About this file
This is a GDSN Registration Agreement form from the Cobb County School District Procurement Services Department in Marietta, Georgia, related to RFP P26041 for FNS Commodity Processing. The Cobb County School District is soliciting qualified vendors to process USDA Commodity Foods into usable end products for the National School Lunch and School Breakfast Programs, with processed food products to be shipped to authorized CCSD Food Distributors through a Value Pass-Through System or delivered directly to the CCSD Food and Nutrition Services Warehouse located at 6975 Cobb International Boulevard in Kennesaw, Georgia. The estimated annual expenditures for this contract are approximately $3,500,000. The agreement incorporates Global Data Synchronization Network (GDSN) standards and protocols into the procurement process.
Vendors are required to provide Global Trade Identification Numbers (GTIN) for all brand name products in their bid responses if available, and must independently verify that GTINs and specifications have been published for any equivalent products prior to the solicitation closing date. For single-ingredient foods such as fresh produce or raw meats, vendors must provide a Universal Product Code (UPC) if available and these items are held to FDA and USDA Standards of Identity rather than GDSN registration requirements. The Purchaser reserves the right to require vendors to deliver product samples within a specified timeframe to facilitate taste testing prior to final award decisions. Upon notification of award, vendors must confirm that all offered brand name products include the Global Trade Identification Number (GTIN) and the GDSN Registration Agreement form must be completed and returned with the RFP response.

GDSN Registration Agreement (This form must be completed and returned with RFP response)
RFP P26041, FNS Commodity Processing - NOI
1. GDSN Standards for Branded Products and Equivalents The Purchaser has incorporated the standards and protocols of the Global Data Synchronization Network® (GDSN®) into this procurement. For branded products, the Purchaser may identify recommended and preferred products by their Global Trade Item Number® (GTIN), which by reference allows the bidding vendor to bid the exact specified product or offer an equal/comparable product.
2. Equivalent Products Per CFR Title 2 Chapter 2, Part 200 Subpart D Competition, procurement transactions must “Incorporate a clear and accurate description of the technical requirements for the material, product, or service to be procured. Such description must not, in competitive procurements, contain features which unduly restrict competition. The description may include a statement of the qualitative nature of the material, product, or service to be procured and, when necessary, must set forth those minimum essential characteristics and standards to which it must conform if it is to satisfy its intended use. Detailed product specifications should be avoided if possible. When it is impractical or uneconomical to make a clear and accurate description of the technical requirements, a “brand name or equivalent” description may be used to define the performance or other salient requirements of procurement.” (CFR 200.319)
3. Instructions for Vendors It is the responsibility of the Vendor to independently verify that GTIN’s, and specifications/attributes have been published for any equivalent products prior to the closing date and time of this solicitation. The Purchaser will evaluate and approve or reject alternative products. At the Purchaser's discretion, Vendors may be required to deliver product samples within a timeframe to facilitate taste testing prior to final award decisions.
4. Standards for Food Product Specifications as defined by FDA and USDA Regulations governing common names and quality indicators may be referenced by their Standard of Identity and/or common use product name. These standards are set forth in FDA regulations and/or USDA Agricultural Market Service (AMS) regulations for Standards and Grading, both of which include detailed product specifications.
5. Vendor Product Registration The Purchaser requires vendors to provide GTIN’s (Global Trade Identification Numbers) in the bid response for all brand name products if available. Single-ingredient foods such as fresh produce or raw meats will be held to the FDA and USDA Standards of Identity and are not required to be https://www.gs1.org/home https://www.gs1.org/home https://www.gs1.org/standards/id-keys/gtin https://www.ecfr.gov/current/title-2/subtitle-A/chapter-II/part-200/subpart-D/subject-group-ECFR45ddd4419ad436d/section-200.319
