Around the Clock (ATC) settle prices and term awarded for each pricing group on the day of the auction and settle prices for the previous trading day to the day an extension price is requested by the Government for the same pricing group or groups. The applicable pricing zone for each included account will be included in the final Exhibit 1 file.

The auction day settle prices and Government settle price extension requests by volume and at the time of extension request will be load-weighted with the applicable pricing zones’ monthly contract volumes included in the final Exhibit 1 for each pricing group. The Government will provide a copy of the ATC settle prices and monthly volumes for each pricing group in the fully executed contract.

Pricing for the extension term shall be determined by calculating the percentage difference between the load-weighted auction day settlement price and settlement prices for the previous day to the day an extension price is requested and applying that percentage difference to the Energy Commodity Costs line item in Attachment 3 - Price Component Confirmation Tables included in this original auction price under the awarded contract. All other Price Components that are listed as Treatment “Fixed” and Include in Offer Price “Yes” in Attachment 3 will not be included in the calculation. Any Price Components listed as “No” under Include in Offer Price will also not be included in the calculation.

If the Contractor declines to extend, the contract will expire with the current performance period for the associated pricing group(s).

RFP 47PA0826R0001 GENERAL SERVICES ADMINISTRATION

FY26 GSA RETAIL UTILITY PROCUREMENT COMPETITIVE ELECTRICITY SUPPLY

Notice of request for extension will be furnished to the Contractor not later than thirty (30) days prior to the expiration of the contract or any extension thereof. However, nothing precludes the Contractor from agreeing to an extension of the contract if the Government fails to issue the notice prior to the thirty (30) days.

Notice of request for extension of this contract shall be considered to have been accomplished at the time the Government sends notice via email to the Contractor.

A.9 RESERVED

A.10 ADDING AND DELETING FACILITIES TO THIS CONTRACT

It is possible that additional accounts not included in the final Exhibit 1 files may be added to the resultant contract(s). In that event, the Government shall provide the Contractor with the facility’s estimated electric requirement (if available) and the two parties shall enter into good faith negotiations to determine a price. A bilateral modification shall be executed adding the line item on the Standard Form 30, Amendment of Solicitation/Modification of Award.

The Government may unilaterally remove any facilities at its discretion. If the Government removes any facilities listed in the final Exhibit 1 files, the Government shall provide the Contractor with a written notice 45 business days before any such removal. If accounts are removed, the methodology provided for each ISO/RTO in Attachments 14 through16, Tailored Addendum To FAR 52.212-4(I) - Termination for the Government’s Convenience shall be used to calculate the early termination charges, if any. The provisions of this paragraph shall not apply to accounts with early end dates noted in the final Exhibit 1 files at the time of contract award(s).

A.11 ANNUAL USAGE ATTESTATION REPORTING

Annual Usage Attestation Report: No later than October 31st of each contract year, the Contractor shall complete and submit Attachment 17 - Annual Usage Attestation Report which shall affirm the kWh volume of electricity delivered under this Contract, to both the Contracting Officer (CO) and Contract Specialist (CS) at the email addresses specified in Section A.15. The annual reporting period shall be October 1 through September 30. While the annual report is due to GSA no later than October 31st each year; if needed, the Contractor may update the report no later than December 1st each year.

The Contractor must state in the email where they submit their report as to whether the report is final or if an updated report will be provided to GSA.

A.12 RENEWABLE POWER FOR FACILITIES IN THIS CONTRACT

Renewable Energy may not be required for every contract awarded under this solicitation. The final Exhibit 1 files will indicate for which accounts the Contractor is responsible for providing Renewable Energy and in what amounts. Contractors are required to review the final Exhibit 1 files and include Renewable Energy in their offer, if applicable. Where applicable, the Contractor shall deliver RECs derived from Renewable Energy as defined above equal to the percentage of total usage required for all accounts included as indicated in the final Exhibit I files. The Renewable Energy requirement is load-following, and the number of RECs delivered will be based on actual usage for each account. The

REC content requirements are in addition to any Renewable Energy required to comply with the State’s Renewable Portfolio Standards (RPS) requirements, if any, during the term of any resultant contract(s).

The Renewable Energy that the Contractor provides must come from renewable resources that have been placed in service within ten (10) years prior to the start of the Government’s fiscal year for each year of the contract. For the contract’s first year, resources will need to have been placed in service on or after October 1, 2016.

Annual Renewable Attestation Report: No later than October 31st of each contract year, the Contractor shall complete and submit the Annual Renewable Attestation Report (Attachments 7 through 11), which shall affirm delivery of Renewable Energy required by this Contract, to both the Contracting Officer (CO) and Contract Specialist (CS) at the email addresses specified in Section A.15. The annual reporting period shall be October 1 through September 30. While the annual report is due to GSA no later than October 31st each year; if needed, the Contractor may update the report no later than December 1st each year. Contractor must state in the email where they submit their report as to whether the report is final or if an updated report will be provided to GSA.

Renewable Energy Vintage: To qualify as an eligible REC under this contract, the Renewable Energy must be generated during the Government’s applicable fiscal year calendar which is October 1 through September 30 for each year of the contract and the six (6) months immediately preceding that time period and the three (3) months immediately following that time period (e.g., April 1, 2025 through December 31, 2026 for fiscal year 2026).

Renewable Cost Breakdown: Upon contract award(s), the offeror shall be able to provide a breakdown, showing what portion of their price (on a $/KWh basis) is attributable to the renewable requirements.

A.13 LOAD CHANGES DURING THE TERM OF THE CONTRACT

As indicated in Section A.1, this contract is for the full requirements of each account at the Delivery Points. The full requirements are expressed as estimates in the final Exhibit 1 files of the solicitation.

The Government does not estimate that its aggregate load will change in a significant manner throughout the term of this contract unless noted in the final Exhibit 1 files. An annual change in the aggregate kWh consumption of each pricing group in excess of twenty percent (20%) each contract year shall be considered significant. The historical volumes are given in the final Exhibit 1 files, and these volumes will be used in determining annual changes.
