About this file

This is an Amendment to a Solicitation (Amendment No. 0001) issued by the Department of Veterans Affairs, National Cemetery Administration Contracting Services for solicitation 36C78627Q50002. The amendment addresses 16 substantive concerns raised during the pre-solicitation phase regarding the original Statement of Work, wage determinations, ordering periods, evaluation criteria, and contract terms for sod installation and related lawn maintenance services at Jefferson Barracks National Cemetery.

Key clarifications and revisions include: corrected turf-quality, sod thickness, and acceptance criteria language; confirmation that Jefferson Barracks has not held a prior sod installation contract with the referenced bidder; removal of references to the A-LIST standard; revised evaluation schemes and acceptability standards; correction of the wage determination document; alignment of the IDIQ ordering period with the base performance period beginning April 1, 2027; clarification that the Service Contract Act price-adjustment clause is not required as contract value is not expected to exceed the simplified acquisition threshold; and definition of the 30-day guarantee and replacement duty terms. The government asserts its discretionary authority to establish the $1,000 guaranteed minimum and maximum contract values based on estimated demand, budgetary constraints, and market research. The estimated annual quantity is 40,000 units per contract year. Offerors must acknowledge receipt of this amendment prior to the deadline specified in the original solicitation, either by completing items 8 and 15 and returning one copy, acknowledging receipt on each offer submitted, or via separate letter or electronic communication referencing the solicitation and amendment numbers.

The purpose of this amendment is to:

(1) Provide amended Combined Solicitation, Statement of Work and Wage determination.

(2) While no questions were directly asked, concerns listed below are addressed.

April Graves

Contracting Officer

Q1: — The turf-quality provision (SOW ¶ A.1(b)) is internally contradictory.

A1: See revised SOW.

Q2: — The sod standard and the seed standard for this cemetery cannot be reconciled. This is a red-line issue for ****.

A2: **** has given a false statement. Jefferson Barracks has not held a contract for sod installation with

**** in the previous 10 years.

Q3: — The record shows no documented basis for dropping the established A-LIST standard.

A3: **** has given a false statement. The A-list standard has not been listed in the previous 3 contracts for Sod and installation.

Q4 — Acceptance turns on undisclosed, subjective criteria.

A4: See revised SOW.

Q5: — The SOW states two irreconcilable sod thicknesses.

A5: See revised SOW.

Q6: — Conflicting units of measure and undefined order limits.

A6. The clause referencing min/max orders references monetary amounts not sod measurements.

Q7: — The IDIQ ordering period ends before the base performance period begins.

A7: See Amended Solicitation

Q8: — The wrong wage determination is attached.

A8: See Amended Solicitation

Q9: — Conflicting question and quotation deadlines.

A9: See Amended Solicitation

Q10 — The evaluation scheme conflicts with itself and the acceptability standard is undefined.

A10: See Amended Solicitation

Q11 — Four one-year options are priced with no proper term-extension mechanism.

A11: See Amended Solicitation

Q12 — The availability-of-funds date precedes performance.

A12: The clause is correct as is for timeframes solicitation is issued. The Clause date may be changed prior to award, as funds become available.

Q13 — The required Service Contract Act labor price-adjustment clause is missing.

A13: FAR 52.222-41 is required for service contracts over $2,500. FAR 52.222-43 is required over the simplified acquisition threshold (SAT). Contract value is not expected to exceed SAT.

Q14 — The 30-day guarantee and one-to-two-day replacement duty are undefined.

A14: See Amended SOW

Q15 — The site-manager and staffing language is overbroad for an as-needed IDIQ.

A15: See Amended SOW

Q16: — The $1,000 guaranteed minimum is nominal and the IDIQ limits lack a stated basis.

The government retains broad discretion to set minimum and maximum contract values as it determines necessary to meet program and procurement objectives. This includes selecting minimums, and setting aggregate maximums based on factors such as estimated usage, budgetary constraints, or market research.

While FAR 16.504-1(b) specifies that the minimum quantity should not be merely nominal, and FAR

16.504-1(c) requires the maximum to have a rational basis, ultimately these thresholds are established at the government's discretion and can be adjusted to reflect anticipated demand, operational needs, and risk allocation considerations.

The Government retains the sole authority and discretion to define, clarify, amend, or revise its technical requirements and specifications in accordance with applicable federal laws and regulations, including the

Federal Acquisition Regulation. The requirements stated in the solicitation represent the Government’s needs and mission priorities.

The Government welcomes meaningful feedback from industry partners to enhance clarity and fair competition. All timely, substantive concerns will be considered, and, if appropriate, may result in amendment to the solicitation. However, the Government is under no obligation to adopt suggested changes and will adhere to the requirements as stated in the final solicitation and any subsequent amendments.

2. Applicable wage determination

Use latest posted documents.

3. Ordering and performance dates

The solicitation identifies an anticipated base performance period beginning April 1, 2027.

However, the ordering-period language under FAR 52.216-18 appears to provide dates that precede the anticipated base period. Please confirm the correct ordering period for the base year.

4. Estimated annual quantity

Estimated 40,000 per contract year

5. Past-performance submissions

The Government will evaluate the Past Performance of the Prime

Vendor (i.e. the offeror) proposed to perform a major portion of the requirement. The

Government may, but is not required to, also consider relevant past performance information regarding predecessor companies, key personnel, or subcontractors that will perform major or critical aspects of the requirement when the Government determines such information to be pertinent to this acquisition. The past performance evaluation factor assesses the degree of confidence the Government has in the an offeror's ability to supply products and services that meet users' needs, based on a demonstrated record of performance. For evaluation of Past Performance, the

Government may use information from any sources available to it including, but not limited to, the Contract Performance Assessment Reporting System (CPARS) and the attached Past Performance Questionnaire.
