About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Department of Veterans Affairs (VA) Network Contracting Office 23. The solicitation is for Duty and Training Ammunition for VA VISN 23 Police Service, set aside 100% for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs). The procurement includes two primary ammunition types: Duty Ammunition (Handgun: 9mm HST, 41,750 rounds; Long Gun: .223/5.56mm Soft Point, 36,500 rounds) and Training Ammunition (Handgun: 9mm Ball/TSJ, 217,500 rounds; Long Gun: .223/5.56mm Full Metal Jacket, 61,000 rounds).

The procurement is a VISN-wide Firm Fixed-Price Indefinite Delivery/Indefinite Quantity (IDIQ) contract with a base year and four option years. Brand-name restrictions are imposed due to historical issues with non-brand ammunition, including weapon damage and training interruptions. Acceptable brands for duty ammunition include Speer, Federal, Remington, Sig Sauer, and Winchester. The solicitation will be posted on SAM.gov, and the contracting office anticipates competition among multiple SDVOSBs. Delivery orders will be placed against the base IDIQ and delivered 30 days after receipt to multiple locations within VA VISN 23.

4. Statutory Authority Permitting Other than Full and Open Competition:

Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by RFO 6.103-1, MODIFIED for BRAND-NAME ONLY according to FAR 6.103-1(d) and FAR 6.104.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The Duty ammunition listed above is Brand-Name Only according to the guidelines published by the VA Law Enforcement Training Center (VA LETC) It is published in multiple documents including their Firearms Program Pistol Training Unit 18 (Sep 2025) and also VA Police Model SOP IV effective 10/01/24. The Brand-Name Only Duty Ammunition requirement complies with VA LETC guidelines.

The Training ammunition listed above, according to VA LETC, must meet “VA Police National Model SOP 4F. Training ammunition may be of any brand, produced by a reputable manufacturer, and meets Sporting Arms and Ammunition Manufacturers’

Institute (SAAMI) specifications, with a velocity from 930 feet per second (FPS) to 1170 FPS (SAAMI Z22939-2022, p. 9). Reloaded ammunition is prohibited.”

However, the VA Police Service is allowed to have stricter requirements and in this procurement, we do; we require the Training Ammunition to be Brand-Name Only as described in the supply list above for the following reason - historically, the non-brand name ammunition procured has included faulty rounds. The VA needs to reduce and eliminate the problems that have resulted from faulty ammunition of past procurements which have damaged weapons, slowed down training, caused time spent investigating and writing reports and overall interferes with the work and training of our Police Units.

For these reasons, the particular brands requested for the Brand Name Only portions of this solicitation are essential as the description of this requirement and precludes purchase of brands not listed in the Statement of Work.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):

Our Brand-Name Only requirements include multiple brands expanding competition beyond Brand-Name Only requirements where the brand and model are of only one manufacturer.

Contracting Officer knowledge of the industry, and reviews of procurement history indicate that this contracting office will be able to establish sufficient competition using SDVOSB set-aside procedures with the Brand-Name Only requirements included. We fully anticipate more than two SDVOSBs to participate which will exceed the minimum of two to use set-aside procedures.

This solicitation will be posted on SAM.gov.

7. Determination by the CO that the Anticipated Cost to the Government will be

Fair and Reasonable:

We anticipate the use of competition through Set-Aside procedures will obtain fair and reasonable pricing. We also intend to compare pricing obtained to historical pricing obtained to ensure pricing is fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
