About this file

This is a Contractor Residency Statement form issued by the State of Texas governing bidder eligibility for a driveway and paving improvements project at Arlington Fire Department Station 15, located at 906 Eden Rd, Arlington, TX 76001. The project requires all labor, materials, equipment, and supervision necessary to remove and dispose of existing concrete pavement, sidewalks, and curbs, and replace them with new concrete pavement, sidewalks, and curbs, including preparation and installation of required base and subgrade. All work shall be completed in accordance with project plans and specifications prepared by Simon Engineering & Consulting, dated February 11, 2026. The City of Arlington strongly encourages electronic bid submissions; paper bids must be submitted in sealed envelopes labeled with company name, solicitation number, and title. Late bids will not be accepted. All solicitations are disseminated exclusively through Euna Procurement, and the City of Arlington accepts no responsibility for solicitations received through other means.

The Texas Government Code section 2252.002 establishes residency requirements for contract awards. Texas resident bidders must complete the appropriate residency attestation on the form. Non-resident bidders (those with corporate offices or principal places of business outside Texas) must disclose their state of origin and the percentage by which their bid must be lower than resident bidders as determined by Texas state law and the annual list published by the Texas Comptroller. The Principal Place of Business in Texas is defined as having at least one permanent office in Texas from which business activities other than bid submissions are conducted and at least one employee working in that office. Failure of out-of-state or non-resident contractors to complete the residency statement will automatically disqualify their bid. This residency requirement does not apply to contracts involving Federal Funds.

CONTRACTOR RESIDENCY STATEMENT

The Texas Government Code section 2252.002 governs the awarding of contracts to non-resident bidders. This law provides that, in order to be awarded a contract as low bidder, a non-resident bidder (out-of-state contractor whose corporate office or principal place of business is outside the State of Texas) bid projects in Texas at an amount lower than the lowest Texas resident bidder by the same amount that a Texas resident bidder would be required to underbid a non-resident bidder in order to obtain a comparable contract in the state in which the non-resident's principal place of business is located. The appropriate blanks in the following statement must be filled out by all out-of-state or non-resident bidders in order for those bids to meet specifications.

The failure of out-of-state or non-resident contractors to do so will automatically disqualify that bidder. This does not apply to contracts involving Federal Funds.
