About this file

This is an Affidavit of Eligibility form issued by the City of Midland, Texas, applicable to bids valued between $50,000 and $100,000 for services and up to $500,000 for commodities. The form implements Texas Local Government Code 271.9051, which allows the City to consider local bidders whose principal place of business is located within Midland city limits. Bidders must submit the completed affidavit to Erika Martinez, Purchasing Manager, at the City of Midland's purchasing office located at 300 N. Loraine Street, PO Box 1152, Midland, Texas 79702-1152. Incomplete affidavits may be rejected by the City.

The affidavit requires bidders to provide detailed information regarding their local business status, including confirmation that the listed address represents their principal place of business, the number of City of Midland residents employed at the location, and the year the business was established locally. Bidders must also disclose reseller permit information if applicable, identify any additional Texas office locations, and confirm whether the business paid local business and real property taxes to the City of Midland in the most recent tax year. Local bidders whose bids are within five percent of the lowest bid price may receive preferential consideration if the City Council determines that the local bidder provides the best combination of contract price and economic development opportunities, including local employment and increased tax revenues. Affidavits submitted under penalty of perjury; intentional submission of false information results in a one-year prohibition from bidding on City of Midland contracts.
