About this file
This is a Criminal History Screening Practices Certification form required by Broward County, Florida for vendors seeking contracts valued at $100,000 or more. The form implements Section 26-125(d) of the Broward County Code of Ordinances and applies to the Taxilane ADG III Westside construction project at Fort Lauderdale-Hollywood International Airport. The project scope includes comprehensive airfield construction work encompassing pavement demolition, installation of new asphalt pavement, vehicle service road construction, water main installation, security fencing, stormwater drainage systems, taxiway edge lighting, airfield guidance signage, drainage canal regrading, and landscaping. Vendors must submit the completed certification form with their solicitation response through BPRO and receive a submission receipt, with the form required either at time of submittal or within three business days of the County's request.
The certification requires vendors to implement or commit to implementing policies and procedures that prohibit inquiry into an applicant's criminal history until after an applicant has been selected as a finalist and interviewed for a position, applicable only to U.S.-based positions performing work on the Broward County contract. Vendors may claim exemption if required by federal, state, or local law to conduct criminal background checks at an earlier stage or if the vendor is a governmental agency. Non-compliance with this requirement constitutes material breach and may result in contract termination, debarment proceedings, or suspension. The form must be signed and dated by an authorized vendor representative and submitted as part of the solicitation response. Additional solicitation requirements include county and state licensing, Disadvantaged Business Enterprise Program compliance, bonding requirements, and Office of Economic and Small Business Development certifications.

Section 26-125(d) of the Broward County Code of Ordinances (“Criminal History Screening Practices”) requires that a Vendor seeking a contract in the amount of $100,000 or more with Broward County shall certify:
A. Vendor has implemented, or will implement upon award of the contract, policies, practices, and procedures regarding inquiry into the criminal history of an applicant for employment, including a criminal history background check of any such person, that preclude inquiry into an applicant's criminal history until the applicant is selected as a finalist and interviewed for the position.
B. This requirement shall apply only to positions located within the United States that will foreseeably perform work under a contract with Broward County.
C. The failure of Vendor to comply with Section 26-125(d) at any time during the contract term shall constitute a material breach of the contract, entitling Broward County to pursue any remedy permitted under the contract and any other remedy provided under applicable law.
D. If Vendor fails to comply with Section 26-125(d) at any time during the contract term, Broward County may, in addition to all other available remedies, terminate the contract and Vendor may be subject to debarment or suspension proceedings consistent with the procedures in Chapter 21 of the Broward County Administrative Code.
